BOARD OF ADJUSTMENT REGULAR MEETING OCTOBER 22, 1985
MINUTES OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF FRIENDSWOOD THAT WAS HELD ON OCTOBER 22, 1985 AT CITY HALL AT 7:00 P.M. WITH THE FOLLOWING MEMBERS PRESENT:

CHAIRMAN DYKES CALLED THE MEETING TO ORDER AND APPOINTED STEVE JOHNSON·TO SERVE AS REGULAR MEMBER.FOR THIS MEETING.
CHAIRMAN DYKES CALLED TO ORDER A PUBLIC HEARING FOR THE PURPOSE OF RECEIVING TESTIMONY FROM INTERESTED PERSONS· REGARDING THE REQUEST FROM DAVID H. MAAROUF TO HAVE HIS HOME AT· 5354 APPLEBLOSSOM, WEDGEWOOD VILLAGE SUBDIVISION, BUILT FACING APPLEBLOSSOM STREET INSTEAD OF CREEKVIEW COURT.·
MR. MAAROUF PRESENTED HIS REASONS SIMPLY AND THERE WAS DISCUSSION FROM THE BOARD MEMBERS TO HIM.
CHAIRMAN DYKES THEN ASKED FOR PUBLIC INPUT REGARDING REQUEST FROM A.P. NICKERSON·OF ·905· BRIARMEADOW, REGENCY ESTATES SUBDIVISION, TO HAVE A· SIDE.SETBACK OF THREE FEET FOR A CARPORT.·
MR. NICKERSON STATED HE WOULD LIKE TO HAVE A CARPORT BUILT THAT WOULD· BE OVER HIS MOTORHOME. · HE · PRESENTED A LETTER FROM MR. AND MRS.· ELMO ROBINSON,903 BRIARMEADOW, STATING THAT THEY WOULD NOT OBJECT TO IT BEING .NEXT TO THEIR PROPERTY EVEN· IF ·IT WILL BE ONLY 10 FEET FROM THE PROPERTY LINE. THERE WAS MUCH· DISCUSSION FROM THE BOARD WITH MR. NICKERSON�
CHAIRMAN DYKES ASKED FOR PUBLIC INPUT REGARDING REQUEST FROM HARRIETT S. CHANEY, OF· 1310 OAK HOLLOW DRIVE, WILDERNESS TRAILS SUBDIVISION, TO · REQUEST A VARIANCE OF SIDE BUILDING · LINE OF APPROXIMATELY FIVE FEET.EVELYN NEWMAN SPOKE IN MS.CHANEY'S PLACE". SHE STATED THAT MS. CHANEY WOULD LIKE A WAIVER OF ENCROACHMENT BECAUSE ·SHE· IS TRYING TO PURCHASE THE HOME WHICH IS ALREADY BUILT� MS. HENLEY NEEDS A VARIANCE TO CLOSE ON THE LOAN. THERE WAS AN ENCROACHMENT OF· SIDE BUILDING LINE'S WHEN GENERAL HOMES BUILT ALL · THE HOMES AND GENERAL HOMES ·SIGNED A· WAIVER WHEN ENC ROACHMENT CAME UP. ·TODD·STEWART WENT OUT TO THE PROPERTY IN

THE SUMMER AND CAREFULLY MEASURED. THERE WAS ONLY A 15 FOOT SIDE.
BUILDING LINE WHEREAS THERE SHOULD HAVE BEEN A 20 FOOT SIDE
BUILDING LINE FOR A CORNER LOT.
CHAIRMAN DYKES CALLED FOR PUBLIC INPUT REGARDING REQUEST FROM
CHARLEY HENLEY-, OF SUN MEADOW -COMMUNITY ASSOCIATION, TO ADD" TWO
SIGNS TO THE SECOND -ENTRANCE TO THE SUBDIVISION. -THE LOCATION
FOR THE SIGNS- IS AT THE INTERSECTION OF *FM528 AND CYPRESS POINT
ENTRANCE. MR-. HENLEY PRESENTED PICTURES' AND STATED HIS' CASE FOR
THE BOARD MEMBERS. DISCUSSION FOLLOWED THE PRESENTATION-. -
CHAIRMAN DYKES ASKED FOR PUBLIC INPUT REGARDING JIM FIELD, OF
FIELDCREEK 'FOREST SUBDIVISION, TO REQUEST :AN -INCREASE IN SIZE OF
A SIGN AT THE LOCATION OF- THE CORNER OF FM 528 AND WINDING WAY. -
MR. FIELD STATED THAT HE HAS HIRED A COMPANY TO FIND OUT HOW
LARGE- A. SIGN NEEDS :TO BE FOR- INDIVIDUALS TO - SEE WHEN - THEY ARE
DRIVING ON FM528. -- THE SIZE WAS 4X4 FEET'. HE SAID THERE IS NO _
SIGN 'FOR WINDING WAY, - SO THE- ONLY WAY THE SUBDIVISION CAN BE
FOUND IS FROM -A LARGER SIGN. ' THERE WAS DISCUSSION AND QUESTIONS.
HEARING NO FURTHER INPUT, CHAIRMAN CLOSED THE PUBLIC HEARING.
CHAIRMAN DYKES ASKED FOR ANY INPUT ON THE APPLICATION OF
DAVID MAAROUF, OF 5354 - APPLEBLOSSOM.- THERE WAS SOME DISCUSSION-.
MAURICE ESTLINBAUM MADE THE MOTION TO GRANT THE VARIANCE FOR HI.S
HOME TO FACE APPLEBLOSSOM WITH THE -CONDITION THAT HE GET A- LETTER
OF APPROVAL FROM THE NEW WEDGEWOOD VILLAGE HOMEOWNERS -ASSOCIATION
STATING THAT- THIS IS ALRIGHT -FROM THEIR BOARD. THE LETTER WOULD
BE GIVEN- TO- NICK CAPUANO AND THEN A COPY OF THIS LETTER- FORWARDED
ONTO THE BOARD- OF ADJUSTMENT- SECRETARY FOR THE- PERMANENT RECORD
FILE. SECONDED BY DR. -TOM SULLIVAN. MOTION APPROVED. -
MR. A.P. NICKERSON, OF 905 BRIARMEADOW, DISCUSSED WITH THE BOARD
HIS PLANS TO BUILD THE CARPORT FOR -HIS MOTORHOME. - HE HAS GONE`
• BEFORE THE' ARCHITECTURAL COMMITTEE IN. REGENCY ESTATES AND THEY
ASKED HIM TO GO BEFORE THE BOARD OF ADJUSTMENT AND ASK ' -FOR A
VARIANCE AND TO THEN HOLD OFF BUILDING .IT' FOR SEVERAL MONTHS
UNTIL THEY HAVE TIME TO MAKE- NEW BYLAWS FOR ` THEIR SUBDIVISION.
A`LENGTHY DISCUSSION FOLLOWED CONCERNING DEED RESTRICTIONS. THE
BOARD ' ASKED -- THAT ' MR. ' NICKERSON -GET A LETTER- FROM THE
ARCHITECTURAL COMMITTEE STATING- THEY -ARE IN FAVOR- OF HIM BUILDING
THE CARPORT. THEN- . TO COME BACK BEFORE THE. BOARD TO ASK FOR -A
VARIANCE WITHOUT A.FEE BEING CHARGED'. THE BOARD -WAS IN- FAVOR OF
THIS AND IT' WAS TABLED. - -
DR. TOM SULLIVAN MADE THE MOTION TO GRANT THE VARIANCE OF SIDE
BUILDING LINE OF FIVE -FEET TO MS. -HENLEY AT 1310 OAK HOLLOW DRIVE
IN WILDERNESS TRAILS SUBDIVISION. ELVIA SALYER SECONDED. MOTION
APPROVED. ' -

CHARLEY HENLEY,OF THE SUNMEADOW COMMUNITY ASSOCIATION, THAT HE WAS ONLY ASKING FOR 2 SIGNS TO BE PLACED AT THE SECOND ENTRANCE TO THE SUBDIVISION AT CYPRESS POINT AND FM528. DISCUSSION FOLLOWED. -STE.VE JOHNSON MADE THE MOTION TO ALLOW 2 SIGNS TO BE PLACED AT THE ENTRANCE TO SUNMEADOW SUBDIVISION, AT CYPRESS POINT AND FM528, AND NOT TO EXCEED 50 SQUARE FEET MAXIMUM.MAURICE ESTLINBAUM SECONDED THE MOTION. MOTION APPROVED.
JIM FIELD, OF FIELDCREEK FOREST SUBDIVISION, STATING AGAIN HIS REASONS FOR WANTING A LARGER SIGN OF 4X4 FEET AT ·FM528 AND WINDING WAY. DR. TOM SULLIVAN STATED-THAT HE IS PUTTING ALOT OF EMPHASIS ON THE SIGN· ·FOR HIS SALES. THERE WAS -A LENGTHY DISCUSSION BETWEEN THE MEMBERS AND JIM FIELD. THE BOARD DID AGREE THAT THEY NEED A VALID REASON TO GRANT A -VARIANCE. DR. TOM SULLIVAN MADE ·THE MOTION TO DENY THE -VARIANCE. ELVIA SALYER SECONDED. THE VOTE WAS UNANIMOUS�
THE MINUTES WERE READ AND APPROVED FROM SEPTEMBER 24, 1985.
MOTION WAS MADE AND SECONDED TO ADJOURN AT 8:45 P.M.
