HomeMy WebLinkAboutZBOA Minutes 1984-09-25 Regular NIlNUTES OF A REGULAR MEETING OF THE FRIENDSWOOD ZONING BOARD OF ADJUSINEI1r III September 25, 1984 A meeting of the Friendswood Board of Adjustment was held in the Council Chambers at City Hall on Tuesday, September 25, 1984, at 7:00 p.m. with the following members present: Chairman Ed Dykes Nick Capuano, Building Inspector. ' Ray Nelson Vance Riley, Fire Marshal Elvia Salyer Pamela Henry, Secretary Maurice Estlinbaum (Alternate Serving) With a quorum present, the following business was transacted: WILLIAM E. JACOBS Mr. Jacobs asked to build a detached garage at 1407 Edinburgh, in the Regency Estates Subdivision, behind the 10 foot building line on a side street. Mr. Jacobs requested a variance for the required 20 foot set back. The plats that Mr. Jacobs reviewed, recorded at Galveston County Courthouse in Galveston, Texas, Volume 15, Page 146, show the building line for Regency Estates as 10 feet from the property line and not 20 feet as the City of Friendswood Zoning III Ordinance requires when siding a street. If Mr. Jacobs complies with the 20 foot building line he will have to cut down a tree and the placement of the garage will not go as well with the design of the house. Nick Capuano stated that the other homes in this neighborhood are in compliance. The contractor on this project began work without Mr. Jacobs' know- ledge. Mr. Jacobs has the approval of the Regency Estate Homeowners' Association but he did not have a copy of the letter with.=him:stating this . The Homeowners' Association approves the construction of a detached garage on lot 4 block 7 of Regency Estates. Ingress and egress of the garage is to be on Windsor Drive. The physical location of the garage is to be behind the 10 foot building line on the lot side adjoining Windsor Drive. There is a 10 foot tax free right of way on Mr. Jacobs' property. With this easement and the 10 foot building line the curb would be approximately 26 feet from the garage by Mr. Jacobs' estimate. MOTION: (Nelson) To grant a variance that allows Mr. Jacobs to build his structure at least 20 feet from the curb. Second: Dykes r Vote: 2 FOR 2 AGAINST (Salyer and Estlinbaum) M:)TION FATTED III Mr. Ralph Miller, Chairman of the Planning and Zoning Commission, who was present for the meeting, adriPd that the structure is supposed to be 28 feet from the curb by City standards. Plats of Regency Estates Subdivision wer reviewed by members of the board. The plats showed a 10 foot building line. MOTION: (Estlinbaum) To grant a variance for the closest part of the garage to be 22 feet from the curb with the stipulations that the plat recording in Gal- veston County for Regency Estates shows a 10 foot building line on it and that Mr. Jacobs give a letter to the Board of Adjustment from the Homeowners' Assoc- iation stating that they approve. Second: Salyer Vote: Unanimous FOR NOTION CARRIED FRENCHMAN'S CREEK Mr. Bob Melton,--representing Frenchman's Creek, requested a six months extension of their sign variance for a directional sign located at FM 528 and Winding Way. The sign is approximately 42 square feet, therefore,:making-itl'in compliance with the -Sign Ordinance which permits a sign up to 50 square feet. Only 6 out of 20 units was occuppied when Frenchman's Creek originally came before the board to request a variance. They now only have 7 vacancies. The minutes of the Board of Adjustment meeting-for February6.28, 1984 show that Mr. Melton.was granted a variance for a sign that was no more than 32 ,square feet. This is an off premise sign. NOTION: (Salyer) To deny the request for a variance for a directional sign at the corner of FM 528 and Winding Way. Second: Estlinbaum Vote: Unanimous FOR MYTION CARRIED SOUTHERN GROUP Mr. DonrBarras, representing Southern Group, requested a 3 month extension of their sign variance for three directional signs located in the Sun Meadow Sub- division. They have 10 out of 28 lots that have not sold. The signs are not on the property being sold but they are in the same subdivision. RATION: (Estlinbaum) To accept the request for a 3 month extension for three 12 foot by 2 foot directional signs. Second: Dykes Vote: Unanimous FOR NOTION CARRIED ADJOURNMENT Motion was made and seconded that the meeting adjourn. The meeting was adjourned. Pamela Henry, Secretary APPROVED: Fri nUI.CPc Chairman
