A meeting of the Friendswood Board of Adjustment was held in the Council
Chambers at City Hall on Tuesday, October 30, 1984, at 7:00 p.m. with the
following members present:
Chairman Ed Dykes Nick Capuano, Building Inspector
Ray Nelson • Pamela Henry, Secretary
Elvia Salyer _
Tom Sullivan
With a quorum present, the following business was transacted:
PULTE HONE CORPORATION
Mr. Craig A. Dudley, representing Pulte Home Corporation, requested a variance
for the sideline set, back at 1508 Bayou Oak Drive in Friendswood, Texas.
The Board of Adjustment received a letter dated October 23, 1984, from
Mr. George Palmer, who contracted the home at 1508 Bayou Oak Drive to be
built. The house is nearly completed and the Palmers have planned to move
in on or before November 1, 1984. They must be out of their current residence
by November 1, 1984. If a variance is not granted they will be unable to
move in until December 1, 1984.
The board also reviewed a letter dated October 23, 1984, from Pulte Home
Corporation that stated the house was in violation of the Friendswood Zoning'
Ordinance which requires a sideline set back for a residential building to
be a minimum of 10 feet-from the property line. The deed restrictions for
Wilderness Trails, the subdivision in which this house is in, only requires
a 5 foot sideline set back: This .is the first production house that Pulte
Home Corporation has built in the City of Friendswood.
The third letter the board reviewed was a. notarized letter from Pulte Home
Corporation dated October 24, 1984, stating that in accordance with the
variance issued by the City of Friendswood (if the Variance is granted) for
1508 Bayou Oak Drive in Friendswood, Texas, Pulte Home Corporation will
maintain a twenty foot distance between structures on both sides of the
house. '
Discussion was held regarding all three letters.
MD'TION: (Sullivan) To grant a variance for sideline set back at 1508
Bayou Oak Drive as long as the notarized letter dated October 24, 1984,
from Pulte Home Corporation, is complied.with.
Second: Nelson
Vote: Unanimous FOR MOTION CARRIED
NATIONAL CONVENIENCE STROES, INC.
Mr. John Weddle, representing National:Convenience Stores, Inc. , requested
a variance for the reqired set back line of 30 feet to be changed to 17 feet
3 inches for a Stop-N-Go store at the North West Corner of FM 528 at Sunset.
This request is being made because the State Highway Department is taking 20 feet
8 _inches of the existing site for Public Right of Way. Councilman Evelyn Newman
was present for this matter.
The board reviewed plats of the building and site. The variance would only be granted
on the basis that National Convenience Stores, Inc. donate the land for the right of
way to the State of Texas. The City of Friendswood mould conduct a market analysis
and write a letter so stating that this is the value of the property and that National
Convenience Stores, Inc. has deeded the- landto_the .City of-Friendswood. The-City_would
then in turn donate the lan to e State of Texas. This letter coul7. then be used. for
a tax write off for National Convenience Store, Inc._
MOTION: (Nelson) To-grant the variance changing the set back requir".ements as
desired by Nation Convenience Stores, Inc. with the condition that the land be
donated to the State of Texas_for a Public Right of Way.

Vote: Unanimous MR MOTION CARRIED
ADJOURNMENT •
Motion was made and seconded that the meeting adjourn. The meeting was
adjourned.

Attached for your review and acceptance by the City of Friendswood, is
the deed conveying .0649 acres approximately 20 ·feet by 150 feet for.
public right-of-way. The subject property was purchased by National
Convenience Stores approximately one year ago at a per square foot
purchase price of $15.55. Na tional Convenience Stores is agreeable to
conveying the .0649 acres,valued at $44,000. to the City of Friendswood in exchange for a waiver of the building set back line and parking
requirements on the remaining subject property being 19,675 square feet
which National Convenience Stores plan to build a SNG convenience store
selling gasoline.
Please forward to me a copy of the donations and waiver agreement for
National Convenience Stores' review.
Upon acceptance of the agreement, I will exchange a signed deed for the
$44,000. donation and building set back and parking waiver agreement.
