HomeMy WebLinkAboutZBOA Minutes 1979-09-18 Regular I , MINUTES OF A HEARING • FRIENDSWOOD BOARD OF ADJUSTMENTS SeptemberL1:8 ,11979 The Friendswood Board of Adjustments met for a hearing on Tuesday, September 18 ,11978 at 7 : 30 p.m. at the City Hall with the following members present : - Bruce Foster - Chairman Ed Dykes Hal Taylor Ray Nelson With a quorum present the following request were heard: SIGN VARIANCE 208 'EDGEWOOD Mr. Darrell Wyont of Garry Green Realty and Mr. Sam Kennedy of Federal Sign, came before the Board requesting a sign variance in the size and height of a proposed sign to be located at 208 E. Edgewood. The sign is 66 . 6 square feet and 16 feet in height. The chairman asked if there were any objections or comments from the public. There were none voiced. Mr. Kennedy presented the prints for the sign which were reviewed by the Board. Mr. Wyont stated the pre-existing sign is 72 square feet and asked that a variance be granted in order to erect a 66 . 6 square foot sign, which is the Better Homes and Gardens standard sign. He stated the sign had already been constructed, thus causing a hardship. The sign was ordered in June and the permit application applyed for July 23 , 1979 . Mr. Wyont agreed to lowering the sign 2 ' and explained to the Board that the franchise of Better Homes and Gardens request that he display the sign with their logo. The Board advised Mr. Wyont the ordinance was adopted December 18 , 1978 , and a great amount of work had been done . to enforce and compile it . They could not agree to the variance and set a precedent , which would cause future problems in enforcing the ordinance . The chairman informed Mr. Wyont he could change the copy and message on the pre-existing sign and advised him of the ordinance concerning pre-existing signs . I Ll B.0. A.9/18/79 Mr. Wyont withdrew his request stating he was misinformed on pre-existing signs and the new ordinance. It was explained to Mr. Wyont that a denial decision could be appealed to District Court. Mr. Wyont stated he would like to have time to prepare for a new request. MOTION: (Dykes) request. Second: Taylor Vote: UNANIMOUS to accept Mr. Wyonts withdrawal FOR MOTION CARRIED LOT VARIANCE -LOT 3, BLOCK 1 OF DUNBAR ESTATES Mr. Gary Townsend of 711 Tanglewood Drive has asked for a lot variance due to an incorrect survey of the side lot line. The side setback is 3.8 feet, which should be 7.5 feet as required. This constitutes a 3.7 foot variance. MOTION: (Dykes) to grant the variance making the 3.8 foot acceptable for the side setback at 711 Tanglewood. Second: Taylor Vote: Unanimous FOR MOTION CARRIED ADJOURNMENT: The meeting adjourned at 8 : 30 p.m. MOTION: " (Taylor) to adjourn the meeting Second: Nelson Vote: Unanimous FOR MOTION CARRIED 4V/*/Secry r September 11, 1979 • Friendswood Board of Adjustments c/o George Calk 109 Willowick Friendswood, Texas 77546 • Gentlemen: This letter is to request a written varience from the established procedure of a 71 foot side set back for the dwelling at 711 Tangle- wood Drive, legal description as follows: Lot 3, Block 1, Dunbar Estates, Sec. 1, • Galveston County, Texas The reason this request is necessary is that the lot was surveyed and flaged incorrectly, at the time the house was built, by Shanks Surveyors in 1977. This error was discovered in August, 1979, due to the fact that lot five, of the same block, and subdivision was sold requiring a new survey by the buyer and lendor. We have en- closed copies of the original survey at the time of our closing, certified on 12/19/77, and the current survey certified on 8/17/79. Both surveys certified by Shanks Surveyors ofHouston, Texas. As you can see by the current survey, our home has only a 3.8 foot at the left side rear corner, thus, requiring our request for this varience. • Your help and cooperation in this matter is appreciated.
