ZONING BOARD OF ADJUSTMENT
1. The meeting was called to order at 7:00 pm with the following people in attendance:
Chairman Greg Hughes Vice Chairman Ron Dyer
Regular Member Steve Knis Regular Member Delvin Kendrick
Regular Member David O’Brien City Attorney Arnold Polanco
Brian Rouane, Building Official Jim Hill, Councilmember
Aubrey Harbin, Dep. Dir. of CDD/Planner Becky Summers, Development Coordinator
Alternate Members Present: Linda Thornton, Glen Mintz, Mike Czarowitz
Absent: Alt. Member Glen Grayban
Chairman Hughes explained the procedure of the meeting and explained that 4 out of 5 votes are
required in order for a request to be approved. He stated that if a request is not granted, the applicant has
10 days to file an appeal to Galveston County. Vice Chairman Dyer administered an oath to everyone
who would be speaking during the meeting.
2. The Board conducted a public hearing to consider a request to allow a fence to encroach the front
building line on the property located at 2201 Pleasant Hill Dr., West Ranch Lakeside Section 2,
Abstract 9, Block 2, Lot 17, Friendswood, Galveston County, Texas
A. Staff Presentation
Brian Rouane, Chief Building Official, stated a building inspector noticed the work and contacted a
code enforcement officer to investigate. The contractor was notified to stop work until a building
permit had been obtained. The application was submitted indicating a 3-foot encroachment. When
the building department went back out and measured the fence structure, it encroached the front
build line by 8-feet.
B. Applicant Presentation
Jimmy Brown, general contractor and owner of J. Brown Construction, said they had obtained
approval from the Home Owner Association but not the City.

Knis asked why the applicant would be building a fence in the front yard at all. Rouane answered
structures, including fences, are allowed up to the front building line.
Dyer clarified that the contractor erected the fence without a City permit.
Hughes asked Brown if he was aware of the smaller 20' setback on cul-de-sac lots. Brown said he
was aware and thought he was close to the build line. Brown stated he could have done a better job.
Hughes asked if the fence could be moved back into compliance. Brown said yes, they would need
to tear out the concrete and rerun the electric lines. He said it would cost roughly $4,000.
Dyer stated the variance request did not meet the five rules for granting.
