HomeMy WebLinkAboutZBOA Minutes 2011-09-27 Regular[ ZONING BOARD OF ADJUSTMENT MINUTES OF A REGULAR MEETING HELD TUESDAY, SEPTEMBER 27, 2011 AT 7:00 PM CITY HALL COUNCIL CHAMBERS 910 S. FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS PUBLIC HEARING 1.Call to order 2. The public hearing was called to order at 7:00 pm with the following present: Chair Ron Dyer Vice Chair Greg Hughes Regular Member Delvin Kendrick Regular Member Steve Knis Alternate Member Mike Czarowitz Dep. Dir. of Community Dev. Frank Manigold Board Secretary Mona Miller P & Z Liaison Mark Tibbitts City Attorney Steve Weathered Alternate Members Linda Thornton and Carol Thelen were in the audience. Regular Member David O'Brien, III and Alternate Member Glen Grayban were absent. Receive comments from the public, both oral and written, regarding: A.A request for an appeal, a variance, or a permanent special exception for prope1ty located at 605 N. Clear Creek Drive. Applicant Allen Small stated that he has lived in this home for over thi1ty years. He explained that when Hurricane Ike hit in 2008, he had fifty trees down and his little enclosure for garbage cans was destroyed. Mr. Small said he fought with his insurance company and finally sought legal assistance, who told him not to do any repairs. He explained that this went on for almost three years, but he has finally settled with the insurance and the repairs are now about seventy five percent complete. Mr. Small mentioned that he contacted residents within two hundred feet of his property and turned in a petition stating no objection from those neighbors. No one spoke in opposition to the request. 3.Consideration and possible action regarding a request for an appeal, a variance, or a permanent special exception for property located at 605 N. Clear Creek Drive A lengthy discussion ensued regarding Mr. Small's request and which option he thought would be appropriate and why. Also discussed was why he didn't just build it in compliance with the current ordinance. Mr. Small stated that his previous building was similar in size to this building at 10' x 12'. He said that he used the building for storing his trash cans in and keeping animals out. Mr. Manigold explained the photos he had given to the Board members marking the property line and where the building sat in relation to it. Mr. Weathered asked the applicant a series of questions about when the previous building was built and whether he had acquired a permit for it. Mr. Small stated that he didn't remember whether a permit was pulled for the building or not. Motion to approve appeal: Hughes Second: Kenrick Vote: 0 to 5 Motion failed Motion to approve varia11ce: Knis Second: Kendrick Vote: 0 to 5 Motion failed Motion to approve per111a11e11t special exceptio11: Hughes Second: Czarowitz Vote: 0 to 5 Motion failed Chairman Dyer reminded the applicant that he can file an appeal to the Galveston County Court within ten days of his denial from the ZBOA. Mr. Manigold added that Mr. Small will receive a written notice in the mail for thirty days to remedy the non-compliant structure. 4.Consideration and possible action regarding approval of minutes for the: A.May 24, 2011 regular meeting Motion to approve: Kendrick Second: Knis Vote: 5 to O (unanimous) B.June 7, 2011 special meeting Motion Carried Motion to approve with corrections of who was in attendance: Czarowitz Second: Knis Vote: 5 to O (unanimous) 5.Adjournment The meeting adjourned at 7:45 pm.
