HomeMy WebLinkAboutZBOA Minutes 2011-06-07 RegularPUBLIC HEARING 1.Call to order ZONING BOARD OF ADJUSTMENT MINUTES OF A REGULAR MEETING HELD TUESDAY, JUNE 7, 2011 AT 7:00 PM CITY HALL COUNCIL CHAMBERS 910 S. FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS The public hearing was called to order at 7:04 pm with the following present: Chair Ron Dyer Regular Member Steve Knis Regular Member Delvin Kendrick Regular Member David O'Brien, III Alternate Member Linda Thornton Dep. Dir. of Community Dev. Frank Manigold P & Z Liaison Mark McLean Board Secretary Mona Miller Alternate Member Glen Grayban was in the audience. Vice Chair Greg Hughes, Alternate Member Mike Czarowitz and Alternate Member Carol Thelen were absent. 2.Receive comments from the public, both oral and written, regarding: A.A request for an appeal, a variance, or a permanent special exception for prope1ty located at 902 Tall Pines Drive, being Lot 4, Block 2 of Coward Creek Section 2 in Galveston County, Texas Motion to remove the variance from table: O'Brien Second: Kendrick Vote 4 to 1 (Knis) Motion carried Applicant Tim Parker spoke in support of the request. He explained that he does not care how the request is approved but that he is asking to enclose the existing breezeway for a laundry room connecting the garage and the house. He stated that he does not understand why there are different setbacks for an attached garage and a detached garage. Mr. Parker showed photos of the existing home and garage where he wants to enclose the breezeway, which is currently an approximately 16' x 16' screened in area. He added that at the last meeting he had mentioned the problems that he has had with dryers in the house; however, he did not fully explain the issue. He stated that currently the washer and dryer are in an area of the house where the dryer can not directly vent. Therefore, the vent makes a long run with a series of ninety degree turns and it gets clogged up and overheats. With the addition, Mr. Parker will be able to move the washer and dryer into the new laundry room where the breezeway is currently, along with a sink and two refrigerators. Ron Brown, a neighbor that lives two doors down spoke in support of the request. He said he has lived there for thitty two years and that Mr. Parker is a good neighbor and always has good intentions. Mr. Brown added that he has no objections to the proposal because Mr. Parker is improving the house. Mike Muntz, president of the architectural committee since 1982, stated that four people overlooked the encroacluuent before Mr. Parker bought the house. He explained that the developer Al O'Farrell, Mrs. Hammersly, the foundation contractor and the city inspector all overlooked it. He added that Mr. Parker is making the property better. Mr. Manigold explained that the Zoning Ordinance requires the main structure to be 10' from the side property line. A detached garage is considered an accessory structure and can be 5' from the property line. He added that by attaching the garage to the house, it becomes a part of the main structure; thereby requiring the 1 O' side yard setback. Mr. Manigold added that the required separation of structures is to reduce the chance of fire jumping from one house soffit to another. A lengthy discussion ensued regarding the possibility of the garage eventually being converted to living area and whether that would make a difference in the setback requirement. Mr. Manigold stated that if the request is approved, it is possible that the garage could possibly be converted into living area as long as it had two means of egress and fire protection. He also reminded the applicant to seek approval from the homeowners association. Ron Brown reiterated his support for the request. Van Williams, president of the homeowners association, stated that plans have not been submitted to the architectural conuuittee as of yet; however he does not see anything wrong with the request. He added that it does not matter whether the garage is attached or detached, but that it will just have to be architecturally appealing. No one spoke in opposition to the request. 3.Adjournment The public hearing adjourned at 7:26 pm. Vice Chair Greg Hughes, Alternate Member Mike Czarowitz and Alternate Member Carol Thelen were absent. 2.Consideration and possible action regarding a request for an appeal, a variance, or a permanent special exception for prope1ty located at 902 Tall Pines Drive, being Lot 4, Block 2 of Coward Creek Section 2 in Galveston County, Texas Motion to remove the variance from table: Knis Second: Kendrick 2 ..f./ Vote 5 to 0 Motion carried O'Brien clarified with Manigold that the side yard setback requirement changes from 5' to 10' when changing the detached garage to an attached garage. Motion to approve appeal: O'Brien Second: Dyer Vote: 0 to 5 Motion to approve variauce: Knis Second: Thornton Vote: 0 to 5 Motion to approve pen11a11e11t special exception: Knis Second: Kendrick Motion failed Motion failed Vote: 5 to 0 Motion carried 3.Consideration and possible action regarding approval of minutes for the: A.May 24, 2011 regular meeting Motion to table: Kendrick Second: Knis Vote: 5 to O (unanimous) Motion Carried 4.Adjournment The meeting adjourned at 8:25 pm.
