HomeMy WebLinkAboutZBOA Minutes 2017-05-23 RegularI ZONING BOARD OF ADJUSTMENT MINUTES OF A REGULAR MEETING HELD TUESDAY, MAY 23, 2017 AT 7:00 PM CITY HALL COUNCIL CHAMBERS 910 S. FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS 1.The meeting was called to order at 7:00 pm with the following people in attendance: Chairman Greg Hughes Regular Member Delvin Kendrick Alternate Member Linda Thornton Brian Rouane, Building Official Jim Hill, City Council Liaison Alternate members present: Glen Grayban Absent: O'Brien, Dyer Regular Member Steve Knis Alternate Member Mike Czarowitz Alternate Member Glenn Mintz Becky Summers, Dev. Coordinator Chairman Hughes explained the procedure of the meeting and explained that 4 out of 5 votes are required in order for a request to be approved. He stated that if a request is not granted, the applicant has 10 days to file an appeal to Galveston County. Hughes administered an oath to everyone who would be speaking during the meeting. 2.The Board will conduct a public hearing and consider a request to allow a structure to encroach the rear and side building line on the prope1ty located at 1208 Minglewood Lane, Clear Creek Woods Subdivision, Lots 50 and 51, Friendswood, Galveston County, Texas: Rouane stated the applicant's proposed structure would not meet the City's required building setbacks. Dr. Stephen Hunt, applicant, explained he would like to build a carport over the existing driveway and add a patio cover onto the rear of his home. He said there is currently a 9-foot fence between him and his neighbor and stated his additions would not obscure the neighbor's view. He said the unique shape of his lot plus the odd placement of the house on the property created a hardship. He added the lot slopes downward into the floodway. Hunt stated his wife is a dermatologist, provided a handout on skin cancer, and said the number one way to avoid skin cancer is to seek shade. Hunt also provided several photographs of the property, fence, and existing structures. Hughes asked Rouane what construction had been approved for the property. Rouane said a swimming pool with a retaining wall had been approved by the City. Czarowitz asked 1 Rouane if the posts shown in one of Dr. Hunt's photos had also been approved. Rouane explained the posts were poured during the construction of the retaining wall for a future project and pouring the concrete together was more cost effective. Hughes asked how much the structure would exceed the top of fence. Hunt answered the roofline would be 6-12" above the fence line, maybe even sholier after adjusting the roof pitch. Hughes said he considered this a classic variance case due to the odd shaped lot and floodway issues. He also said the structures would not adversely impact the neighbors whose views were already obscured by fences and vegetation. He reminded the Board of the upcoming annual Memorial Day Service program, Monday at 10:00am. Planning and Zoning Commission liaison Tony Annan told the Board that the Commission was currently reviewing changes to the fence ordinance. 6.The meeting was adjourned at 7:29pm.
