ZONING BOARD OF ADJUSTMENT
MINUTES OF A
REGULAR MEETING HELD
TUESDAY, DECEMBER 18, 2012 AT 7:00 PM
CITY HALL COUNCIL CHAMBERS

1.Call to order

The meeting was called to order at 7:00 pm with the following present:
Chair Ron Dyer
Regular Member Delvin Kendrick
Regular Member Steve Knis
Alternate Member Glen Grayban
Alternate Member Mike Czarowitz
Dep. Dir. of Community Dev. Frank Manigold
Planning Manager/PIO Nick Haby

Vice Chair Greg Hughes, Regular Member David O'Brien, III and Alternate Members
Carol Thelen and Linda Thornton were absent.
Public Hearing regarding a request seeking the following:
A.a variance request at 708 Southfield Drive for a 6' encroachment of a second story
deck into the required 25' rear yard setback, per the requirements of Appendix C -
Zoning Ordinance, Section 7.Q. Regulation Matrix -Residential Districts for Single
Family Residential (SFR) zoning.
Dr. Koussayer spoke in support of his request stating that .they just moved to
Friendswood a year ago and that they have been wanting to add a balcony to their
home. He explained that there is nothing behind their fence except animals on a
large tract of land. He also stated that the deck will be 19' from the back fence.
Neil Ostrosky, neighbor and President of the Forest of Friendswood HOA, spoke in
opposition to the request. He explained that the deck is very close to the prope1ty
line and it overlooks his pool and invades their privacy. He stated that this deck has
not and would not be approved by the HOA Architectural Control Committee. Mr.
Ostrosky added that the construction of it is not consistent with the quality of
construction in the neighborhood with homes ranging from $400,000 to the
$600,000s. He then read several comments from emails he had received from other
residents regarding this deck.
3.Consideration and possible action regarding a request seeking the following:

Knis asked about the 3 notes written on the application. Dr. Koussayer read them to the
Board:
1)We are taking stairs away, leaving 19' from fence.
2)Farmland behind house
3)Wife's dream to have deck
Manigold explained that this request originated with a complaint from a neighbor about the
deck being built. He stated that Code Enforcement went out and verified that it was under
construction and stopped the work until a permit could be obtained. When the permit was
applied for, they discovered that the deck was being built too close to the property line.
Dyer asked the applicant how they would get to the deck if they remove the stairs. Dr.
Koussayer replied that they will replace the existing windows with a door. K.nis asked the
applicant why a variance is needed. Dr. Koussayer responded that they have always
wanted a balcony and it provides a family member with breathing problems quick access to
the outside during the night instead of having to go down stairs.
Motion to approve variance: Kendrick
Second: Grayban
Vote: 0 to 5 Motion failed
4.Consideration and possible action regarding approval of minutes for the:
A.August 28, 2012 regular meeting
Motion to approve with a correction to Item #3 to change "Motion failed" to
"Motion passed": Knis
Second: Kendrick
Vote: 5 to O Motion passed
5.Adjournment
The meeting adjourned at 7:32 pm.
