HomeMy WebLinkAboutZBOA Minutes 2012-08-28 Regularl 1 1 I ZONING BOARD OF ADJUSTMENT MINUTES OF A REGULAR MEETING HELD TUESDAY, AUGUST 28, 2012 AT 7:00 PM CITY HALL COUNCIL CHAMBERS 910 S. FRIENDSWOOD DRIVE FRIENDSWOOD, TEXAS 1.Call to order 2. The meeting was called to order at 7:00 pm with the following present: Chair Ron Dyer Vice Chair Greg Hughes Regular Member Delvin Kendrick Regular Member Steve Knis Regular Member David O'Brien, III Dep. Dir. of Community Dev. Frank Manigold Planning Manager/PIO Nick Haby Board Secretary Mona Miller City Attorney Steve Weathered P & Z Liaison Chris Brown Alternate Members Mike Czarowitz and Linda Thornton were in the audience. Alternate Members Carol Thelen and Glen Grayban were absent. Public Hearing regarding a request seeking the following: A.a permanent special exception at 2318 Lakeway Drive, to allow 38% lot coverage, instead of the maximum lot coverage of 35% pursuant to Appendix C -Zoning Ordinance, Section 7.Regulation Matrix -Residential Districts, based on de minimus circumstances. Perry Thomas, President and owner of Kings Manor Homes, stated that he has built five homes in this neighborhood thus far and each one is a custom home designed specifically for each client. He added that he was not aware of the 25' rear setback at first, then, did not realize there was a 35% maximum lot coverage until he applied for the permit. Mr. Thomas explained that Mark Stoll, the homeowner, has elderly parents that are currently in good health, but could possibly need to move in with the Stoll's in the future; therefore, they did not want to relocate more square footage upstairs. In addition, he stated that they were concerned with the livability of the home if it were smaller. Mr. Thomas stated that Mr. Stoll has purchased the lot next door; however, he did not want to build across the property line because he wants to build another home next to his. Mark Stoll explained that they are learning as they go through this building process. He said they asked about the setbacks, but were not aware of the 35% maximum lot coverage. He stated, even though the home is designed as a two story, they really would have preferred to have a one story as they get older and their parents age. He added that any further design changes to the home would be made on the back of the home and that portion just faces pasture land. He stated that they will build a nice home. . I I I I :i I I' ·1 11 ;, I' 11 George Rogers explained that he is also a resident of the Lakes at San Joaquin in a home built by the same homebuilder. He spoke in support of the request. He sees it as a win for the other homeowners because it will increase their home values and a win for the city since it will increase tax values. Chiquita Taylor, a next door neighbor, spoke in support of the request. She stated that Brighton Homes has bought all the remaining lots in the neighborhood, so this would be the last of the custom homes being built. She added that this home will increase their property values and the she just wants to see it get built. No one spoke in opposition to the request. 3.Consideration and possible action regarding a request seeking the following: A.a permanent special exception at 2318 Lakeway Drive, to allow 3 8% lot coverage, instead of the maximum lot coverage of 35% pursuant to Appendix C -Zoning Ordinance, Section 7.Regulation Matrix -Residential Districts, based on de minimus circumstances. Knis asked Mr. Thomas to address his concerns about drainage. Mr. Thomas explained that the finished slab will be at 24" elevation and the lot drainage is Type A drainage with swells to the front of the yard. Knis also asked Mr. Thomas if there are any plans for auxiliary structures on this lot. Mr. Thomas stated that there are no current plans for auxiliary structures at this time. Mr. Stoll added that they planned a larger garage to keep from having a storage building. He also stated that they do not plan to have a swimming pool; however, future owners may want to. Manigold explained that auxiliary structures are not included in the 35% maximum lot coverage, only the air conditioned space and the garage. Hughes asked if there was the possibility of replatting the lot to get the extra square footage that they needed. Mr. Thomas explained that the lots are already the minimum lot width of 120'. Hughes asked about the framing already being set and whether the city limits fell behind this home. Mr. Thomas stated that in fact the framing on the ground was the proposed 3 8% lot coverage and that the property behind the home was in League City. A lengthy discussion ensued regarding the forms being set, the steps leading up to this request and the letter that was included with the application. Mr. Stoll stated that he did not buy the lot next door to build another home for himself, but rather to protect his interest in the type of home that was built next to him. Further discussion was had regarding the 35% lot coverage. Motion to approve permanent special exception: Hughes Second: O'Brien Vote: 4 to 1 (Kendrick opposed) .
