1.Call to order
ZONING BOARD OF ADJUSTMENT
MINUTES OF A
REGULAR MEETING HELD
TUESDAY, MARCH 26, 2013 AT 7:00 PM
CITY HALL COUNCIL CHAMBERS
910 S. FRIENDSWOOD DRIVE
FRIENDSWOOD, TEXAS
The meeting was called to order at 7:00 pm with the following present:

Vice Chair Greg Hughes and Alternate Members Carol Thelen and Glen Grayban were
absent. Regular Member Steve Knis came in shortly after 7, and did not participate.
2.Public Hearing regarding a request seeking the following at 214 and 216 Stratmore Drive,
being Lots 13 and 14, Block 2 o_f Annalea Kingspark, Section A and Whitehall Section A,
in Abstract 20, Galveston, County:
A.a variance from Appendix C -Zoning Ordinance, Section 8. -Supplementary
dish'ict regulations. B., to allow � fence to be constructed along the front
property line
B.a special exception to Appendix C -Zoning Ordinance, Section 8. -
Supplementary district regulations. B., to allow a fence to be constructed
along the front property line
Vivian Ma1tin spoke in support of the request. She explained that this project to improve
the park started about a year ago. And, that when they inquired with the City as to what
was required, they were told that they had free range to do what they wanted; therefore,
they were surprised when they were told they could not fence the entire park. They are
proposing to install the fence to keep children from running into the street, to stop kids
from riding bikes and motorcycles into the park, stop trash from blowing around and keep
people from crossing neighbors' yards to access the park. She added that she feels like this
fence regulation applies to homes, not a park.
Kim Furbanks spoke in support of the request stating that her and her very rambunctious 8

year old love to go to the park. She explained that since she has been on the HOA she has
heard a lot of complaints about cars speeding down Stratmore. They have called the
police and addressed these concerns every other way that they can. Ms. Furbanks added
that she is concerned that a child will be hit by one of the speeding vehicles.
In addition to speaking on her own behalf, Ms. Furbanks read a letter from the daughter of
Don Bennet, who has passed away, but had been a board member for twelve years prior to
his death. The letter stated that she had lived in the neighborhood since 1968. It also
explained that Mr. Bennet, had been a safety engineer for Nasa and was always concerned
about the safety of the children and wanted to prevent an accident prior to the loss of life.
She stated that her dad was also involved in the Boy Scouts and that the Boy Scouts have
been working on the park, replacing the equipment, mulching, etc.. In addition, a young
man planned to work on his Eagle Scout project by installing the fence.
Tammy Thompson, a 5 year resident of the neighborhood, spoke in support of the request.
She explained that she has a child with special needs and sought the board to volunteer
for the park reconstruction project. She stated that it took the board several years to save
the money, then the Boy Scouts worked on cleaning up the park all summer. Ms.
Thompson said that large numbers of children have been coming to the park now; however,
there is no protection if vehicles veer off the road, or a ball rolls into the drainage ditch or
street. She stated that they have moved the swings away from the road. She also explained
that they are proposing to install the fence 12' from one neighbor's side fence to allow
vehicle access to the drainage ditch and sewer manhole.
No one spoke in opposition to this request.
1.Consideration and possible action regarding the request seeking the following for
property located at 214 and 216 Stratmore Drive, being Lots 13 and 14, Block 2 of
Annalea Kingspark, Section A and Whitehall Section A, in Abstract 20, Galveston,
County:

A lengthy discussion ensued with the Board and the applicant regarding the placement of
the fence. Manigold explained that the fence should be set back 25' from the front property
line. Ms. Maitin stated that placing the fence 25' off the front prope1ty line would cut the
size of the park almost in half. During the discussion, Dyer expressed safety concerns with
the playground equipment that he had seen at the park.

placed no closer than 15' from the back of the cut'b: O'Brien

Vote: 3 (O'Brien, Czarowitz, Thornton) to 2 (Dyel', Kendl'ick)

A.December 18, 2012 regulal' meeting
