GUTHREY. MS. GlJ.I'HREY QUESTIONED THE C<M1ISSION ABOUT THE REQUIREMENTS TOBUIID ON THEIR PROPERTY. COOMISSIONER McHUGH ADVISED MS. GUTHREYTHAT SHE ¼QUID HAVE TO REPLAT SINCE THE PROPERTY WAS PURCHASED BYMEIT'ES AND BOUNDS. MR. GUTHREY ADDRESSED THE CCMMISSION WITH THE (X)NCERN THAT THEY MIGH'l' BE REQUIRED TO SUPPLY FIRE HYDRANI'S, [ 1 l J 'WATER, SEWER SERVICES, FRav1 528 TO THEIR PROPERTY. CHAIRMAN BAKER EXPLAINED THAT THE ORDINANCE REQUIRES THE DEVEI.DPER TO SUP PLY THE PROPERTY WITH WATER, SEWAGE, AND A GOOD ROAD. HIS FURI'HER OBSERVATION WAS THAT SCMEI'IMES THIS REQUIREMENT WILL INHIBIT THE PURCHASER TO BUILD ON HIS PROPERTY. CHAIFMAN BAKER ALSO INFORMED THE CCMMISSION THAT OUR ATIORNEY ADVISED IF A PERSON OONS A PIECE OF PROPERI'Y LARGE ENOUGH TO INS'l'ALL A SEWAGE SYSTEM, IT IS MMOST IMPOSSIBLE TO FORBID THEM USE OF THEIR PROPERTY. MRS. GUTHREY TOID THE C<11MISSION THERE HAD AIJMAYS BEEN Th'D LCYI'S; THE DIFFF...RENCE BEING, THE LCYI' LINES HAVE CHANGED. SHE AI.SO SAID THE ONLY THING NECESSARY WAS TO HAVE THE LINE SHCWN ON THE SURVEY SHE HAD IN HAND. ENGINEER HENGST ADVISED MRS. GUTHREY THAT A LINE CHANGE IN A SURVEY 'WOULD NOT BE SUFFICIENT AND WOULD NOT MEN.l' THE RNJUIREMENTS OF THE CITY OF FRIENDSWOOD'S SUBDIVISION ORDINANCE. C(M,USSIONER McHUGH .ABKED IF MR. P..ND MRS. GUTHREY HAD RECEIVED THEIR PACKET F'RCM THE CITY DEFINING REQUIREMENTS, TO WHICH MRS. GUTHREY ANSWERED IN THE AFFIRMATIVE. MRS. GUTHREY SAID SHE UNDERSTOOD MEETING WITH THE PLANNING AND ZONING CCMMISSION WAS THE FIRST STEP IN THE PROCEDURE, AND SHE WOULD NCM HAVE A MYLAR PREPARED. SHE THEN ADDRESSED THE COMMISSION WITH THE QUESTION OF CITY SERVICES. CHAIRMAN BAKER EXPRESSED HIS OPINION THAT IT WAS BEST FOR THE CITY THAT THE PROPERTY BE DEVEI.DPED AND FELT THAT BECAUSE OF THE DISTANCE, CITY SERVICE CONNECTION WOUID NOT BE REQUIRED. 5.CALL A PUBLIC HEARING FOR A ZONE CLASSIFICATION CHANGE REQUEST OFMFR-M (MULTIPLE FAMILY RESIDENTIAL -MEDIUM) TO SFR (SINGLE FAMILYRESIDENTIAL) -55.8998 ACRES LAND BE'IWEEN SAN JOAQUIN PARKWAY ANDFM 528 -D. DAWSON AND J. DAWSON A PUBLIC HEARING WAS CALLED FOR JANUARY 8, 1990. 6.PRE APP -55. 8998 ACRES LAND B�"'"IWEEN SAN JOAQUIN PARKWAY AND FM528. ENGINEER HENGST EXPRESSED HIS CONCERNS THAT THE 'IDWER ESTATES TRFA'IMENI' PLANT Vl'OUID BE OVF.:R DESIGN CAPACITY DURING THE PEAK PERIODS AS WELL AS DAILY AVERAGE FIDiJ, SHOUI.D THIS SUBDIVISION BE DEVELOPED. HENGST TOLD THE ca.1MISSION THAT IN CALCULATING THE ESTIMATED USAGE, 2.5 PEAK WAS USED, 3 PIDPLE PER HOUSEHOLD AND 130 GALLONS PER PERSON. Ca.1MISSIONER WASSON ASKED IF THE PLANT WAS NCJM AT CAPACITY. HENGST SAID THAT IT WAS NOT; HCMEVER, WITH ALL OF THE PROPOSED DEVELOPMENT, FRIENDSWOOD IDULD EXCEED THEIR PERMI'ITED CAPACITY. MR. DAWSON INFORMED THE Ca.1MISSION OF A LETI'F.R HE RECEIVED IN 1984, ADVISING HIM. THAT THE TREATMENT PLANT WOUID BE ABLE TO ACCCM-1ODATE GRCWTII. DAWSON INFORMED THE CCMMISSION THAT THE DIROCTOR OF PUBLIC WORKS HAD TOLD HIM, THE CITY \OC)ULD HOl\T()R THIS LETI'ER AND IDULD PROVIDE FACILITIES TO ACCCMOC)DATE '!'HIS SUBDIVISION. BOGREN QUESTIONED THE FIGURES HENGST HAD USED TO DEI'ERMINE CAPACITY, HAVING BEEN ADVISED BY OTHERS, WHOSE FIGURES 2 n l WERE NO!' IN AGREEMENT WITH MR. HENGST'S FIGURES. ENGINEER HENGST REITERATED TO THE CCMMISSION THAT HE WOULD NaI' ADVOCATE A SUBDIVISION WHICH, IN HIS OPINION, WOUID GIVE THE CITY PROBLEMS LATER. TO WHICH HE ADDED, UNLESS '!'HE CITY WERE TO DO Sa.IBTHING WI'IH THE TOWER ESTATES TRFA'.IMENT PLANT TO INCREASE ITS' CAPACITY. CCMMISSIONER WASSON ASKED IF TCWER ESTATES WAS CONSIDERED A PACKAGE TRF.A'IMENT PLANT AND IF OTHER PACKAGE TREA'IMENT PIJ\l\l'J'S WERE ALLCMED OUT IN THIS ARFA. ENGINEER HENGST SAID THAT THE EPA AND 'l'HE STATE WERE r.'iOVING 'l'a\1ARD REGIONAL TRFA'IMENT. HE ADVISED THAT THE CITY'S LONG RANGE PLANS WERE TO ABANDON THE TOWER ESTATES PLAN!'. COOMISSIONER WASSON ASKED IF THE SEWAGE WOULD THEN BE TAKEN BY LI.Fl' STATION TO A REGIONAL TRFA'IMENT PLANT. HENGST REPLIED "YES 11 • CHAIRMAN BAKER STATED ALL MAJOR GRCWI'H WOill.D BE IN THAT PARTICULAR AREA AND ASKED ENGINEER HENGST THE LOCATION OF SEWAGE FOR THE FALCON RIDGE SUBDIVISION. HENGST SAID THAT FALCON RIDGE WASTE IS CHANNELED IN THE OPPOSITE DIRECTION FRa1 TCWER ESTATES. CHAIRMAN BAKER ASKED ENGINEER HENGST IF HE WAS SATISFIED WITH HIS NUMBERS. HENGST REPLIED THAT HE WAS USING FACTORS; HOWEVER, HE WOULD LCOK AT THEM AGAIN. CCMMISSIONER HOLZSCHUH SAID THAT HE WAS Nor INCLINED TO GO OVER THE ROCCMMENDATION, AND FELT THAT IT WAS THE CITY'S RESPONSIBILITY 'l'O PROVIDE THE ADDITIONAL SEWAGE TRFA'IMENT IF THEY WANTED THE ADDITIONAL DEVEIDPMENT. CHAIRMAN BAKER SAID THE CCMMISSION WOUID GIVE TENTATIVE APPROVAL, CONTINGENI' UPON DUANE'S FIGURES. SHOULD HENGST PROVE THE TOWER ESTATES SEWAGE SYSTEM IS NO!' ADEQUATE TO SERVE PROPOSED DEVErOPMENT, THE CC1-1MISSION WILL HAVE 'I'O CONCUR WITH COUNCIL ON AN EQUITABLE SOLUTION. 7.CALL A PUBLIC HEARING FOR A ZONE CLASSIFICATION CHANGE REQUESTOF CSC (CCl-'.lMERCIAL SHOPPING CENTER TO SFR (SINGLE FAMILYRESIDENTIAL) 14.1286 ACRES OF LAND LCCATED ON FM 528 ADJACENT 'I'OTHE PROPOSED BEREAN BAPTIS'r SUBDIVISION. -D. DAWSON AND J. DAWSON A PUBLIC HEARING WAS CALLED FOR ,JANUARY 8, 1990. 8.PRE APP -14.1286 ACRES LAND LOCATED ON FM 528 ADJACENT TO THEPROPOSED BERFJ\N BAPTIST SUBDIVISION. CITY ENGJNEER HENGST EXPRESSED HIS APPROVAL THAT THERE WERE 'IWO ENTRANCES IN'I'O THE SUBDIVISION AND WAS DELIGHTED THAT THE 60 FOO!' EASEMENT HAD BEEN RESERVED FOR ROAD WIDENING. HENGST EXPRESSED THE CONCERN OF SEWAGE AS THIS PROJECT' WIIJ, ALSO EMPTY SEWAGE IN'I'O THE 'IOOI!,� ESTATES TREA'IMENT PLANT. CHAIRMAN BAKER SUGGESTED THE CCMMISSION WAIT UNTIL ENGINEER HENGST RE-EVALUATE HIS FIGURES. 9.CONSIDERATION AND POSSIBLE RECa-1MENDATION TO CITY COUNCIL - APROPOSED DEVEIDPMENT SITE PLAN LCCA'l'ED AT FRIENDSV.UOO LINK RD. ATAPPLEBIOSSCl-1 -OUT OF RESERVE "C" BLOCK 1, WEDGE.WOOD VILLAGE,SECTION 8, (UNRECORDED SUBDIVISION) -NC -C. GORDON 3 I 1 l l l 10. MR. GOROON SUBMITI'ED A SITE PLAN OF HIS PROPOSED DEVEIOPMENT, RB;)UESTING THE STRUCTURE AFFRONT FRIENDSWOOD LINK ROAD RATHER THAN APPLEBLOSSCM. THE CCM-ITSSION AGREED TO THE LOCATION OF THE STRUCTURE; HCWEVER, FELT THE SITE PLAN WAS NOT SUITABLE DUE TO THE FACT THAT INDIVIDUAL PARKING SPACES WERE NOT SHCMN. MR. C'-OROON WAS ASKED TO RESUBMIT A SITE PLAN INDICATING THE REQUIRED NUMBER OF PARKING SPACES. THE Cet-1MISSION DENIED REXXM-1ENDATION TO CITY COUNCIL UNTIL SUCH TIME AS THE SITE PLAN IS RESUBMI'ITED AND APPROVED BY THE PLANNING AND ZOOING CCMMISSION. MITCH MI'IO!ELL ASKED TO ADDRESS THE Cet-1MISSION CONCERNING THE MAJOR THOROUGHFARE PLAN. HE EXPRESSED THE OPINION THERE WERE MAJOR PROBLEMS WITH SEVERAL AREAS AND ASKED WHAT THE PRCX:;EDURE WOUID BE, IN ORDER TO MAKE CHANGES. THE CCM-1ISSION ADVISED MR. MITCHELL OF THE PUBLIC HF.ARING WHICH HAD BEEN HELD AND ASKED WHY HE HAD NOT EXPRESSED THOSE CONCERNS AT THAT TIME. MR. MITCHELL EXPLAINED HE WAS NOT PROPERLY PREPARED, AND WOUID LIKE THE OPPORI'UNITY TO INTRODUCE SCME OPTIONS WHICH HE FELT SHOUJ.D BE CONSIDERED. CHAIRMAN BAKER INFORMED MR. MI'IO!ELL THAT THE MAJOR THOROUGHFARE PLAN WAS A "LIVING" I.:XXlJMENT WHICH COUID BE CHANGED IF IT WERE NF--CESSARY. CCM,ITSSIONER WASSON ASKED MR. MITCHELL IF HE WOUID PRESENT HIS PROPOSED CHANGES AND O�IONS TO THE PLANNING AND ZONING CC1-1MISSION, AT A LATER DATE. ADDITIONALLY, MR. MI'ICHELL ASKED FOR PRELIMINARY REVIEW OF FAGLE LAKES ON DECEMBER 21, 1989. THE CCM-1ISSION GRANTED HIS REQUEST. 11.PRE APP -JIM THa.1PSON -KENTUCKY FRIED CHICKEN -FM 528 ANDWINDING WAY. JIM THa.1PSON PRESENTED HIS PLAT OF 3.7 ACRES OF LAND WHICH WILL BE SUBDIVIDED INTO THREE (3) LOTS. CCM-ITSSIONER WASSON ASKED IF THE LOTS BEING CREATED WOULD MEET THE CSC REQUIREMENTS. ENGINEER HENGST SAID THA'r THEY WOUID NOT, DUE TO THE MINIMUM LOT SIZE IN THE ZONING ORDINANCE. CURREN"rLY, THE MINIMUM LOT SIZE FOR CSC IS 'lWO (2) ACRES. CCMMISSIONER McHUGH EXPRESSED HER CONCERN WITH THE WAY THE ORDINANCE WAS WRITI'EN AS DID CCMMISSIONER WASSON. IN ADDITION, CCMMISSIONER WASSON ADVISED THE CCl-1MISSION THAT UNTTI, THE ORDINANCE WAS CHANGED, THE CCM-llSSION COUID NOT APPROVE IIBJUEST. ENGINEER HENGST SUGGESTED THAT THE CCMMISSION APPROVE THE PRE APP AND IN THE MEANWHILE, START THE PROCESS TO AMEND THE ORDINANCE, TO WHICH THE CCM,ITSSION AGREED. 12.CONSIDERATION AND POSSIBLE RECOMMENDATION TO CITY COUNCIL,PROPOSED AMENDMENTS TO ZONING ORDINANCE NO. 84-15, SECTION K, SIGNREGULATIONS -ORDINANCE NO. 323. CHAIRMAN BAKER INFORMED THE Cet-1M.ISSION THE CITY ATTORNEY WAS MAKING ADDITIONAL REVISIONS TO THE SIGN ORDINANCE AND v.UUI.D, THEREFORE, PASS OVER THIS I'J'E1.1. 4 ( 1 ! i 13.CONSIDERATION AND DISCUSSION OF THE CSC REPLAT REX)UIREMENT INTHE SUBDIVISION ORDINANCE. CCMMISSIONER McHUGH EXPRESSED HER CONCERN THAT A CSC SHOUI.D NOI' BE REPLATTED WITH EACH PAD SITE DEVELOPMENT. CCM-USSIONER WASSON S'ICOD IN OPPOSITION TO PROPERTY SEPARATED BY MEl'ES AND BOUNDS, BELIEVING THAT PLA'ITING IS IN THE BEST INI'ERESTS OF THE CITY. TO FACILITATE THE DEVELOPMENT OF THE CSC ZOOFS SHE RECCMMENDED THE REDUCTION OF MINIMUM 10T SIZE FRa.1 'Il\70 ACRES TO A MORE PRACTICAL SIZE. COMMISSIONER l'lASSON FURTHER EXPRESSED HER CONCERNS THAT METES AND BOUNDS ARE NOI' COVERED BY ORDINANCE FOR EASEMENI'S, ROAD ACCESS, PERMI'ITING THE CONSTRUCTION, AND RECEIVING THE PROPERTY ON THE PARI' OF THE CITY FOR MAINI'ENANCE AND PERPEruITIES. NOR IS THERE LEGAL PROVISION TO ENSURE THAT ADEQUATE SERVICES ARE TO BE PROVIDED TO THE CREATED PROPERI'Y OR THE SURROUNDING PROPERTIES. ENGINEER HENGST ADVISED THE CCM,1ISSION THAT THE PURPOSE OF CSC IS TO HAVE A MASTER PLAN APPROVED. CCM-USSIONER McHUGH SAID SHE WAS NOI' AGAINST REPLA'ITING, INSTEAD SHE FELT THE PROPERTY ZONED CSC COUI.D BE PLO.IT.ED INI'O PAD SITES WHICH COUID BE DEVELOPED AT A LATER TIME; AT PRESENT, THIS COUID NOI' HAPPEN ACCORDING TO THE ORDINANCE. SHE RECCMMENDED THE MINIMUM rar SIZE BE CHANGED TO BE WORKABLE FIGURE. THE CCM-1ISSION ELOCTED TO RECCM1END A REVISION TO CITY COUNCIL IN MINIMUM LOT WIDTH OF 75' , MINIMUM DEPTH OF 100', AND MINIMUM LOT AREA SIZE OF 7,500 SQ. F!illl'. MOI'ION: (McHugh) r,1.ADE A MOI'ION TO RECCM"1END TO CITY COUNCIL THE PROPOSED CHANGES TO THE CSC REPLAT REX)UIREMENT OF THE SUBDIVISION ORDINANCE. SECOND: (HOLZSCHUH) VOI'E: FOR -UNANIMOUS OPPOSED: NONE MOI'ION CARRIED. 14 • ca-1PREHENSIVE PLAN CCMMISSIONER WASSON EXPLAINED THE CCMPREHEN'SIVE PLAN 'ID THE NE.W COMMISSIONERS; SHE STATED THAT ACCORDING 'ID STATE LAW, THE CITY OF FRIENDffi\WD COULD NOI' CHARGE IMPACT FEES 'ID DEVELOPERS UNLESS THEY HAVE A FORMULA BASED ON SCME RATIONAL FOR CHARGING ON A PER LOT BASIS. SHE ADDED THAT THE ONLY PRACTICAL WAY TO CCME UP WITH A FORMULA IS TO COST OUT OUR SYSTEMS; MAJOR THOROUGHFARES, DRAINAGE, WATER AND S�lE.R SYSTEMS, AND THEN ATI'ACH A PER LOT COST. OUR MASTER PLANS SHOUID BE BASED ON A MASTER LAND USE PLAN. HOWEVER, SHE SUGGESTED THAT DUE 'ID THE LATENESS OF THE HOUR, THE CC1-1MISSION PASS OVER THIS ITEM. 15.CHAIRMAN BAKER REMINDED THE COMMISSION OF THE CAPITAL IMPROVEMENTADVISORY ca-1MI'ITEE MEETING ON DECEMBER 18, 1989. CITY ENGINEERHENGST INFORMED THE CCM-1ISSION THAT THE ONLY PORl'ION TO BEPRESENTED IS THE SEWER AND PROPOSED IMPACT FEES ON THE SEWER. HEEXPLAINED THE MEETING WOUI.D BE STRICI'LY INFORMATIVE AT THIS POINT;Ha-IBVER, THE CITY HAS UNTIL JUNE 1, 1990 'ID ADOPI' THE CIP.
