RIGHT-OF-WAY -COUNCILMAN PRIHODA Councilman Prihoda presented a right-of-way map showing the major throughfares of the City to the Planning and Zoning Commission. Councilman Prihoda had met with Mr. Poorman of the District Engineering of the State Department of Highways and Public Transportation concerning the required right-of-ways being established in Friendswood. Councilman Prihoda gave each of the Commissioners a copy of the letter which had been addressed to the Mayor and City Council dated October 4, 1985 intended to clarify the right-of-way requirements for proposed improvements of certain roads in Friendswood. City Attorney John Olson told the Council that if the Highway Depart­ment does not establish guide lines for the amount of right-of­way needed their might be a problem in obtaining right-of-way. He also suggested perhaps the zoning ordinance set back might be changed to help eliminate a future problem. Commissioner Holt said he felt the best approach would be to asses the right-of-way from the developers as they come to the City for development. Councilman Prihoda suggested the right-of-way remain at 90' and increase the set back in the ordinance. He ( I I Page 2 October 17, 1985 told the Commission he would like Planning and Zoning Commission input concerning this potential problem. It was suggested they meet again for a workshop to discuss establishing a policy. Council­man Prihoda is to di�cuss with the City Attorney a set back change to the ordinance, and also how the change will effect the already platted property. DON ROBERTS -PARK 518 -FINAL Don Roberts addressed the Planning and Zoning Commission Concerning 4 acres to be platted for development. The property is located on F.M. 518. Mr. Roberts told the Commission it ha d been his understanding that the Clear Creek Drainage District would not give approval for this property until a drainage study of the entire 25 acre tract had been completed. Mr. Roberts submitted the following letter to the Planning and Zoning Commission. Gentlemen: In accor dance with the instructions of the land owner, Mr. Ralph L. Lowe, Mayor of Friendswood, the plat of PARK 518 is hereby submitted for approval. The approval block for the Clear Creek Drainage District has not been included on this plat. Resolution 78-1 of the District defines the responsibility for drainage between the City of Friendswood and the Clear Creek Drainage District. The property located within the PARK 518 Subdivision drains to a roadside ditch and is very clearly less than 100 acres. Therefore, the responsibility lies with the City of Friendswood and not the Clear Creek Drainage District. We, therefore, request approval of the plat of PARK 518 subdivision at your October 18th meeting. Commissioner Cress explained that it had been a policy of the Planning and Zoning Commission to have the Clear Creek Drainage District review all plats and to sign the final milar along with the other signatures required by the subdivision ordinance. Commissioner Cress also felt perhaps there had been a misunderstanding on the request for a 25 acre study for the 4 acre development. It was decided that the Planning and Zoning Commission would contact the Clear Creek Drainage District for clarification. It was also pointed out that the plat had not been submitted 10 days prior to the Planning and Zoning Commission meeting, which is required by ordinance. ! l Page 3 October 17, 1985 CHAIRMAN RALPH MILLER, CALLED A SPECIAL WORKSHOP FOR OCTOBER 24, 1985 FOR THE PLANNING AND ZONING COM MISSION. RE-APPOINTMENTS MOTION: (CRESS) To forward a letter to the City Council recommending re-appointment of Bill Todd and Ralph Miller to fill two of the three commissioner terms expiring November, 1985. SECOND: (HOLT) Commissioner Brown addressed the Planning and Zoning Commission saying she was not asking for re-appointment of her term, but had enjoyed serving on the Commi ssion and stressed the importance of having continuity by the re-appointments. VOTE: FOR: Cress, Brown, Holt, Beggs, Todd and Miller ABSTAINED: Beeth MOTION CARRIED DAY CARE -KENT BALLARD -F.M. 518 - 4 ACRES Mr. Ballard is requesting a recommendation from the Planning and Zoning Commission to help resolve the problem of the Day Care struct ure being too large to comply with the NC zone of the Zoning Ordinance. The building is shown as a 6,000 sq. ft. structure and the ord inance permits only 4,000 sq. ft. The str ucture of the 6,000 sq. ft. is to be built on a 4 acre sit e and the or dinance requires a lot area minimum of 7,500 sq. ft. After a very lengthy discussion the following recommendation was made. MOTION: (TODD) To recommend to City Council an emergency ordinance deleting from the Zoning Ordinance from Section 7, SCHEDULE OF DISTRICT REGULATIONS, a portion of G.4. the following: THE COMMERCIAL RETAIL AND SERVICE USES PERMITTED IN THIS DISTRICT SHALL NOT EXCEED FOUR THOURSAND (4,000) SQUARE FEET IN GROSS FLOOR AREA FCR ANY LOT OR PREMISES.
