COUNCILMAN PRIH OD A -RIGHT-OF-WAY Councilman Priho da reported from the City Council to the Planning and Zoning Commission that they have called a public hearing for November 11, 1985 for the purpose of adding 15' to the set back on State Highways. Other roadways would be determined by volume and speed of tr affic. City Manager Jim Morgan told the Planning and Zoning Commission that City Attorney John Olson informed him the City can not dictate the amount of right-o f-way, but can require the right-of-w ay.after the City has the plans-from the State for the amount required for State, Federal and Farm to Market roads. The Planning and Zoning·cornrnission requested .that Council post pone the hearing as they would like more inf ormation on ri ght-of­way and also to review the ordinance prior to the calling of a public hearing. SECOND: (TODD ) VOTE: Unanimous FOR MOTION CARRIED PARK 518 -FINAL A final plat of PARK 518 consisting of 4 acres was presented to the Planning and Zoning Commission. At the October 17, 1985 meeting, Mr. Roberts addr ess the Commission saying the Clear Creek Drainage District had requested a drainage study of the entire 25 acre tract. The Commission fe lt there had been a communication proble m and told Mr. Roberts they would contact the Clear Creek Drainage District. Chairman Ralph Miller has been in contact with the Clear Creek Drainage District and it was determined they only wanted a· letter from Mr. Roberts stating the developer would bring before the Clear Creek Drainage District the plans on how the run�off water for the 4 acres will reach the road-side ditches. The Clear Creek Drainage District will forward a letter to the Planning and Zoning Commission regarding the conversation Mr. Miller had with the Clear Creek Drainage District. The Planning and Zoning Commission will sign the mylar upon receipt of a letter .. from the Clear Creek Drainage District. REZONING RECOMMENDATION The Planning and Zoning Commission is recommending to the City Council the following: MOTION: (BEETH) To recommend to City Council the rezoning of 4.1590 acres out of lots 41,42,53 and 54 of the Voss Subdivision and located on F.M. 518 and named PARK 518, from CSC to NC. SECOND : (HOLT) VOTE: Unanimous FOR MOTION CARRIED A memo to be sent to City Council regarding the above motion from the Planning and Zoning Commission. I Page 3 October 24, 1985 REZONING RECOMMENDATION The Planning and Zoning Commission is recommending to the City Council the following: MOTION: (HOLT) To recommend to City Council the rezoning request for 12.7 acres located 300' East of North East Corner of F.M. 528 and Winding Way for a retirement center be denied. The dis approval is ba sed on insufficient information. A Public Hearing was held October 7, 1985, the request being CSC AND MFR-L to Sp ecific Use PUD. Recommended approval will require compliance with the Specific Use· PUD in the zoning ordinance. SECOND: (CRESS) VOTE: Unanimous FOR MOTION CARRIED MINUTES FOR APPROVAL Septem ber 19, 1985 -Minutes approved as read. October 3, 1985 -Minutes ap proved as read.
