THE FOLl.CWING MEMBERS WERE PRESENT: BAKER -CHAIRMAN COLBURN HOLZSCHUH McHUGH RODGERS WASSON BLAKE -CIP WATSON -CIP FRANKOVICH -LIAISON BRAND -CITY MANAGER THOfPSON -ENGINEER HENRY -DEVELOPMENT COORDINATOR BRINI<MAN -SOCRETARY �1ITH A QUORUM PRESENT, KONCABA AND SPEARS ABSENT, THE FOIJ.OvING ITEMS WERE CONSIDERED: 1.CONSIDERATION AND POSSIBLE .ACTION REx::'-.ARDING THE CAPITALJ.MPROVEMEN'l' PLAN -IMPACT FEE. DICK GAY INFORMED THE COMMISSION THAT THE UNIT COSTS HAD INCREASED APPROXIMATELY 15% AFTER THE LAST MEN.I'ING OF THE CAPITAL IMPROVEMENTS ADVISORY COMMIT.IEE ON MARCH 1, 1990. AI.SO, HE HAD CONFERRED WITH FRANK ELBRANO AND ROGER PIERCE WITH REGARDS TO FINANCING COSTS FOR THE 'rnO BASIC SYSTEMS; MELODY LANE WATER AND WASTEWATER SYSTEM AND THE CENTRAL SERVICE SYSTEM. THEY HAVE ASSUMED '1W) BOND ISSUES AND INCLUDED ISSUANCE COST, C'ARRIED F.ACH ISSUE FOR 20 YF.ARS AT 7 1/2% TO .ARRIVE AT HIS TOTAL COST OF FINANCING. GAY SAID HE HAD ALSO INCLUDED AN IMPACT FEE FOR WASTEWATER TRF.A'IMENT FOR BAY AREA SERVICE ARF.A AS PER JOHN OLSON'S RECQ\1MENDATION. HE Rh'"VIEWED THE NEW CIP STUDY ADDING THAT THE DESIGN AND CONSTRUCTION PHASE, ENGlNEERING, AND RIGHT-OF-WAY COST HAVE BEEN ADDED, SUB TOTAI.ED, THEN BOND ISSUANCE AND FINANCE COSTS ADDED. GAY ALSO ADVISED THE COMMISSION THAT A FULL REPORT HAD TO BE AVAILABLE FOR PUBLIC REVIEW WHEN THE NOTICE FOR THE PUBLIC HF.ARING ON IMPACT FEES WAS PUBLISHED IN THE JOURNAL ON WEDNESDAY, MARCH 21, 1990. THIS RB;:1UIRED THAT HE HAVE THE ADVISORY COMMI'ITEE'S APPROVAL BY MONDAY, MARCIi 19, 1990. CHAIRMAN BAKER ASKED IF THERE WAS ANY WAY THE CI'I"Y COUID "BREAK EVEN" RATHER THAN Nar RECOVERING COSTS. DICK GAY INFORMED THE a::M-1ISSION THAT THE LAW WAS SO TIGHT THAT IT DID NOT ALlOv A GRF.AT OF.AL OF FLEXIBILITY; HOOEVER, THE PLAN COUill BE AMENDED IF NECESSARY. MS. BRAND ADVISED BAKER THAT HE WAS CORRECT' IN SAYING THE CITY HAD PUT IDNEY INTO THE BLACKHAWK SYSTEM. SHE HAD VERIFIED WITH FINANCE AND ACCOUN'rING THAT APPROXIMATELY $469,000 WAS PAID AND A CERI'AIN PORTION COUID BE CONSIDF.RED IN THE IMPACT FEES. THE HEARING IS TO BE MONDAY, MARCH 19, 1990. 2.CONSIDERATION AND POSSIBLE RECXM>1ENDATION REGARDING THE ZONECLASSIFICATION CHANGE REQUEST OF OBD (OID BUSINESS DISTRICT) TOMFR-H (MULTIPLE FAMILY RESIDENTIAI, -HIGHEST) -3. 979 ACRES OUT OFwrs 6 & 7 ON FM 518 -(HAUSMAN -PUBLIC HEARING 3/5/90) CHAIFMAN BAKER ADVISED MR. HAUSMAN THAT THE ENTITIFS WERE IMPRESSED WITH THE DRAWINGS FOR THE APAR'IMENTS HE HAD PRESEN.l'ED IN THE PUBLIC HEARING; HCMEVER, HAD EXPRESSED 'IHEIR CONCERN THAT ONCE THE PROPERTY W1'.S REZOOED, THE1IB WERE NO GUARANTEES THAT THOSE APARIMENTS WOULD BE BUILT. MR. HAUSMAN REMINDED THE ca-1MISSION OF HIS REPUTATION WITH R&;ARD TO HIS PAST BUIIDING PRACTICES. HAUSMAN ADDED THAT THE VALUE OF THE LAND, 'ICGEI'HER WITH THE 18 UNITS PER ACRE, REQUIRED AN "UPSCALE" PROJECI' IN ORDER 'ID BE PROFITABLE. BAKER ASKED MR. HAUSMAN IF THEY HAD CONSIDERED DRAINAGE TO WHICH MR. HAUSMAN REPLIED "YES". TRAFFIC, NUMBER OF SCHOOL CHIIDREN, SOCURITY GATES, ETC. WERE AT.SO DISCUSSED IN GREAT DETAIL. BAKER AI.SO ASKED IF MR. HAUSMAN \\"QUID BE WIT.LING TO GIVE THE COUNCIL A LEITER OF INl'ENT GUARANTEEING THE ARClll'I'Ex::'I'URAL DESIGN AS SUBMITI'ED. AGAIN, MR. HAUSMAN REPLIED THAT HE WOUID BE AGREEABLE TO THAT RBJUEST. MOTION (WASSON) TO REXXMMEND TO CITY COUNCIL THE ZONE CLASSIFICATION CHANGE REX;2UEST, FRCM OBD TO MFR-·H, BE APPROVED. SEroND: McHUGH VCYI'E FOR: BAKER, McHUGH, WASSON, RODGERS AND HOLZSCHUH OPPOSED: COLBURN MorION CARRIED. 3.CONSIDERATION AND POSSIBLE ROCCMMENDATION REX:;ARDING THE ZONECLASSIFICATION CHANGE RE'QUEST OF SFR (SINGLE FAMILY RESIDENCE) 'IOSP (SPECIFIC USE) CHURCH FOR AN EXISTING S'I'RUCTURE IlX'J\TED AT 301LEISURE LANE (CHURCH OF CHRIST -PUBLIC HEARING 3/5/90). CHAIFMAN BAKER INFORMED THE CCMMISSION THAT AT PRESENT THE CHURCH OF CHRIST COULD NOT ADD ON TO THEIR BUIIDING BECAUSE THEY HAD BEEN ANNEXED IN AS CHURCH. HE ADDED THAT IN ORDER TO BE ABLE TO EXPAND THEIR BUIIDING, THEY WOUID HAVE TO BE REZONED FOR SPECIFIC USE. ca-1MISSIONER WASSON ASKED IF PLANS �"OUID HAVE TO BE APPROVED PRIOR TO THEIR f.1.AKING AN ADDITION TO THEIR BUIIDINGS. CITY ENGINEER THCMPSON DISTRIBUTED COPIES OF THE REVISED MAJOR THOROUGHFARE PLAN AND REVIEWED THE CHANGES. CHAIRMAN BAI<ER ADVISED THE CCM1ISSION THAT THE MAP APPF.AFED ACCURATE TO+/-ONE MILE. MYI'ION (COLBURN) TO REX:XM•1END TO CITY COUNCIL THAT THE REVISED MAJOR THOROUGHFARE PLAN BE APPROVED. SEX::OND: HOLZ SCHUH VOTE FOR: UNANIMOUS OPPOSED: NONE MOTION CARRIED. 5.CONSIDERATION AND POSSIBLE RECCM-1ENDATION REGARDING THE PROPOSEDREVISIONS TO FLOOD ORDINANCE, 1989. (FRANKOVICH). COUNCIL .MErvIBER :FRANKOVICH INFORMED THE ca-1MISSION OF THE INTENT OF THE PROPOSED REVISION TO THE FIOOD ORDINANCE. THE INTENT BEING THAT A LAND DEVELOPER IDULD HAVE THE BURDEN OF PR(X)F REGARDING THE IMPACT OF HIS DEVELOPMENT ON THE MAJOR TRIBUTARIES IN FRIENDSWOOD. THE PROPOSED REVISION OOUJ..D CONSIDER A 100 YEAR STORM FREQUENCY AS DOES FEMA AND MOST OF THE SURROUNDING DISTRICTS. FRANKOVICH REMINDED THAT THE CLEAR CREEK DRAINAGE DISTRICT CURRENTLY USED A 25 YE.AR STORM FREQUENCY. CHAIRMAN BAKER J\.SKED IF SUNSET MEADCmS HAD BEEN BUILT ACCORDING TO THE 100 YEAR STORM FREQUENCY RATHER THAN THE 25 YE.AR FREX:)UENCY, WHA'I' WOULD THE DIFFERENCE HAVE BEEN. BCY.l'H COUNCIIMEMBER FRANKOVICH AND ENGINEER THa.lPSON SAID THE DETENTION VOLUME WOULD BE HIGHER, THOUGH THE DRAINAGE DITCH WOUID NOI' BE THAT MUCH LARGER. Ca.1MISSIONER COLBURN ASKED WHAT IDULD EQUATE A HUNDRED YE.AR STORM. ENGINEER THa.1PSON AND COUNCIIMEMBER FRANKOVICH AGREED THAT IT WAS A MA'ITER OF VOLUME VERSUS TIME, FOR EXAMPLE, 6" OF RAIN IN ONE HOUR MIGHT CONSTITUTE A HUNDRED YEAR STORM. ENGINEER THCMPSON SAID THAT CHAN'l'EL WAS CONSIDERED r.'.DRE THAN A HUNDRED YEAR STORM. STEVE HASKEW, A SUPERVISOR WITH THE CLEAR CREEK DRAINAGE DIS'l'RICT, ENDORSED THE PROPOSED CHANGE TO THE FIOOD ORDINANCE. CCM1ISSIONER HOLZSCHUH SAID THAT HIS CONCERN WAS THAT THE SMALL DEVELOPER, A PERSON WHO WAS SUBDIVIDING A SMALL PLAT OF LAND INTO 'IWO OR THREE Im'S, MIGHT BE FACED WITH AN EXPENSIVE ENGINEERING STUDY. FRANKOVICH SAID THAT HE HAD RESEARCHED THE COST OF THE STUDY. IN HIS OPINION, THE STUDY COULD BE DONE IN 4 HOURS AND IDULD COST $500-$700, PF.RHAPS LF.SS. CHAIRMAN BAI<ER ASKED STEVE HJI..SKEW HOW A PERSON COUID CXlv1E UP WITH A DRAINAGE PLAN WHEN SUBDIVIDING A PROPERI'Y, IF HE WERE Nar SURE WHAT WOULD BE BUILT ON THE PROPERI'Y. ENGINEER 'THOMPSON REMINDED MR. HASKEW THAT IN THE PAST SOOE PLATS HAVE BEEN APPROVED WITH A NOTE ON THE PLAT. THE NOTE STATES SPOCIFICAIJ.,Y THAT AT THE TIME A SITE PLAN IS PR ESENTED, IT HAS TO BE APPROVED BY THE CCDD. MR. HASKEW STATED THAT IT W'.:llJLD BE UP TO THE CITY 'IO ENFORCE THAT RULING BECAUSE ONCE CCDD HAD ISSUED APPROVAL, THEY OOUID NO LONGER 3 r 1 I lI P&Z 3/15/90 BE ABLE TO CONTROL DRAINAGE. CHAIRMAN BAKER SAID HE UNDERST(X)D THE NEED FOR SUCH AN AMENDMENT; HOOEVER, HIS CONCERN ALSO WAS FOR THE PERSON WHO HAD A 50 ACRE TRACT WHICH MIGHT BE SUBDIVIDED INTO '1W) EQUAL PARTS. BAKER SAID IT SEEMED UNNECESSARY FOR THE MAN TO HAVE AN ENGINEERING STUDY PREPARED IF HIS INl'ENI' WAS 'IO GRAZE HORSES ON THE PROPERI'Y. FOR THAT REASON, BAKER FELT THAT IT SHOUID BE LEFT TO THE DISCRETION OF THE CITY ENGINEER IF A STUDY SHOULD BE �UIRED. CCM,1ISSIONER HOLZSCHUH AGREED WITH CHAIRMAN BAKER WITH REGARD TO THE DISCRETIONARY OPINION OF THE CITY ENGINEER. THE CXM-1ISSION DECIDED TO POSTPONE RECG1MENDATION UNTIL THE NEXT REGULAR MEE'TING OF THE PLANNING AND ZONING CCM1ISSION OR UNTIL SUCH 'rIME THE MATIER HAD BEEN STUDIED. 6.CONSIDERATION MlD POSSIBLE REC<M,1ENDATION REGARDING THE PROPOSEDAMENLMENTS TO ZONING ORDINANCE NO. 84-15, SOCI'ION K -SIGNREGULATIONS -ORDINANCE NO. 323. CHAIRMAN BAKER ADVISED THE ca.1MISSION THAT THE NEW SIGN ORDINANCEHAD Ca.1E FROM THE MAYOR. HE SAID THERE WERE OTHERS WHICH BETIERREFLECTED P&7.'S VIEW, BUT THE OTHERS COULD Nar BE CONSIDERED. ANYPROPOSED CHANGES MUST BE NOTED ON THE NEW REVISION. THECXM-1ISSION REVIEWED THE MAJOR AREAS OF CONCERN FROM PAGES 1 -17.A SPECIAL MEETING WAS CALLED FOR MARCH 22, 1990 TO DISCUSS THESIGN ORDINANCE ONLY. CHAIRMAN BAKER INFORMED THE ca.1MISSION THATTHE PUBLIC HEARING WOULD BE HELD ON APRIL 2, 1990 RF.GARDLESS IFRECa.1MENDATION HAD cc.ME FRa-1 THE PLANNING AND ZCNING CCM'1ISSION. 7.CCMPREHENSIVE PLAN IN RE(',ARD TO CCMMUNITY SURVEY. CCM,1ISSIONER HOLZSCHUH ADDRESSED THE CCMMISSION WITH HIS C0'-1MENTSCONCERNING THE LE'ITER FROM THE PRESIDENT OF THE CHAMBER OFC'Clv1MERCE REGARDING THE PROPOSED SURVEY. CHAIRMAN BAKER SAID THE1'"'INAL SURVEY� HAVE TO BE PRINTED BY MARCH 29, 1990 IN ORDERTO GE!' INTO THE NE.WSLE'ITER. IT WAS AGREED THAT THE BOARD MEMBERSOF THE CHAMBER OF ca.1MERCE WOUI.D HAVE AN OPPORTUNITY TO C0'-1MENT ONTHE SURVEY PRIOR TO THE FINAL PRINTING.
