HE AI.SO REMINDED THE CCMMI SSION OF THE 300 TO 400 PEaIBONS WHO SPOKE IN OPPOSITION TO THE ZONE CHANGE REQUEST AT THE PUBLIC HEARING ON APRIL 2, 1990 AND NONE SPOKE IN FAVOR OF IT. BAKER TOLD THE CCMMISSION IF THE ZONE CHANGE REQUEST WERE DENIED, THE PROPERI'Y hUJLD REMAIN SFR (SINGLE FAMILY RFSIDENCE) IN WHICH CASE, THE CCMMISSION WOULD HAVE TO WORK WITH THE CMNER/DEVELOPER TO ENABLE HIM USE OF HIS PROPERTY. CDLBURN -MOTION THAT THE ZONE CLASSIFICATION CHANGE REQUEST OF SFR to MFR-M OF 5.6229 ACRES OF LAND LOCATED AT BRIAR CREEK AND FM 528 BE DENIED. SECOND: HOLZSCHUH VCYI'E FOR: UNANIMOUS OPPOSED: NONE MOTION CARRIED 2.CDNSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF.' 1.14ACRES INTO 4 LCYI'S -RESERVE "G" OF PARKWAY SUBDIVISION IN THESARAH r-'.cKISSICK LE.AGUE, ABSTRACT 151 -300 PARKWOOD -ZONED NC(NEIGHBORHOOD CXM-1ERCIAL DISTRICT) -IRISH GREEN II - IffiE IN REVIEWING THE FINAL PLAT, CITY ENGINEER THCMPSON POINTED OUT THAT THE REAR EASEMENT SHOULD BE 10' AS REQUIRED BY ORDINANCE; HOOEVER, THE PROPOSED FINAL PLAT OF IRISH GREEN II INDICATES A 5' EASEMENT IN THE REAR. AT THIS TIME, THERE IS NaI' A PRC\JECT'ED DATE FOR PROPERTY ACQUISITION BY THE HIGHWAY DEPAR'IMENT. SECOND: WASSON VCJ.r'E FOR: UNANIMOUS OPPOSED: NONE MOTION CARRIED 3.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF33.3792 ACRES OUT OF THE SARAH McKISSICK LEAGUE, ABSTRACT 151 -EAGLE LAKES SECTION I -MI'.IOIELL THE CCMw1ISSION REVIEWED THE FINAL PLAT WITH MITCHELL AND CITY ENGINEER THCMPSON WHO ADVISED THE CCMw1ISSION THAT A NUMBER OF ITEMS WERE NaI' CCMPLl..�. CCMw1ISSIONER HOLZ SCHUH SUGGESTED THE PLAT BE DEFERRED UNTIL THE NEXT REGULAR MEm'ING WHEN ALL ITEMS HAD BEEN ADDRESSED. THE CCMMISSION AGREED WITH THIS DECISION. 4.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF 4. 99ACRES O[JT OF THE SARAH McKISSICK OR J .R. WILLIAMS LEAGUE, ABSTRACT151 -EAGLE LAKES SECTION IV (FORME,'RLY KNONN AS FALCON RIDGE IV) -MITCHELL THE CCMw1ISSION REVIEWED THE FINAL PLAT NaI'ING THAT ALL REQUIRED REVISIONS HAD BEEN ADDRESSED. CXlvlMISSIONER WASSON MADE A MOI'ION THAT THE FINAL PLAT OF EAGLE LAKES SECTION IV BE APPROVED. SECOND: HOLZSCHUH VCJ.r'E FOR: UNANIMOUS OPPOSED: NONE MOTION CARRIED 5.PRE APP -BOCA RATON SUBDIVISION -55.98+ ACRES I.DCATED ON THEWEST SIDE OF SAN JOAQUIN PARKWAY AND FM 528 ACROSS FRC1-1 TENNISCLUB -ZONED SFR (SINGLE FAMILY RESIDENCE) -DAWSON. THE C(Mw1ISSION REVIEWED THE PRE APP OF BOCA RATON SUBDIVISION. THERE WAS A QUESTION CONCERNING THE EXXON DRILL SITE. CITY ENGINEER THCMPSON SAID THAT THE AREA WOUID HAVE TO BE REZONED SHOULD EXXON ABANDON THE DRILL SITE. CHAIHMAN BAKER ASKED THCMPSON IF SEWAGE HAD BEEN ADDRESSED BECAUSE DUANE HENGST HAD SAID THERE WAS NaI' CAPACITY TO ACXX:1-1MODATE ANY DEVEIDPMENT. THCMPSON REPLIED THAT COUNCIL HAD AUTHORIZED AN INTERIM PLAN 'IO INCREASE THE CAPABILITIES OF THE PUMPING SYSTEM TO SUNMEADCMS r 1 11 lJ P&Z 4/5/90 3 WHICH WOUID ALl./:Jtv CAPACITY FOR SEVERAL TRACTS TO BE DEVELOPED IN THAT IMMEDIATE AREA. THE CCMMISSION HAD NO OBJECTIONS TO THE PROPOSED SUBDIVISION. 6.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLA'l' OFWOFFORD ADDITION -1. 4 717 ACRE TRACT BEING A REPLAT OF PART OF IJYr1, BI.OCK 6 , FRIENDffi«X>D SUBDIVISION -A. W. CONNERY THE FINAL PLAT WAS REVIEWED. CCMMISSIONER MclIDGH MADE A MJTION THAT THE FINAL PLAT OF v.UFFORD ADDITION BE APPROVED. SOC'OND: COLBURN VOI'E FOR: UNANIMOUS OPPOSED: NONE MOTION CARRIED 7.REVIEW AND POSSIBLE RECCM-1ENDATION REGARDING PROPOSED REVISIONSTO THE FLOOD ORDINANCE. (FRANKOVICH). COUNCIIMAN FRANKOVICH REVIEWED THE REVISED RECCMMENDATION TO THE FLOOD ORDINANCE. FRANKOVICH SAID HE IDULD LIKE THE CCMMISSION ID APPROVE THE PROPOSED REVISION AND MAKE RECCM-1ENDATION TO CITY COUNCIL. CCMMISSIONER .McHUGH SAID THAT SHE STILL HAD A PROBLEM WITH THE hURDING REFERENCING THE SUBDIVISION OF SMALL TRACTS OF LAND. ENGINEER THCMPSON AGREED THAT HE ·woum LIKE A LI'I'I'LE MORE FLEXIBILITY AND GAVE AN EXAMPLE OF WHERE THIS IDRDING MIGHT CRFATE HARDSHIPS FOR A SMALL DEVELOPMENT. CCMMISSIONER WASSON SUGGFSTED THAT THE v.URDING "AT THE DISCREI'ION OF THE CITY ENGINEF.R" BE ADDED TO '!'HE RECCMMENDATION. CTMllSSIONER HOLZSCHUH SUGGESTED THAT A SIMPLE SE!' OF GUIDELINES BE PRESENTED SO THAT THE CITY ENGINEER WOULD NOI' BE INUNDATED WITH REQUESTS. HE SUGGESTED 'IBAT PERHAPS THE IDRDING "LESS THAN 10 ACRES OR LESS THAN 2 rms 1-1.AY BE EXEMPT FR<l-1 THIS SECTION UPON WRITI'EN APPLICATION TO THE CITY ENGINEER AND HIS APPROVAL THERIDF." THCMPSON SAID THAT HE FELT THAT IDRDING IDULD BE INADEQUATE BECAUSE IT WOUID Nar COVER ALL CASES. CCMMISSIONER McHUGH EXPRESSED HF..R OPINION THAT THE CI'l'Y ENGINEER SHOULD HAVE FINAL DECISION IN THE MA'ITER OF WHETHER OR Nar A DRAINAGE ANALYSIS IDUI.D BE ROOUIRED. THE ca-1MISSION, AS A WHOLE, AGREED THAT THE CITY ATTORNEY SHOULD BE CONSULTED SO THAT AN EQUITABLE SOLt.1I'ION COULD BE A'ITAINED. 8.CONSIDERATION AND POSSIBLE REX:Xl>1MENDATION REGARDING THE PROPOSEDAMENI:MENI'S TO ZONING ORDINANCE NO. 84-15, SECTION K -SIGNREGULATIONS -ORDINANCE NO. 323. IT WAS DECIDED THAT THE CCMMISSION WOULD LIKE TO MEET WITH CITY ATTORNEY JOHN OISON TO REVIEW BarH THE SIGN ORDINANCE AND THE REVISION TO THE FLOOD ORDINANCE.
