THE FOLI..avING MEMBERS WERE PRESENT: BAKER -CHAIRMAN COLBURN KCNCABA McHUGH RODGERS WASSCN THCMPSON -CITY ENGINEER HENRY -DEVELOPMENT COORDINA'IOR BRINI<MAN -SOCRETARY WITH A QUORUM PRESENT AND HOLZSCHUH ABSENT, THE FOLLCWING ITEMS WERE a:>NSIDERED. 1. CONSIDERATION AND POSSIBLE ACTION RffiARDING THE PROPOSED DESOTADRIVE -BCGREN. TED BOGREN PRESENTED THE PROPOSED PLANS FOR DFSOTA DRIVE WHICH HADBEEN PRESENTED 'IO CITY a:>UNCIL. a:>UNCIL SAID THIS ITEM HAD 'IOCOME BACK 'IO THEM THROUGH PROPER CHANNELS, WHICH WOULD BE THROUGHTHE CITY STAFF AND PLANNING AND ZONING. CHAIRMAN BAKER ASKED IFIT WAS A a:>RREX::T ASSUMPTION THAT THE LAND WAS 'IO BE ACCEPTED BYTHE CITY AND THE DEVELOPER WOULD BUILD THE STREET. BOGREN REPLIEDTHAT THIS WAS 'I.HE PLAN. ENGINEER THCMPSON SAID THAT HE AND MELVINMEINECKE, PUBLIC WORKS DIROC'IOR, WERE REVIEWING THE CONSTRUCTIONPLANS AND THE ALIGNMENT. HE ADDED THAT THE CITY HAD COPIES OF THEDEEDS; HCWE.'VER, THEY WfilIB NCYI' EXEOJTED AT THIS TIME. THCMPSON CCMMENTED THAT THE PROPOSED ROAD WAS 'IO BE 28'WIDE, AND WOULD BE OPEN DITCH; HCMEVER, THE PLAN IS 'IO MAKE THEROAD HAVE BOTH CURB AND GUTl'ER IN THE Flm.JRE. THCMPSON EXPRESSEDHIS a:>NCERN AS 'IO WHO WOUID DO THE CURBING; HOOEVER, DR. DAWSCN,OONER OF THE ADJOINING 12. 99 ACRES, HAS WRITTEN A LETTER ASSURINGTHAT WHEN HE (DAWSON) PLATS HIS SUBDIVISICN, CURB AND GU'ITER ANDSTORM SEWER WILL BE ADDED TO DFSCYI'A DRIVE. THCMPSON SAID THEDEVELOPER HAS APPLIED FOR THE PERMIT; HCMEVER, HAS NCYI' ROCEIVEDHIS AUI'HORIZATION YE'T. THE TITLE REPORI' WIIJ., HAVE 'IO BE UPDATEDPRIOR TO ACCEPTANCE BY THE CITY. ENGINEER THC1'1PSON ADVISED THE ca.1MISSION THAT ACCORDING TO THE MAJOR THOROUGHFARE PLAN, THE RIGHT-OF-WAY FOR SPREADING OAKS IS SHCWN TO BE 80' • ADDITIONALLY, THERE IS NO PROVISION ON THE PRELIMINARY PLAT FOR AN OFFSITE DRAINAGE OUI'FALL. MR. DavNING EXPLAINED THAT THE OUI'FALL WOUID GO THROUGH A PIPE INTO THE ROADSIDE DRAINAGE DITCH. HE SAID THEY WERE NO!' CHANGING THE 25 YEAR FUJfl POSITIOOS. DISCUSSION FOLLONED CONCERNING arHER DRAINAGE CONSIDERATIONS, Im SIZES, ETC. CXM>tISSIONER MCHUGH suroESTED THE ITEM BE TABLED UNTIL ENGINEER THOMPSON COULD REACH AN AGREEMENT WITH THE DE.VELOPER WITH REX:;ARDS 'ID THE RIGHT-OF-WAY. ENGINEER THC1'1PSOO SAID THAT HE COULD NOT DE.VIATE FRCM IIB;:2UIREMENTS FOR RIGHT-OF-WAY. MOI'ION TO APPROVE THE PRELIMINARY PLAT OF BROOKE .MF.ArovS CONTINGENT UPON THE RIGHT-OF-WAY FOR SPREADING OAKS TO BE CHANGED TO THE REX)UIRED 80' AND PROVISIONS ARE MADE FOR OFFSITE DRAINAGE IMPROVEMENTS -WASSOO. SEX::OND: McHUGH VCYI'E FOR: UNANIMOUS OPPOSED: NONE MOI'ION CARRIED 4.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OFDeVORE SUBDIVISION - A 14.9817 ACRE TRACT OF LAND OUT OF THE B.S.AND F. CITY ENGINEER THa.1PSON EXPLAINED TO THE CCMw1ISSION THAT THERE WERE SCME PROBLEMS WITH LIENS APPEARING ON THE TITLE REPORT. MS. GREENE SAID THAT THE TITLE CCMPANY WAS UPDATING THE REPORT AND ALL TITLE PROBLEMS WOUID BE CLEARED. THERE WERE ADDITIONAL CONCERNS WI'I'H REGARD TO THE DRAINAGE DISTRICT'' S APPROVAL. DR. JONES ADDRESSED THE CCMMISSION, ADVISING THEM OF SCMEPROBLEMS HE HAD CONFRONTED WITH REGARD TO THE Piwr'S ASSOCIATIONAND WITH THE H� 1 S ASSOCIATION. HE ASKED THAT THECCMMISSION GIVE THEIR APPROVAL CONTINGEN'I' UFON THOSE '!WO GROUPSBEING IN AGREEMENI' WITH THE REPLAT. THE DEVELOPER CCMMENTED THAT THESEPARATION OF STREETS WAS IN ORDER 'IO CONTROL TRAFFIC; HCME.VER,CHAIRMAN RAI<ER CCT>1MEN'.I'ED THAT THE FIRE DEPARIMENT AND OTHEREMERGENCY AGENCIES PREFERRED STRAIGHTER STREETS. 7.RNJUFST FOR A ZONE CLASSIFICATION CHANGE RNJUEST OF SFR (SINGLEFAMILY RESIDENTIAL) TO NC (NEIGHBORHOOD m1MERCIAL DISTRICT) 75'x 100', EXISTING STRUCTURE (F.M. 528) - DON KIRKPATRICK. 'I'HIS ITEM WAS WITHDRAWN BY MR. KIRKPATRICK, JUST PRIOR 'IO THEMEETING. 8.CONSIDERATION AND POSSIBLE �ATION RmARDING THE PROPOSEDAMENDMENTS 'IO ZONING ORDINANCE NO. 84-15, SECTION I< -SIGNRffiULATIONS -ORDINANCE NO. 323. THE CCMMISSION REVIEWED THEIR PROPOSED REffi\1MENDATICN OF THE SIGN ORDINANCE. CHAIRMAN BAKER ADVISED THE Cet-1MISSION THAT THE PROPOSED CHANGES WOUID BE AVAILABLE FOR THEIR APPROVAL AND FOR THE CITY COUNCIL'S PACKEI'S ON FRIDAY, MAY 18, 1990. 9.MINUTES FOR APPROVAL 3 [ 1 l J p & z 5/17/90 THE MINUTES WERE PASSED OVER UNTIL THE NEXT RmJLAR .MEETING OF THE PLANNING AND ZONING C<M1ISSION.
