REGULAR MEETING PLANNING AND ZONING CCMMISSION JUNE 21, 1990 7:00 P.M. AGENDA
A REGULAR MEETING OF THE FRIENDffi\U)D PLANNING AND ZCNING CCMMISSION WAS HELD ON THURSDAY, JUNE 21, 1990, AT 7:00 P.M. IN THE CITY HALL COUNCIL
CHAMBERS. THE FOLLCMING MEMBERS WERE PRESENT:

WITH A QUORUM PRESENT AND NONE ABSENT, THE FOU.CWING ITEMS WERE CONSIDERED.

MAYOR SCHRADER ADDRESSED THE COMMISSION RffiAIIDING A LE:ITER FRCM GUS WENZEL STATING THAT ALL PERSONS ON THE PLANNING AND ZONING COMMISSION WITH A RF.AL ESTATE CONFLICT OF INI'EREST, SHOUI.D BE REMOVED FRCM THE COMMISSION. HE STATED THAT THE LE:ITER WAS DATED 1988 AND WAS NOT A RECENI' LEITER. HE FURTHER EXPLAINED THAT HIS RESPONSE 'IO MR. WENZEL WAS THAT THERE WAS NOT A CONFLICT OF INTEREST, JN HIS ESTIMATION. SCHRADER SAID THAT HE ALSO 'IOID MR. WENZEL THAT ALL PERSONS ON THE PLANNING AND ZONJNG COMMISSION HAVE
A RESPONSIBILITY 'I'O REPORI' THAT CONFLICT BEFORE AN ISSUE WAS DEBATED OR VOTED ON.
LARRY OUTLER OF 204 CAS'I'Lll'roD EAST, PRESENTED THE COMMISSION WITH A LIST OF HIS CCMPLAINI'S REGARDING LAURELFIELD SUBDIVISION. DISCUSSION FOLLCMED AND CHAIRMAN BAKER AGREED TO ESTABLISH A
MEEI'ING Bl!."'IWEEN OUTLER, THE BUIIDER AND/OR DEVELOPER, THE CITY OF FRIENDSWOOD, AND PLANNING AND ZCNING. MR. OUI'LER' S MAJOR
cn,1PLAINT WAS THE LACK OF A PLANI'ING SCREEN AND THE TRUCKS TRAVELING IN FRONT OF HIS HCME.
KENT BALLARD ADDRESSED THE COMMISSION REGARDING A ONE ACRE TRACT OF LAND ADJACENT TO OAK TREE AND LAURELFIELD.
BALLARD EXPLAINED THAT THE PROPERTY WAS ADJACENT TO THE LAURELFIELD SUBDIVISION AND BE'IWEEN THE TRACTS OF LAND ON QUAKER'S BEND; 'I'HEREFORE, IT rs AN ISOLATED ONE ACRE TRACT. THE cmNER IS PROPOSING TO LEAVE THE CUL-DE-SAC IN TAC11 AND REPLAT THE TRACT ON'IO THE EXISTING LARGER TRACT (LOI'S 4 & 5) • HE FURTHER

3.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OFDeVORE SUBDIVISION - A 14.9817 ACRE TRACT OUT OF THE B.S. AND F.SURVEY, ABSTRACT 625, GALVESTCN, TEXAS. 4 rms IN'ro 1 BLOCK ONLUNDY LANE -SID GREENE.
THE CCMMISSION REVIEWED THE FINAL PLAT OF DeVORE SUBDIVISION AND crl'Y F.NGINEER THCMPSON CCMMENTED THAT THE MYLARS WERE NCYI' SIGNED WITH INDIA INK. HE REX:CMMENDED THAT MS. GREENE HAVE THE DeVORES 00 OVER THEIR SIGNATURES WITH INDIA INK, EXPLAINING THAT THE COUN.l'Y iuum Nar ACCEPT THE MYLARS FOR FILING, AS THEY WERE.

4.CONSIDERATION AND POSSIBLE ACTION RF..GARDING THE FINAL PLAT OFFALCON RIDGE II, A 44.9640 ACRE TRACT OF LAND OUT OF THE SARAHMcKISSICK LEAGUE (J.R. WILLIAMS), ABSTRACT NO. 151 -BOGREN.
THIS ITEM WAS Nar READY FOR FINAL PLAT APPROVAL AND WAS PASSED OVER BY THE CCMv1ISSION.
5.RATIFY AND CONFIRM THE FINAL PLAT OF FAGLE LAKES I -33.3792ACRE TRACT OUT OF THE SARAH McKISSICK LEAGUE -MITCHELL.
THE PLAT WAS REVIEWFD BY THE CCMMISSION. CITY ENGINEER THCMPSON CD1MENTED THAT THE ONLY ITEMS OUTSTANDING WERE SIGNATURES ON THE MYLARS AND THE FINAL COPY OF THE RESTRICTIVE COVENANTS, BOTH OF WHICH ARE REQUIRED BEFORE FILING WITH THE COUNTY.
COMMISSIONER HOLZSCHUH MADE A .MCYI'ION TF.AT THE FINAL PLAT OF FAGLE LAKES I BE APPROVED CONTINGENT UPON REX:EIPT OF FINAL RESTRICTIVE COVENANTS AND THE SIGNATURES SOCURED ON THE MYLAR. SEX:OND: COLBURN VCfl'E FOR: UNANIMOUS OPPOSED: NONE MarION CARRIED.

'ICM BURKE PRESENTED THE CCMMISSION WITH HIS PROPOSED SUBDIVISION, ADVISING THEM THAT ANOTHER PORl'ION OF PROPERI'Y WJLD HAVE TO BE REZONEDi HCMEVER, WITH 'l'HE NEW PROPOSED SUBDIVISION THE :RmUIRED UYr SIZE WOUID BE A'ITAINED. THE CCMMISSION AGREED WITH THE CONCEPT OF THE PROPOSED SUBDIVISION.

THERE WERE APPROXIMATELY 20 CITIZENS IN THE AUDIENCE, MANY OF WHa-1 ADDRESSED THE CCM,ITSSION WITH THEIR CONCERNS REC'..ARDING THE APPROVAL OF THE PROPOSED SUBDIVISION.
CITY ENGINEER THCMPSON EXPRESSED THE CONCERNS OF THE FIRE MARSHAL WITH REGARDS TO THE S'.I'REEI' NAMES AND CONI'INUITY OF STREETS • HE C'CM-1ENTED THAT THERE WERE Sa.1E MINOR CONCERNS AISO, WITH WATER LINF,S ON CUI.rDE-SACS, BCY.I'H WITH LINE SIZING AND WITH THOSE LINES GOING UNDER THE S'l'REID' AND NaI' AROUND THE CUI.rDE-SAC. 'I'HCMPSON'S MAJOR CONCERN HCWE.VER, WAS WITH REGARD TO DRAINAGE. THCMPSON CXM-1ENTED THAT HE HAD REVIEWED A DRAINAGE ANALYSIS WITH REGARD TO THE PROPOSED SUBDIVISION'S IMPACT ON CHIGGER CREEK BUT HAD NaI' BEEN GIVEN AN DRAINAGE IMPACT ANALYSIS FOR THE SUBDIVISION'S IMPACT ON THE EXISTING WIIDERNESS TRAITS 1 & 2. THERE IS NO DETEm'ION PROPOSED AT THIS TIME, BECAUSE THE OLDER DRAINAGE PLAN HAD BEEN DESIGNED TO HANDLE THE NEW WIIDERNESS TRAII.S. HE EXPLAINED THAT HE HAD NaI' SEEN DATA, OLD OR NEW, WHICH WOULD VERIFY THAT DRAINAGE WOUID TAKE CARE OF THE PROPOSED SUBDIVISION. THa.iPSON FURI'HER EXPLAINED THAT THE; PARTICULAR PIEX::E OF PROPERI'Y BEFORE THE CCMMISSION, FALIS ON THE DIVIDE BEIWEEN CHIGGER CREEK AND CCWARD'S CREEK AND IT WAS UNCLEAR WHERE THE DIVIDING LINE WAS.
AFTER MUCH DISCUSSION, CCM,1.ISSIONER WASSON MADE A MOTION THAT THIS ITEM BE TABLED FOR FURTHER DRAINAGE ANALYSIS, TRAFFIC IMPACT ANALYSIS, AND THE IMPACT OF THIS SUBDIVISION TO THE EXISTING SUBDIVISION. THERE WAS ADDITIONAL CONCERN WITH RESERVE GREEN SPACES AND PARKING WITH REGARD TO THOSE PROPOSED PARK ARF.AS. ADDITIONALLY, THE cx:MviENTS OF THE FIRE MARSHAL WIIJ., HAVE TO BE ADDRESSED. MR. NORI'HRUP AND McDONALD ASKED IF CONDITIONAL PRELIMINARY COUID BE GRANTED TO ASSIST IN THEIR FINANCIAL SITUATION. DISCUSSION FOLLCWED AND CCMMISSIONER WASSON MADE A MOTION THAT THIS ITEM BE UNTABLED. SOC'OND: HOLZ SCHUH

ENGJNEER THCMPSON EXPRESSED HIS CONCERN WITH CONTINGEN.I' APPROVAL AS DID C<M-llSSIONER McHUGH. IT WAS AGREED THAT IF CONI'INGENT PRELIMINARY APPROVAL WAS GRANTED THAT THE DEVELOIMENT WOUI.D HAVE TO CQ\1E BEFORE THE C'CMMISSION ONCE MORE FOR REVISED PRELIMINARY APPROVAL. CHAIRMAN BAKER ADVISED THE DEVELOPERS THAT THE LIST OF CONTINGENCIES WAS POSSIBLY INCCMPLETE AND THAT SHOULD ENGINEER THCMPSON OR THE CLEAR CREEK DFAINAGE DISTRICT HAVE FllRI'HER REQUIREMENTS, THAT THEY TOO WOUID HAVE TO BE ADDRESSED.
C01MISSIONER WASSON MADE A MCYI'ION THAT THE PRELIMINARY PLAT OF WILDERNESS TRAILS BE APPROVED CONI'INGENT UPON A DRAINAGE ANALYSIS, TRAFFIC IMPACT ANALYSIS, AND THE IMPACT OF THIS SUBDIVISION 'IO THE EXISTING SUBDIVISION. ADDITIONALLY, THE DEVELOPERS WERE TO SUPPLY PLANNING AND ZONING WITH INFORMATION CONCERNING THE RESERVE GREEN SPACES AND PARKING WITH REGARD TO THOSE PROPOSED PARK ARF.AS AS WELL AS ADDRESSING THE a:M-1ENTS OF 'IBE FIRE MARSHAL. SECOND: HOLZSCHUH VOI'E FOR: WASSON, HOLZSCHUH, COLBURN, RODGERS, BAKER OPPOSED: KONCABA AND McHUGH MOTION CARRIED

CHAIRMAN BAKER ADVISED THE cet,1MISSION THAT THE ORDINANCE HAD A MAXIMUM HEIGHT REQUIREMENT OF 35 1 • THE ONLY WAY A HCME LIKE THE PROPOSED COUID BE BUILT IN FRIENDSWOOD IS IF THE PR OPERTY WERE REZONED 'IO SFR -SPECIFIC USE. THE CCMMISSION REVIEWED THE PLANS FOR THE PROPOSED HCME AT 907 QUAKER BEND AND CAIJ..ED A PUBLIC HF.ARING FOR AUGUST 6, 1990.
11.PRE APP -GOIDMAN SUBDIVISION -REPLAT OF wrs 6 AND 7,FRIENDSWCX)D ESTATES SUBDIVISION ON MYRI'LE,WX)D -GOLDMAN.
THE Ca-1MISSION REVIEWED THE PRE APP FOR THE GOIDMAN SUBDIVISION AND APPROVED MRS. GOLIMAN 'S PLANS TO ADJUST HER wr LINES. SHE WAS INFORMED THAT SHE COUID GO SHORT FORM AND WAS ADVISED 'IO SEE DEVELOPMENT COORDINA'IOR HENRY FOR ASSISTANCE.

THIS ITEM WAS PASSED OVER UNTIL THE NEXT REGULAR MEF.I'ING OF THE PLANNING AND ZONING CCM-1ISSION.

THE PROPOSED ORDINANCE WAS REVIEWED BY THE CCMMISSION AND DISCUSSION FOLI.CMED REGARDING THE INTENT OF THE ORDINANCE. CXM-1ISSIONER KONCABA MADE A rtillION THAT THE PROPOSED AMENDMENT 'IO THE ORDINANCE BE �ED TO CITY COUNCIL FOR APPROVAL. SECOND: COLBURN
