HE EXPLAINED THAT ROCENTLY, WITHIN THE LAST FEW WEE<S, THE CLF.AR CREEK DRAINAGE CCM,1ISSION REQUIRED THE DEVELOPER 'IO PLACE A NOI'E ON EACH PLAT THAT WENT 'IO '!'HEM FOR SUBDIV ISION APPROVAL. BAKER SAID THAT HE UNDERST(X)D THE NEED FOR THIS NCf.I'E WHEN SUBDIVIDJNG C<M-1ERCIAL PROPERTIES; HCWEVER, IT HAD BOCCl>1E A CONCERN FOR THE INDIVIDUAL WHO WAS DIVIDING HIS/HER PROPERI'Y IN'IO '1W) PORTIONS. MEANWHILE, THE ITEM WILL BE PLACED CN THE CX>UNCIL AGENDA FOR THEIR NEXT RffiULAR MEETING SO THAT THE QUESTION CAN BE DISCUSSED AT LENGTH. 4.CONSIDERA'fION AND POSSIBLE RECCMMENDATION REQ\RDING THE ZONECLASSIFICATION CHANGE REQUF,ST OF NC (NEIGHBORHOOD CCMMERCIALDISTRICT) TO SFR (SINGLE FAMILY RESIDENI'IAL) 3.5299 ACRES OF LANDAT OAK DRIVE AND FM 518 (RESERVE L) IN POLLY RANCH -O'FARRELL. MR. GARCIA WAS ASKED WHAT HE HAD PROPOSED FOR HIS PROPERTY WHICH ADJOINS THE 3.5299 ACRES OF LAND IN THE PROCESS OF ZCNE CLASSIFICATION CHANGE. MR. GARCIA TOLD THE CCMMISSION THAT HE WISHED 'IO PUT IN A BAR-B-Q PLACE AND FELT HE troULD HAVE SCME PROBLEMS OOING SO IF THE PROPERTY ON OAK DRIVE AND FM 518 WERE REZONED 'IO SINGLE FAMILY RESIDENTIAL. CHAIRMAN BAKER CX>UNSELED MR. GARCIA THAT ANY OONER OF A PROPERTY COUID REQUF,ST A ZONE CLASSIFICATION CHANGE IF HE/SHE DESIRED. BAKER ADVISED MR. GARCIA THAT HE SHOULD SEE THE DEVELOPMENI' CX>ORDINA'IOR 'IO BOOIN PROCESS FOR ZONE CLASSIFICATION CHANGE REQUF,ST ON HIS PROPERl'Y IF THAT WAS HIS DESIRE. CCMMISSIONER HOLZSCHUH SAID THAT HE FELT THE PROPERl'Y SHOUID BE REZONE BEx::AUSE THE PROPERTY HAD BEEN ZONE SFR AND WAS CHANGED 'IO NC RECENTLY. HOLZSCHUH MADE A MOTION THAT THE C(M,ITSSION REXXM•1.END 'IO CITY CX>UNCIL THAT THE ZONE CLASSIFICATION CHANGE REX)UEST OF NC (NEIGHBORHOOD CCMMERCIAL DISTRICT) 'IO SFR (SINGLE FAMILY RESIDENI'IAL) BE APPROVED. THE PLANNING AND ZONING Ca.1MISSION QUESTIONED THE NEED TO HAVE THREE DRIVES WHICH 'WOULD EXIT ONTO FM 518; HCMEVER, THERE WAS NO REPRESENTATION FOR THE OONER OR DEVELOPER OF THE PROPERTY. A PUBLIC HF.ARING WAS CALLED FOR AUGUST 6, 1990. 8.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FJNAL PLAT OFFALCON RIDGE II, A 44.9640 ACRE TRACT OF LAND OUT OF THE SARAHMcKISSICK LF.AGUE (J.R. WIIJ.,IAMS), ABSTRACT NO. 151 -BOGREN. ENGINEER THCMPSON INFORMED THE C(M.ITSSION THAT THERE WERE NO LIEN HOLDER SIGNATURFS ON THE MYLARS, THE TITLE REPORT HAD NCY.I' BEEN UPDA'l'ED, AND THE DEED RESTRICTIONS HAD NCYI' BEEN RECEIVED BY CCMMUNITY DE.VELOPMENT. CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OFKEYSTONE MF.Ar:avS -26 ACRE TRACT OF LAND OUT OF THE S.E. WHITNEYSUBDIVISION ON FM 528 -BOGREN. CITY ENGINEER THOOPSON ADVISED THE ca.1MISSION THAT THE CITY STAFF WAS MISSING SEVERAL ITEMS; THE UPDATED TITLE REPORT, DEED RESTRICTIONS, STATE HIGHWAY DEPAR'IMENT PEFMITS, LIEN ROIDER SIGNATURES, AND MYLARS. MR. DOYLE ASKED THE C<M-1.ISSION TO APPROVE THE PLAT CONTINGENT UPON THESE ITEMS. CHAIRMAN BAKER INFORMED MR. DOYLE THAT IF THE CC:t•i-1ISSION WERE TO DO SO, THE MYLARS COUID NOI' BE SIGNED lM.rIL HE (DOYLE) RETURNED TO THE CCM-1.ISSION FOR CONFIRMATION AND RATIFICATION; THEREFORE, NO TIME WOULD BE SAVED. THIS ITEM WAS WITHDRAWN PRIOR TO THE MEEI'ING. 11.SITE PLAN - FM 528 - MR. EADES MR. EADES PRESENTED A SITE PLAN OF THE PROPOSED DRIVING RANGE WHICH WIIJ., BE CONSTRUCTED BEHIND THE BALL FIELDS ON FM 528. EADES INDICATED TO THE C<M-1.ISSION THAT HE WOUID PREFER ADDING ADDITIONAL PARKING USING OYSTER SHEU.S; HOOE.VER, OOULD ADD 24 PARKING SPACES USING CONCRETE IF THE CG1MISSION RF.QUIRED. HIS PURPOSE FOR USING OYSTER SHELL WAS PRIMARILY DUE TO THE EX:ONCMICS INVOLVED. HE EXPLAINED THAT IN THE FUTURE HE FELT THE NEEDS OF THE CQ\1t,IDNI'l'Y MIGHT CHANGE AND THE PROPERrY MIGHT BEXXME rt.ORE VALUABLE FOR 3 1 I l l l P&Z 7/5/90 CYl'HER USES. MR. FJ.\DES AISO ADVISED THE Ca-1MISSION THAT THE STATE HAD OBTAINED RIGHT-OF-WAY AND IN DOING IT APPEARED THAT A RATHER LAR3E OAK TREE WOUID BE DESTROYED. HE HAD APPFALED 'IO THE STATE 'IO SAVE THE TREE BY CONSTRUCTING THE ROAD AROUND IT OR BY RELCCATING THE TREE 'IO THE INTERIOR OF THE BALL PARK. THE STATE HAD NaI' BEEN RECEPTIVE 'IO EITHER IDEA. HE ASKED IF PERHAPS THE CITY MIGHT JOIN IN HIS EFFORI'S 'IO SAVE THE OAK TREE. DISCUSSION FOI...LavED CONCERNING THE TREE AND IT WAS DETERMINED THAT MR. FADES COUID APPROACH COUNCIL 'IO SEE IF THE CITY MIGHT GET INVOLVED. CCM-1ISSIONER WASSON MADE A .MOTION TO ACCEPT THE PRELIMINARY SITE PLAN. SECOND: KCNCABA VarE FOR: UNANJMOUS OPPOSED: NONE MOTION CARRIED 12.LAND DEVELOPMENT BOOKLET THE CCMMISSION AGREED THAT THE LAND DEVELOPMENT BOOKLET HAD BEENWELL PREPARED AND APPROVED THE CONCEPT. THEY WERE UNAN:W.JOUS INTHEIR DECISION THAT THE MATTER CONCERNING THE CLFJ\R CREEK DRAINAGEDISTRICT BE RESOLVED BEFORE GIVING FINAL APPROVAL 'IO THE BOOK SOTHAT IT MIGHT BE INCORPORATED IN THE MATERIAL. 13.CCMPREHENSIVE PLAN (M.W.) c:x::MMISSIONER HOLZSCHUH �lTED THAT HE ¾OULD HAVE THE RESULTSOF THE SURVEY AT THE NEXT REGlJLAR MEEI'ING OF THE PLANNING ANDZCNING CCMMISSION. C(l,1MISSIONER WASSON ADDED THAT THE ca.1MISSIONMIGHT WANT TO PRESENT A REPORI' OF THE SURVEY RESULTS TO CITYCOUNCIL. WASSCN ALSO STATED THAT SHE ¾OULD LIKE 'IO SEE THECCM'lISSION ¼ORK CN THEIR GOALS AT THE NEXT REGlJLAR MEETING.CCMMISSIONER McHUGH REMINDED THE Ca-1MISSICN THAT DEVELOPMENTCOO:RDINA'IOR HENRY HAD OBTAINED A COPY OF 'IHE CCMPREHENSIVE PIANFOR THE CITY OF BELLAIRE. McHUGH SAID SHE HAD REVIEWED THEM ANDWAS QUITE IMPRESSED, SUGGESTING THAT THEY 'IOO, MIGHT RFJ.\D THEPLAN PRIOR 'IO THE NEXT MEETING OF P&Z • 14.MINUTES FOR APPROVAL -MAY 17, 1990.
