A REGULAR MEETING OF THE FRIENDffi'X)()D PLANNING AND ZONING COMMISSION TO WAS HELD ON THURSDAY, SEPTEMBER 20, 1990, AT 7:00 P.M. IN THE CITY HALL COUNCIL CHAMBERS. THE FOLLCMING MEMBERS WERE PRESENT: BAKER -CHAIRMAN RODGERS McHUGH WASSON KONCABA HENRY -DEVELOPMENT COORDINATOR BRINKMAN -SOCRE'I'ARY WITH A QUORUM PRESENT, HOLZSCHUH AND COLBURN ABSENT, CHAIRMAN BAKER CALLED THE MEEI'ING TO ORDER TO CONSIDER THE FOIJOHNG: 1.CONSIDERA'rION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OFPOLLY OAKS (RESERVES K&L OF THE POLLY RANCH SUBDIVISION) -18 ImS-GARTRELL. IN THE ABSENCE OF ENGINEER THOOPSON, DEVELOPMENT COORDINATOR HENRY INFORMED THE CCt-1MISSION THAT ALL ITEMS HAD NO!' BEEN ROCEIVED BY CITY S'l'AFF AND THEREFORE THIS ITEM BE PASSED OVER UNI'IL THE NEXT REGULAR MEEI'ING OF THE PLANNING AND ZONING CCMMISSION. 2.CONSIDERATION AND POSSIBLE ROCCMMENDATION REGARDING THE ZONECLASSIFICATION CHANGE REQUEST OF SFR (SINGLE FAMILY RESIDE'NTIAL)TO CSC (CCM-1UNITY SHOPPING CENTER DISTRICT) FOR 0.1664 ACRES(7,248 SQUARE FEET) OF LAND LOCATED AT FM 2351 AND BLACKHAWK(PUBLIC HEARING -AUGUST 6, 1990). CHAIRMAN BAKER INFORMED THE COMMISSION THAT THE PARI'IFS INVOLVED WERE IN THE PROCESS OF IDRKING OUT THE PROBLEMS RmARDING THE PROPOSED SITE PLAN AND WERE CLOSE TO AN Ex;).UITABLE SOLUTION. THIS ITEM WAS PASSED OVER UNTIL THOSE PROBLEMS ARE SOLVED. 3.DISCUSSION REGARDING 25,000 SQUARE FEET OF LAND LOCATED AT FM 528BY THE PEPPERMINI' PARK FACILITY -PROPOSED USED CAR rm -DAVIDGILBREATH. MR. GILBREATH WAS Nar IN ATTENDANCE THEREFORE, THIS ITEM WAS PASSED OVER. 4.CHAIRMAN BAKER CALLED A PUBLIC HEARING FOR OCTOBER 1, 1990 TOHEAR PUBLIC INPllr REGARDING THE ZONE CLASSIFICATION CHANGEREQUESTS OF THE FOLLCMING: a.ZONE CLASSIFICATION CHANGE REQUEST OF CSC (ca1MUNITY SHOPPINGCENTER DISTRICT) TO OPD (OFFICE PARK DISTRICT) -#4 OAKTREE,FM 518, 3.810 ACRES.b.ZONE CLASSIFICATION CHANGE REQUEST OF SFR (SINGLE FAMILYRESIDENTIAL) TO OPD (OFFICE PARK DISTRICT) - LOI' 4, BLOCK f l l J 11, FRIENDffi\WD SUBDIVISION -1.0325 ACRES BEHIND OAK TREE. THE COMMISSION WAS INFDRMED OF THE PUBLIC HEARING SET FOR OCTOBER 1, 1990 AND WERE AISO INFDRMED OF ANOTHER ESTABLISHED FOR OCTOBER 15, 1990. 5.DISCUSSION REGARDING DEED RESTRICTIONS -D. ARCHER. CITY SECRFI'ARY, D. ARCHER, EXPLAINED A CONCERN REGARDING DEEDRESTRICTIONS. ARCHER ADVISED THE COMMISSION OF INSTANCES WHEREDEVELOPERS ¾"OULD FILE AN AMENtMENT TO THEIR DEED RESTRICTIONS ORADISENDCW,1ENT OF THE RESTRICTIONS AFTER THEY WERE FILED BY THECITY. THE CONCURRENI' FILING IS DONE WITHOUT THE KNOOLEDGE OF THECITY. SHE HAD SPOKEN WITH JESSIE KIRKENDALL, COUNTY CLERK, WHOEXPLAINED THAT SHE (KIRKENDALL) WAS BOUND BY I.AW TO FILE ALL FULLYEXECUTED DOCUMENTS WHICH WERE PRESENTED FOR FILING. AT PRESENT,THE CITY RmUIFES DEED RESTRICTIONS 'ro BE FILED SIMULTANOOUSLYWITH THE FINAL PLAT WHICH, IN ARCHER'S OPINION LFAVES THE CITYEXPOSED. THE CITY A'I'IORNEY AGREES 'WITH ARCHER AND HAS SUGGESTEDTHAT THE PLANNING AND ZONING CCM-1ISSION MIGHT WANT 'ro REVIEW THESUBDIVISION ORDINANCE AND REM)VE THE IID,2UIREMENT THAT DEVELOPERSHAVE TO PROVIDE THE CITY WITH A FINAL SET OF RESTRICTIONS FORFILING. THE DEVELOPER WOULD BE RESPONSIBLE FOR FILING THEIR CMNRESTRICTIONS AND THE CITY WJJ.D l\X:> LONGER BE IN AN EXPOSEDSI'IVATION. 6.CCMPREHENSIVE PLAN (M.W.) COMMISSIONER WASSON REVIEWED THE SURVEY WHICH HAD BEEN MAILED OUTFARLIER THIS YEAR WITH THE CITY NE.WSLET.l.1ER. THE Ca-1MISSIONRECONSIDERED THE GOAIS AND OBJK'TIVES PORTION OF THE CG1PREHENSIVEPLAN AND FOUND THEM 'ro BE IN LINE WITH THE DESIRES OF THE CITIZENSOF FRIENDffi\WD. IT WAS DEX::IDED THAT THE GRAPH, PRODOCED BYCOMMISSIONER HOLZSCHUH, AND THE OOALS AND OBJOCI'IVES OF THECOOPREHENSIVE PLAN WOUID BE PRESENTED 'ro THE CITY COUNCIL FORTHEIR PERUSAL. THE PRESENI'ATION WILL BE AT CITY COUNCIL'S NEXTREGULAR MEFI'ING OR AT SUCH TIME THAT �SSIONERS HOLZSCHUH ANDWASSON ARE AVAILABLE 'ro MAKE A PRESENTATION. 7.MINTJl'ES FOR APPROVAL -SEPTEMBER 6, 1990.
