A SPECIAL MEETING OF THE FRIENDffi\mD PLANNING AND ZONING CQ'1MISSION/CIP ADVISORY COMMI'ITEE WAS HELD ON IDNDAY, JUNE 4, 1990 AT 7:00 P.M. IN THE CITY HALL COUNCIL CHAMBERS. THE FOLLCMING MEMBERS WERE PRESENT:

WITH A QUORUM PRESENT, KONCABA, RODGERS, WASSON, SPEARS, AND BLAKE ABSENT, THE FOLL(M.[NG ITEMS WERE CONSIDERED.
IX>CKETED JOINT PUBLIC HEARING: A PUBLIC HEARING FOR '.rHE PLANNING AND ZONING Cc:t,1MISSION 'IO RECEIVE PUBLIC INPUT, BOI'H ORAL AND WRI'ITEN, REGARDING THE ITEMS LISTED BELCW:
1.CONSIDERATION AND POSSIBLE ACTION RffiARDING THE CAPITALIMPROVEMENT PLAN -IMPACT FEE.
CHAIRMAN BAKER ADDRESSED THE AUDIENCE THAT THE CAPITAL IMPROVEMENTS PLAN WITH IMPACT FEES HAD 'IO BE ADOPTED BY JUNE 20, 1990 ACCORDING 'IO SENATE BILL 336. HE FURTHER EXPLAINED THAT THE CIP WILL NOI' AFFECT THOSE PERSONS WHO CURRENTLY CMN HCMES IN FRIENDSV.UJD, BUT WOUID AFFECT THOSE PERSONS WHO WOUID BUILD Het-1ES IN THE FUTURE. CHAIRMAN BAKER TlmNED THE MEETING OVER 'IO DICK GAY OF BRCWN AND GAY ENGINEERING.
DICK GAY ADDRESSED THE AUDIENCE WITH AN OVERALL REVIEW OF THE CAPITAL IMPROVEMENT PLAN AND THE MANNER IN WHICH THE FEES WERE CALCULATED. HE EXPLAINED THAT THE COST STUDY HAD INCLUDED WASTE WATER COLLECTION BUT HAD NCYl' CONSIDERED WASTE TREA'IMENT. GAY SAID THAT COUNCII.MEMBER RITI'ER HAD QUFSTIONFD THE CITY'S TREA'.I'MENT CAPACITY AT THE BLACKHAWK SE.WAGE TREA'IMENI' PLANT WITH REGARD 'IO THE CIP. MR. GAY SAID THAT THE FIRST PHASE AT THE BLACKHAWK TREA'IMENT PLANT WAS 'IO CAPACITY AND THE COST COULD NOI' BE CONSIDERED; HCWEVER, THE SEX:.'OND PHASE WAS STILL AVAILABLE AND THAT COST COULD BE CONSIDF.RED FOR RECOVERY IN THE CIP. HAVING CHANGED THE ORIGINAL FIGURES 'IO REFLECT AN OVERALL CITY COST 'IO COVER THE BLACKHAWK WASTE TREATMENT, THE CITY HAD DECIDED 'IO HOLD A SECOND PUBLIC HEARING WITH REX:'..ARD 'IO IMPACT FEF.S. HE STATED THAT AT PRESENT, THE PLAN HAD BEEN AVAILABLE FOR THE PUBLIC'S REVIEW FOR APPROXIMATELY 30 DAYS. GAY SAID THAT THE '1W) PRIMARY FAC'IORS THAT ARE CONSIDERED IN THE CALCULATION OF FEES WAS THE 'IOTAL COST OF THE IMPROVEMENT AND THE TCY.I'AL UNITS 'IO BE SERVICED.
MR. GAY CONTINUED HIS REMARKS SAYING THAT THE SENATE BIIJ., STATED THAT THE CITY COUID NOI' EXCEED A TEN YE.AR TIME FRAME WHEN CONSIDERING THE GRCM.rH IN THE FOUR PRIMARY ARF.AS; CEN'I'RAL AREA, MELODY LANE, NORTHWEST SOCTION, AND ALONG BAY AREA BLVD. HE

INFORMED THE AUDIENCE THAT THE ADOPTED ZONING MAP HAD BEEN USED TO DETERMINE THE AREAS C'ONSIDERED '.OCGETHER WITH I<NOOLEDGE OF POI'ENTIAL GRCWI'H IN THE CITY AS INDICATED BY THE CAPITAL IMPROVEMENTS ADVISORY CCMMI'ITEE .
'IW) CITIZENS FRCM THE AUDIENCE SPOKE. ONE ASKED ABOUT THE WASTEl'iQ\TER FEE FOR THE CENI'RAL ARF'..A AND THE SECOND ASKED IF THE PROPOSED LINES FOR WASTEWATER COLLECI'ION WERE ADEQUATE TO ACC(M,'.ODA'I'E SUN MFADCl'lS. MR. C-.AY QUOTED THE FIGURE FOR THE CENTRAL AREA AND ADVISED THE AUDIENCE THAT THE PROPOSED LINE WOULD BE SUFFICIENT TO ACCCM'DDATE SUN MEADC:mS AS WELL AS anIER PROPOSED DEVELOPMENT ALONG FM 528.
WITH NO aI'HER ca-1MENT FRCM THE AUDIENCE, THE CIP PORTION OF THE PUBLIC HEARING WAS CLOSED.
2.A ZONE CLASSIFICATION CHANGE REQUEST OF CSC (CCM'1UNITY SHOPPINGCENTER DISTRICT) TO SFR (SINGLE FAMILY RESIDENTIAL FOR 1. 0030ACRES BEING A PART OF 11.4003 ACRES OF LAND OUT OF r..ars 15 AND 16,BLCCI< 5, FRIENDSWOOD SUBDIVISION -(CEDAIMOOD AND W. CASTLEWOOD).
TCM BURKE ADVISED THE CCMMISSION THAT THE PROPERTY TO BE REZONED DID NCII' CCMPLY WITH SIZE REQUIREMENTS FOR ITS CURRENT ZONING AND WOUID THEREFORE, REQUIRE A VARIANCE. HE FURl'HER REMARKED THAT CWNERS OF A NEARBY PIECE OF PROPERTY HAD ASKED FOR THEIR PROPERTY TO BE REZONE FRCM SFR TO A CCM-1ERCIAL ZONING AND HAD BEEN DENIED THEIR REX)UFST. BURKE WENT ON TO SAY THAT BY CHANGING THE ZONING OF THE PROPERTY TO SFR THE TAXABLE VALUE WOUID BE INCREASFD 20 TIMES. MR. BURKE l\�S ASKED ABOUT THE PROPOSED EXCHANGE OF LAND TO SUPPLY A ROAD TO THE CITY'S SWIMMING PCX)L. MR. BURKE ADVISED THAT HIS NEXT STEP WAS TO GO BEFORE THE PLANNING AND ZONING CCMMISSION WITH THREE PROPOSED OPTIONS. IT WOUID BE THE FUNCTION OF THE PLANNING AND ZONING cetJIMISSION TO ADVISE HIM (BURKE) WHICH PLAN '11HEY WOUID SUPPORT. �D OR THREE PERSONS IN THE AUDIENCE SPOKE IN FAVOR OF THE REZONING AND l\10NE SPOKE IN OPPOSITION.
THE PUBLIC HEARING WAS ADJOURNED.
