HomeMy WebLinkAboutP&Z Minutes 1986-10-02 RegularMINUTES OF A REGULAR MEETING OF THE FRIENDSWOOD PLANNING AND ZONING COMMISSION October 2, 1986 The Friendswood Planning and Zoning Commission held a regular meeting on Thursday, October 2, 1986, at 7:00 P.M. in the City Hall Council Chambers. The following Commissioners were present. Holt -- Chairman Councilman Prihoda Todd Baker Cress Ballard Beeth With a quorum present and with Beggs absent, the following business was transacted. REQUEST_FOR REZONING Mrs. Harrelson submitted a request to rezone a 6,536 square foot tract of land located at 201 Magnolia from SFR. to OBD. Mrs. Harrelson was advised to file an application for a zone class- ification change. LIBERTY TREE Mrs. Wagner addressed the Commission regarding Liberty Tree Estates saying they are considering subdividing 3 acres of lot 3 (6.5317 acres) to be added to lot 4 (7.4791 acres). When Liberty Tree Estates was platted and recorded in July 1985 the lots were restricted to no further subdividing for 10 years. The deed restrictions would have to be modified before replatting of the subdivision. Replatting would require the short form method of subdividing addressed in the subdivision ordinance. MRS. BROUSSARD - PRE APP -- MURPHY 3 LOTS !I Mrs. Broussard owns 2.5 acres on Murphy Lane and is considering subdividing the tract into 3 lots. The survey presented by Mrs. Broussard shows a pipeline located within the tract of land. Page 2 October 2, 1986 The Commission requested information regarding the passage of proposed ordinance 86-8 which could change the set back require- ments of property with a pipeline, SECTION 19-11; THIRD PARAGRAPH AS FOLLOWS: "No residential, commercial or industrial structure other than structures necessary to operate the pipeline shall be erected or moved to a location. nearer than forty (40) feet to any pipeline transporting flammable materials when the pipeline pressure is greater than two hundred fifty (250 psi) unless a greater or lesser distance is recommended by the then applicable USAS Code." SECTION 19-11 THIRD PARAGRAPH PROPOSED CHANGE: "No residential, commercial or industrial structure other than structures necessary to operate the pipeline shall be erected or moved to a location nearer than ten (10) feet to any pipeline easement or, if there be no pipeline easement, within forty (40) feet to any pipeline transporting flammable material when the operating pressure is greater than 250 pounds per square inch (250 psi) unless a greater or lesser distance is required by the then applicable USAS Code." The Commission advised Mrs. Broussard to follow the short form procedure for subdividing. COMMISSIONER KENT BALLARD ABSTAINED FROM THE FOLLOWING DISCUSSION: FRIENDSWOOD RETIREMENT LIVING CENTER. ORDINANCE NO. T86-14 - EXHIBIT A PLAT The Commission reviewed proposed ordinance T86-14 pertaining to a 13.3288 acre tract for a Specific Use - PUD development known as The Friendswood Retirement Living Center. Chairman Holt will be forwarding the additions and changes to the City Attorney. Chairman Holt called a special meeting for Monday, October 6, 1986, to review the plat (Exhibit A) and proposed ordinance T86-14 additions and changes to be presented to the City Council. Page 3 October 2, 1986 CHARTER REVIEW COMMISSION - RECOMMENDATION SECTION: City Manager Section (4.01) SUB PARAGRAPH C. To provide Council with the flexibility of entering into a contract with the City Manager, the Planning and zoning Commission recommends the City Charter be amended: Term and Removal: The City Manager may be removed at the discretion of the Council, by vote of at least (5) members of the entire Council. The action of the Council in suspending or removing the City Manager shall be final. It is the intention of this charter to vest all authority and fix all responsibilities of such suspension or removal in the Council. _ The intent of this recommendation is to insulate the City Manager from short term effects of unpopular decisions.
