With a quorum present, Chairman Baker and Vase Chairman Todd
absent, the following items were considered.
MR. ILLERICH - 121 CHERRY TREE LANE - DRAINAGE OUTFALL
Mr. Illerich addressed the Planning and Zoning Commission in
regard to a proposed development increasing the storm water
runoff through a natural gully that crosses his property and
several neighboring properties. Mr. Illerich was discussing
with the Clear Creek Drainage District an easement along Clear
Creek owned by the CCDD.which was creating a problem of pond--
ing water and mosquito breeding at the far edge of his property
when he discovered the proposed development which he felt would
create a storm water runoff problem.
Mr. Illerich wants to make it clear to the Planning and Zoning
Commission he is not objecting to the proposed development his
concern being the potential damage to adjacent property. He
is submitting the following letter dated March 24, 1987 to the
Planning and Zoning Commission to be reflected in the minutes
to keep his concern alive.

Ladies and Gentlemen of the Commission:
I have reviewed a copy of Clear Creek Drainage District
letter of 22 December 1986 signed by Mr. A. Frank Frankovich,
President. This letter is in response to my letter of 18
September 1986 addressed to Planning and Zoning Commission.
There are several items in the 22 December letter
that are of particular concern to me.
In the first instance, I have never been privileged
to see or discuss with anyone the signed written agreement
between Clear Lake Drainage District and the proposed
subdivider that was attached to the 22 December letter to
Planning and Zoning Commission; I find that quite incon--
sistant with the rights of private property owners. It
appears to me that we should have been consulted and made privy
to all information concerning the agreement prior to the
signing of that document by Clear Creek Drainage District
and the proposed subdivider.
In the second instance, it appears that there has been
a change in Clear Creek Drainage District philosophy sub-
sequent to my letter of 18 September. See paragraph 5 of
my letter and paragraph 2 of Clear Creek Drainage District
letter. In my original discussion with the responsible
persons at the Drainage District I was assured that the
drainage flow over my --and adjoining -private property was to
be controlled by metering. Now it is explained that the
drainage flow is to be uncontrolled which will in no way
protect us from trash damage, contamination and erosion to
our property. At least when the drainage flow was to be
controlled some amount of trash damage, contamination and
erosion control could be anticipated. With the new phil-
osophy we will be susceptible to trash and contamination
originating in the Friendswood Timbers Subdivision and
deposited on our property. Again, I have never been
offered the opportunity to discuss or review the so-called
pertinent data referred to by Clear Creek Drainage District
to justify the concept of uncontrolled drainage flow across
my --and adjoining -private property.

In the third instance, I do not really perceive that
there is a logical comparison between my back yard and the
open recreational area of Camp Manison. If there is a com-
parison, I would like to know just what the Drainage District
proposes to do in my back yard to prevent damage to my property
as they are doing at the Camp Manison prperty.
In the fourth instance, Clear Creek Drainage District
does not address my concern about the quite possible damage
to our properties as the result of contaminate originating
in the proposed Friendswood Timbers subdivision. I fully
understand that this is not within the scope of their flood
control mandate. However, I must continue to petition for
relief in this part of the problem from Planning and Zoning
Commission and City Council.
In the fifth instance, I have no concern that the 15 acre
detention pond and the Corp of Engineers takingover the
Drainage District right-of-way on my property will do anything
but improve the flooding situation for the public good of the
citizans of Friendswood. What does concern me is that the
attainment of this public good will be at the expense -as I
see it now --of current property owners and taxpayers living
in Enchanted Woods subdivision.
In the sixth instance, I find it disturbing that
correspondence passing between Clear Lake Drainage District
and Planning and Zoning Commission did not include a
courtesy copy to me considering my extreme interest in this
ongoing problem. Had it not been for a member of City Council
I would never have known that this correspondence existed.
Your attention to my concerns over drainage from the
proposed Friendswood Timbers subdivision across our private
propety in Enchanted Woods subdivision is much appreciated.

The Clear Creek Drainage District responded in a letter dated
December 22, 1986, to the Planning and Zoning Commission in
reference to Mr. Illerich's letter of September 18, 1986. All
correspondence is reflected in previous minutes.
Mr. Illerich told the Commission he did not expect any solution
tonight he just wants to keep his concerns known because sooner
or later the property will be developed.
F.M. 2351 - KIM REED - ZONE CLASSIFICATION CHANGE
Mr. Reed owns 1.4959 acres located on F.M. 2351 known as
Cypress Plaza where he developed a strip center housing
Reed's Restaurant. Mr. Reed's property is zoned CSC and
he is making an application for a zone classification
change to the rear portion of the site. The present 1.4959
acres is zoned CSC and his request will be a CSC - Specific
Use- Storage. The storage will be the same material as the
strip center and not visable from F.M. 2351. The Commission
advised Mr. Reed to proceed with his application for a zone
classification change and Specific Use Permit as set forth in
the zoning ordinance (Section 9 G. Specific Use Permit).
MR. BTNNER -- CAR WASH-- F.M. 2351
Mr. Binner addressed the Commission on a proposed change of
use from Car Repair to Detailed Car Wash on the property
located at the corner of F.M. 2351 and Melody Lane.
Lt. Williams of the Police Department submitted the following
comments to the Commission.
1. The access to and from the establishment can be from
two separate right--of--ways, however, we may have to install
"NO STANDING OR PARKING" signs on both roadways if a traffic
problem arises.
2. The property in the viewing areas of the intersection
must be kept open so on coming traffic can see a reasonable
distance down the intersecting street.
3. If any structural additions are added you should be
advised in advance so that no obstacles are created in so far
as the traffic is concerned.

4. If the proposed washing area is going to be covered,
I would like to know what the distance is of the covered area
to the right-of-way of the nearest road.
Mr. Binner was advised the ordinance requirements for parking
would be seven (7) employee spaces. The site plan presented
indicated entering on F.M. 2351 and exiting through an exist-
ing building leading to Melody Lane, which has roll up doors
on each.end.
The Commission advised Mr. Binner the exit needed to be by
other means than thru the building. Perhaps a double lane
entrance leading to the exit on Melody Lane. They also felt
the gate entrance on F.M. 2351 should be widened from 12' to
at least 16' for easier access. The Commission requested the
following constraints be shown on the site plan.
1. Only One Way In be clearly marked
2. Only One Way Out be clearly marked.
3. Widen the entrance gate located on F.M. 2351 for
better ingress.
4. Required parking spaces be shown.
5. A means of exit be provided other than through
the existing building or the car wash lane.
The meeting was adjourned.
