Minutes of the Regular Meeting of the Zoning Board of Adjustment of the City of Friendswood was held at City Hall
on March 26, 2002 at 7:00 p.m. with the following members present constituting a quorum:

Chairman Decker, called the hearing to order to receive public input regarding Haverford Development Co., Inc.
requesting a variance for property located at 602 Royal Oaks, Lots 7, Block 1, Section 4, The Forest Subdivision,
Galveston County, Texas, for reduction of rear setback of 25' to approximately 18'. City of Friendswood Code,
Appendix C-Zoning, Section 7.Q. 2.
Discussion followed with Haverford Development Co., Inc. representative Toby Miller explaining request. Hardship: 1)
Emotional, 2) Monetary.
Hearing no further input the Public Hearing was closed at 7:10 pm.

Re: Variance request - 602 Royal Oaks
Lot 7, Blk 1, The Forest Section Four
Attached please find the documentation related to the request for a zoning ordinance
variance. The applicant is seeking a variance on the required rear yard set backs for
a Single Family residence. Section 7, Q. 2. the Residential Regulation Matrix, states
that the required rear yard setback shall be 25 feet..
Currently, builders are have the option of obtaining either an independent engineer's
inspection or a city inspection before a foundation is poured. A form survey must be
submitted to the building department along with an engineer's letter if the city does
not inspect a foundation pour.
The form survey when submitted for this lot was rejected due to the approximately
18.foot rear set back. See attached Exhibit A. The builder was verbally informed of
the set back problem by the Building Inspector. The builder acknowledged the
survey was incorrect and stated he would re -submit a corrected form survey.
In this instance, the builder had begun construction on the house with an incorrect
survey. The construction is essentially completed. It will cost the builder tens of
thousands of dollars to correct his mistake. Replatting the lot is not an option as it
abuts a pipeline easement. The pipeline set back has been maintained and is not
an issue.
Construction stopped after the home builder informed the building inspector that
there was still a problem with the rear set back.
Although significant financial costs will be incurred in order to correct the rear yard
set back, the formal definition of hardship has not been demonstrated to approve the
variance request.
