CHAIRMAN BAKER ASKED ENGINEER THCtl.iPSON 'IO EXPIAIN THE PROPOSED AMENDMENT 'IO THE CAPITAL IMPROVEMENT PIAN. THOMPSON EXPIAINED THE PRCCEDURE FOR CALCUIATING IMPACT FEES FOR CCMMERCIAL DEVELOPMfill"T ACCORDING TO THE ADOPTED CAPITAL IMPROVEMEt'-1"1.' PLAN. THE PROPOSED Af.fu""'NDMENT 'IO THE CIP PLAN WOUID BE A MORE EQUITABLE SOLUTION. 'l'HCMPSON PRESENTED THE PROPOSED AMb""'NCMENT STATING THAT HE HAD USED THE CITY OF HOUS'ION' S CRl'I'ERIA FOR THE DIFFERENT CCMMERCIAL DEVELOPMENTS. THCMPSON CITED AN EXAMPLE WHERE A CHURCH WANTED TO DEVELOP A FOUR ACRE TRACT OF PROPERI'Y FOR A 200 SEAT CHURCH WHICH WOULD HAVE A ONCE A WEEK CONTRIBUI'ION 'l'O THE SEWER SYSTEM. THEIR IMPACT FEE, BASED UPON OUR CURREN'l' CIP PLAN, WOULD BE $13 , 00 0. THE PROPOSED AMENDMENT viOULD SET THE CHURCH'S IMPACT FEE AT A FEE THAT WOULD BE fv'.DRE EQUITABLE TO THEIR IMPACT OF THE SYSTEM. THCMPSON ALSO STATED THAT A COUNCIIMEMBER HAD EXPRESSED HIS CONCERN BECAUSE THE ORIGINAL.PLAN HAD BEEN ESTABLISHED BY LAND USE WHICH WAS BASED ON OUR ZONING MAP. ZONING FRCM C<M-1ERCIAL TO SINGLE FAMILY RESIDENTIAL WOULD AFFOCT THE INCOME ROCEIVED BY THE CI'IY, COMMISSIONER FINGER Rr:.QUESTED THAT THCMPSON PREPARE A STATEME'NT OF THE CIP FUNDS COLLOCTED BY THE CITY, USING '!'HE FACTOR RELATIVE 'IO GALLONS PER DAY AS PROPOSED AND THE CURRENT PLAN W1IICH IS FIGURED BY ACREAGE. ENGINEER THa.1PSON STATED THAT THE CITY WAS PROPOSING A HIKE AND BIKE TRAIL ON THE OPPOSITE SIDE OF THE ROAD FRCM THIS PROPER'l'Y. '!'HE CCMMISSION AGREED THAT THE POOPOSED PLAT WAS THE BEST POSSIBLE USE OF THE LAND. CONSIDERA'l'ION AND POSSIBLE ACTION REC-ARDING 'l'HE FINAL PLAT OF POOLE SUBDIVISION LOCATED ON CEDAR\\"OOD ('IBO LOTS) -LCWE FAMILY 1988 TRUS'l'. ENGINEER THa.1PSON STATED THAT CITY STAFF WAS MISSING A PIPE LINE LE'ITER FOR THIS PROPERTY. JANIS LOWE INFORMED THE COMMISSION THAT THE CLEAR CREEK DRAINAGE DISTRICT DID NOT APPROVE THE PLAT BEC'.AUSE SHE DID NOT HAVE A DRAINAGE PLAN. SHE STATED THAT THE PROPERTY IS BEING SUBDIVIDED IN'ID 'Il\10 PORI'IONS WITH ONE SECTION BEING S01D 'fO AN ADJOINING HOMEOiv1IBR AND THE OTHER FOR'l'ION REJ.1AINING BARREN UNTIL IT IS SOID. I.CME STATED THAT SCMEWHERE THERE HAD BEEN A POLICY CHANGE. ENOUGH. CHAIWJAN BAKER SAID THAT THE STA'I'ElvlENT HAD BEEN ACCEPTABLE IN SEVERAL INSTANCES. MS. LCWE REQUESTED THE CCMMISSION TO APPROVE THE PIAT IN LIEU OF THE FACT THAT IT HAD BEEN POLICY IN THE PAST TO ACCEP'r SUCH A STATEMENT. FRANKOVICH COMMENTF.D THAT THE PRESENT ADMINISTRATION OF THE CCDD FELT THE STATEMENT WAS NO LONGER SATISFACTORY IN THAT THEY �DUID Nm' HAVE ANOI'HER LOOK AT 'l'HE DRAINAGE. ENGINEER THOMPSON SAID THAT HE HAD JUST RECEIVED A PIAT FROM THE HARRIS COUNTY FLOOD CONTROL DISTRICT '!'HAT HAD THE EXACT ¾ORDING AFFIXED. CCMMISSIONER WASSON STATED 'l'HAT THE CLEAR CREEK DRAINAGE DISTRICT HJI.D NO!' INFORMED THE PLANNING AND ZONING CCM'1.ISSION OR CITY STAFF OF THE CHANGE IN THEIR POLICY. DISCUSSION FOI..La'JED REGARDING THE AMENDMENT TO THE FLOOD DAMAGE PREVENTION ORDINANCE WHERE THE CITY ENGINEER IS GIVEN THE AUTHORITY TO APPROVE DRAINAGE PLANS IN SUCH AN INSTANCE. MS. LCWE STATED THAT SHE HAD POSTPONED THE SECOND READING OF THE ZONE CIASSIFICATION CHANGE BECAUSE IF THIS PIAT WAS NO!' APPROVED, IT OOULD Nm' BE PROFITABLE TO HER TO REZONE THE PROPERTY. CHAIFMAN BAKER SAID THAT THE OPTIONS OF '!'HE CCT-1MISSION WERE TO TABLE THE MA'ITER OR APPROVE IT AND SEND A IEITER TO THE DISTRICT EXPIAINING WHY PLANNING AND ZONING DID SO. BAKER STATED THAT THE CCM-1ISSION'S POLICY HAD NOT CHANGED AND THAT THE CCDD SHOUID HAVE NOTIFIED THE PROPER ENTITIES OF A CHANGE IN THEIR POLICY. BAKER RECOMMENDED THAT 'l'HE COMMISSION APPROVE THE PIAT.
