A REGULAR MEETING OF THE FRIENDffi'X.)()D PLANNING AND ZONING Ca-1MISSION WAS HELD ON THURSDAY, SEPTEMBER 5, 1991, AT 7:00 P.M. IN THE CITY HALL COUNCIL CHAMBERS. THE FOLLCWING MEMBERS WERE PRESENT: KONCABA -VICE CHAIRMAN COLBURN FINGER JORDAN WASSON HENRY -DEVELOPMENT COORDINATOR TI-ICT-1PSON -CITY ENGINEER WITH A QUORUM PRESENT AND BAKER AND RODGERS ABSENT, VICE CHAIRMAN KONCABA OPENED THE MEETING ASKING FOR CCM-1UNICATIONS FRCM THE PUBLIC. MR. DORSETT ASKED TO ADDRESS THE CCMv1ISSION REGARDING THE TEMPORARY BATCHING FACILITY WHICH IS TO BE LOCATED NEXT TO THE FIRE STATION ON FM 528 FOR THE STATE HIGHWAY WIDENING PROJECT. HE STATED THAT DORSETT v.URKS FOR J .D. ABRAMS AND THAT THE STATE HAD GIVEN THEM 24 MONTHS TO ca-1PLETE THE JOB. MR. DORSETT ADDED THAT THEY WERE A lOCAL CCT-1PANY our OF PASADENA AND WOULD CCT-1PLY WITH ALL OF THE REQUIREMENI'S REGARDING AIR POLLUrION CONI'ROL, ETC. AND ASKED IF THE Ca-1MISSION HAD FURl'HER QUESTIONS. VICE CHAIRMAN KONCABA ADVISED MR. DORSETT OF THE PROCEDURES WHICH WILL HAVE TO BE FOLLCMED REGARDING THE ZONE CLASSIFICATION CHANGE REQUEST AND INFORMED THE CCMMISSION A PUBLIC THAT A PUBLIC HEARING HAD BEEN ESTABLISHED ON OCI'OBER 3, 1991. 1.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OFPHASE THREE OF PARI'IAL REPLAT OF THE REPLAT OF "THE PARK" - 4 I.illS- KENT BALLARD. DR. JONES PRESENTED THE PROPOSED PLAT INDICATING THAT THEY DID NOI' HAVE THE DRAINAGE DISTRICT SIGNATURES BUT STAFF DID HAVE A LEI'l'ER OF APPROVAL ON FILE. JONES ASKED THAT THE PLANNING AND ZONING Ca.1MISSION GIVE APPROVAL CONTINGENT UPON THE DRAINAGE DISTRICT'S SIGNATURE. CCMMISSIONER FINGER MADE A MYJ.'ION THAT THE FINAL PLAT OF PHASE THREE OF PARI'IAL REPLAT OF THE REPLAT OF "THE PARK" BE APPROVED CONTINGENT UPON THE SIGNATURE REQUIRED. SECOND: COLBURN VOI'E FOR: UNANIMOUS OPPOSED: NONE MOTION CARRIED 2.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OFPHASE FOUR OF PARI'IAL REPLAT OF THE REPLAT OF "THE PARK" -1. 3663ACRES -KENT BALLARD. DR. JONES SAID THAT THE SAME APPLIED TO THE PLAT OF PHASE FOUR WHICH WERE THE PATIO HCMES. ENGINEER THCT-1PSON STATED THAT THE STAFF DID HAVE A LETTER OF APPROVAL ON FILE. u P&Z September 5, 1991 Page 2 Ca.1MISSIONER COLBURN MADE A MOTION THAT THE FINAL PLAT BE APPROVED CONTINGENT UPON THE CCDD'S SIGNATURE. S:OCOND: FINGER VOTE FOR: UNANIMOUS OPPOSED: NONE MOTION CARRIED 3.PRE APP -LEISURE ESTATES -WINDING WAY AND LEISURE LANE -5 ACRES -GARI'RELL ENGINEER THCW'SON STATED THAT THE CITY DID Nar ACQUIRE ENOUGH RIGHT-OF-WAY FOR THE REALIGNMENT OF WINDING WAY AND AS A RESULT THE DITCH AND FORCE MAIN IS ON PRIVATE PROPERI'Y. THCW'SON SAID THAT HE WOULD FAVOR ACCEPl'ING THE RIGHT-OF-WAY WHICH WOUID ALSO ALl£Jil THE DEVELOPER HIS 120' WIDTH REQUIRED ON ALL THE LOTS. THE Ca.1MISSION AGREED TO THE CONCEPT. 4.CONSIDEIWrION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF KATIE'S PARK SUBDIVISION - GARl'RELL ENGINEER THCW'SON COOMENTED THAT THE DETENTION SYSTEM INDICATED ON THE PLAT PARALLELED THE CREEK AND IT WAS SUGGESTED THAT GARl'RELL SHCM SWALES ALONG THE LOT LINE OR PROVIDE ADDITIONAL CAPACITY IN THE CREEK ITSELF. GARI'RELL AGREED TO SWALES ON THE PROPERI'Y LINES AND ENGINEER THCW'SON SAID THA'l' THIS WAS A WORKABLE SOLUI'ION. THCW'SON EXPLAINED THE WCATION OF RESTRICTER PIPES SO THAT THE TREES WIIJ., NOI' BE AFFECI'ED. Ca.1MISSIONER FINGER MADE A MOTION THAT THE FINAL PLAT OF KATIE'S PARK SUBDIVISION BE APPROVED. S:OCOND: COLBURN VOTE FOR: UNANIMOUS OPPOSED: NONE MOTION CARRIED 5.PRE APP -BRCMN ACRES -3 .1240 ACRES OF LAND WCATED ON WOODLAWN TO BE SUBDIVIDED INTO 3 LOTS (presently zoned SFR -Single Family Residential) -CHUCK DAVIS AND FLOYD BRCMN, JR. THE CCMMISSION REVIEWED THE PLAT AND ENGINEER THCMPSON STATED THAT HE HAD NO PROBLEMS WITH THE PLAT, UTILITIES WERE IN PLACE AND IT WAS Nar A MAJOR THOROUGHFARE. THE CCM1ISSION AGREED WITH THE CONCEPT. 6.PRE APP -SOUTHERN BREEZE -1. 9661 ACRES WCATED AT FM 518 AND E. CASTLEWOOD, TO BE SUBDIVIDED INTO 5 LOTS (presently zoned NC - Neighborhcx:x:l Conmercial District) - CHUCK DAVIS AND FLOYD BRCWN,JR. ENGINEER THCW'SON ADVISED THE COMMISSION OF THE EXACT WCATION OF THE PROPERI'Y. C(M,USSIONER WASSON EXPRESSED HER CONCERN WITH DRIVE.WAYS ON FM 518 AND ASKED IF A CCMMON ACCESS WOUID BE POSSIBLE SO THAT THERE WOUID BE FEWER DRIVES ON THE MAJOR ROAD. ENGINEER THCMPSON SAID THAT P&Z COULD LIMIT THE NUMBER OF DRIVES BY PLAT BUT IT WOUID BE DIFFICULT IF THE '1WO END PIECES DID Nar DEVELOP FIRST. THCMPSON STATED THAT IT WOULD BE DEPENDENT WHERE THE [ l I u P&Z September 5; 1991 Page 3 MEDIAN OPENINGS ARE ALSO. THE CCM1ISSION AGREED TO THE CONCEPT BUT ASKED IF THE DEVELOPER 'WOULD LIMIT THE DRIVEWAY ACCESS TO '!WO IF POSSIBLE. 7.PRE APP -BALES LEA -1.94 ACRES OF LAND I.OCA'rED ON FM 518 INFRONT OF LAURELFIELD SUBDIVISION AND ADJACENT TO OAK TREEDEVELOPMENT, TO BE SUBDIVIDED INTO 3 LOI'S -CHUCK DAVIS (presentlyzoned NC -Neighborhood Comnercial District). ENGINEER THa.1PSON ADVISED MR. DAVIS THAT EXISTING IMPROVEMENTS ¼QUID NEED TO BE SHavN ON BOl'H OF THE CCMMERCIAL PLAT. THE CCM1ISSION REVIEWED THE PLAT AND AGREED WITH THE CONCEPT REITERATING THEIR REQUIREMENT TO RESTRICT DRIVEWAYS ON FM 518. IT WAS DISCUSSED THAT A CCM-10N ACCESS COULD 'WORK FOR BCfI'H PIECES OF LAND AS THERE 'WOULD BE ONE CONTINUOUS PIECE OF PROPERTY. 8.PRE APP -GARDEN OAKS -244 x 300 -'!WO LOI'S -GARDEN DRIVE ANDSHAD<M BEND -CHUCK DAVIS THE CCM,1.ISSION REVIEWED THE PROPOSED PLAT AND AGREED WITH THE CONCEPT. 9.CONSIDERATION AND POSSIBLE ACTION REGARDING THE AMENDED PLAT OFCARMEL VIIJ.AGE II -UTILITY RELOCATION -GARTRELL VICE CHAIRMAN KONCABA EXPLAINED THAT THE PURPOSE WAS TO RELOCATE A 10 FOOl' TEXAS-NEW MEXICO UTILITY EASEMENT FRCM REAR LOI'S TO FRONT LOI'S. THERE ARE A LARGE NUMBER OF PIPE LINES IN THE AREA AND IN AN EFFORI' TO CURI'AIL COSTS TEXAS-NEW MEXICO PUT IN OVERHEAD LINES IN THIS LOCATION. DR. JONES INFORMED THE CCM1ISSION THAT AT PRESENT THE UTILITY LINES ARE ABOVE GROUND AND ONE OF THE BUILDERS IS REQUIRED BY HIS MORI'GAGE Ca.1PANY TO PLACE THE UTILITIES UNDER GROUND. 'I'HEREFORE, THEY ARE REQUESTING THAT THE UTILITY EASEMENT IN THE REAR OF THE PROPERTIES BE ABANDONED AND THE UTILITY EASEMENT GRANI'ED IN THE FRON!' SO THAT IT WILL BE POSSIBLE TO DO SO. THE HCMECMINER ALSO REQUESTED THAT THE LINE BE MOVED DUE TO ITS CLOSE PROXIMITY TO HIS HCME. IT WILL COST APPROXIMATELY $20,000 TO RELOCATE THE LINE AND ALTHOUGH THE HCMEXJNNERS WIIJ., BE BEARING THE LARGEST PART OF THE COST, TEXAS-NEW MEXICO WIIJ., BE SUPERVISING THE PROCEDURE. THE TRANSFORMERS WIIJ., BE LOCATED IN THE FRONT. THERE ARE INTERIM CONSTRUCTION LENDERS AS WELL AS THE PERMANENT LENDER WHOSE SIGNATURES APPEAR ON THE MYLAR. CCM1ISSIONER WASSON ASKED IF THIS WAS CONSIDERED A REPLAT WHICH 'WOUID HAVE TO Ca.1PLY WITH THE SUBDIVISION LAWS GOVERNING REPLATS. ENGINEER THa.1PSON SAID THAT HE HAD CONFERRED WITH THE CITY ATTORNEY WHO STATED THAT IT WAS AN AMENDMENT TO THE PLAT AND NO!' A REPLAT, AS LOl' LINES WERE NO!' CHANGING. CCMMISSIONER FINGER ASKED WHY UTILITIES COULD NO!' BE Pur UNDERGROUND TavARD THE REAR OF THE PROPERTY. DR. JONES SAID THAT THE DEVELOPER WANI'ED TO RELOCATE THE UTILITY EASEMENT TO GIVE THE HCMECMINER MORE RCa-1 IN THE REAR OF HIS PROPERTY FOR SPAS, PATIOS, El'C. THE CCMMISSION AGREED '!'HAT THIS WAS A MUCH BETTF..R CONCEPT. DEVELOPMENT COORDINATOR HENRY ADVISED THE CCMMISSION THAT STAFF WAS MINUS THE CLEAR CREEK DRAINAGE DISTRICT'S APPROVAL AND THAT OF GALVESTON COUNTY DRAINAGE f l I l l P&Z September 5, 1991 Page 4 DISTRICT #3. KENT BALLARD ASKED FOR APPROVAL CONTINGENT UPON THE ACQUISITION OF THE SIGNATURES BOCAUSE THE BUILDER'S MORTGAGE CCMPANY WAS ABOUT TO PULL OUT, THEREFORE TIME WAS OF THE ESSENCE. ca'1MISSIONER JORDAN MADE A MOTION THAT THE PLAT BE APPROVED CONTINGENT UPON THE REQUIRED SIGNA'I'URES.
