A REGULAR MEETING OF THE FRIENDSWOOD PLANNING AND ZONING CCM,1ISSION WAS HELD ON THURSDAY, NOVEMBER 7, 1991, AT 7: 00 P .M. IN THE CITY HALL COUNCIL CHAMBERS. THE FOLI.avING MEMBERS WERE PRESENT: KONCABA -VICE CHAIRMAN FINGER RODGERS WASSON THCM.PSON -CITY ENGINEER HENRY - DEVELOPMENT COORDINA'l'OR BRINKMAN -SECREI'ARY WITH A QUORUM PRESENT, BAKER, COLBURN AND JORDAN ABSENT, VICE CHAIRMAN KONCABA CALLED THE MEEI'ING OF THE PLANNING AND ZONING COMMISSION TO ORDER AND ASKED FOR CCM-1UNICA'£IONS FRCM THE PUBLIC. WITH NO CCMMUNICATION FRCM THE PUBLIC, THE FOLI..avING ITEMS CONSIDERED: 1.DISCUSSION BY CHESTER DRIVE Ha.1ECMNER'S ASSOCIATION -SHIRLEYBAIN. MS. BAIN ADDRESSED THE COMMISSION REGARDING A LOT THAT WAS TO BE SUBDIVIDED IN THEIR SUBDIVISION BY MR. NATCHMAN. SHE STATED THAT THERE WERE 'IWO "FOR SALE" SIGNS ON THE PROPER"rY AND THAT THE SURROUNDING HCMECWNERS HAD BEEN TOLD THAT THE PROPER'l1Y HAD ALREADY BEEN SUBDIVIDED. THE CCM-1ISSION ADVISED MS. BAIN THAT THE PROPERI'Y HAD NOT BEEN SUBDIVIDED AND VICE CHAIRMAN KONCABA INFORMED HER THAT THE PROPERI'Y HAD CCME BEFORE THE CCM,1ISSION ONLY 00 A PRE-APP BASIS. MS. BAIN SAID SHE HAD A LETI'ER FRCM MR. EIGNUS WHO HAD DE.'VELOPED THE LOT. HIS INTENTION WAS FOR THE LOTS TO REMAIN LARGE, CONSISTING OF ONLY ONE Hafil PER LOT. IN ADDITION, MS. BAIN SAID SHE HAD A PETITION WITH ALL OF THE HCMECWNER' S SIGNA'IVRES IN OBJECTION TO THE SUBDIVISION. SHE ALSO STATED THAT WHILE THE SUBDIVISION MAY MEEl' THE STANDARDS FOR THE CITY OF FRIENDSWOOD, IT IS ALSO AGAINST THE DEED RESTRICTIONS WHICH GOVERN THEIR NEIGHBORHOOD. VICE CHAIRMAN KONCABA REITERATED THAT THE SUBDIVISION HAD NOT BEEN FINALIZED AND THAT THE PROPERI'Y COULD NOT BE SOLD UNTIL THE SUBDIVISION PRCCESS WAS CCMPLl!.'""TE. HE FURI'HER STATED THAT THE CITY CANNOT ENFORCE DEED RESTRICTIONS BUT WOULD ASK THAT PEDPLE CCMPLY WITH THEM. 2.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF FAGLE LAKES, SECTION II -WALTER P. MCX)RE, THIS ITFM WAS NOT READY AND WAS WITHDRAWN FRCM THE AGENDA. 3.CONSIDERATION AND POSSIBLE ACTION REGARDING 'l'HE FINAL PLAT OF THORNI'ON ACRES -CLEAR CREEK DRAINAGE DISTRICT. THE COMMISSION REVIEWED THE FINAL PLAT OF THORNTON ACRES. MRS. THORN'I'ON PRESENTED A LETI'ER DATED APRIL 7, 1983 FRCM THE CITY OF ·FRIENDSWOOD. THE r,mrrnR, SIGNED BY MELVIN MEINECKE, CCM-IT'ITED THE CITY TO BUILDING A DRIVE.WAY TO THE THORNTON'S PROPERI'Y FACING SUNSET DRIVE, WHEN REQUESTED BY THEM. THE LEITER STATED THAT THE DRIVE.WAY WOULD BE BUILT BY PLACING REINFORCED CONCRETE PIPE IN THE [ l l lJ P&Z November 7, 1991 Page 2 DI'ICH, BY PLACING DIR'r AND LIMES'l'ONE OVER THE PIPE AND THEN PLACING CONCRETE PAVING FRCM SUNSET DRIVE TO THEIR PROPERI'Y. ENGINEER THCMPSON SAID THAT AT THE TIME THE LE."ITER WAS WRITTEN, '.I'HE BRIDGE WAS UNDER CONSTRUCTION AND ONE Im' WOULD BE INACCESSIBLE. HE C<M-1ENI'ED THAT NOW IT WAS NCYr REALLY NECESSARY SINCE BOTH I.OI'S HAD ADEXlUATE ACCESS FRCM COWARD'S CREEK. HE ALSO EXPRESSED THE OPINION THAT THE ca-1MISSION SHOULD LIMIT ACCESS ON SUNSET DRIVE. CCM-1ISSIONER FINGER SAID THA'l' HE FELT THE AGREEMENT WITH THE CITY SHOULD BE HONORED. MRS. THORNTON SAID THAT SHE DID NCYr WANT TO MAKE AN ISSUE OF THE DRIVEWAY NOR DID SHE WANl' TO JEOPARDIZE THE SUBDIVISION, BUT FELT THAT IT v.lQUID BE CONVENIENT FOR THEM. CCM-1ISSIONER FINGER ROCCMMENDED THA'l' PLAT NCYrE #6 BE CHANGED TO READ THAT ONE DRIVE.WAY WOULD BE PERMI'ITED OFF OF SUNSET AND ASKED IF THE THORNI'ONS WOULD BE CCMFOR'rABLE WITH THAT PLAT NOTE. MRS. THORNTON SAID THA'l' SHE WOULD. CCMMISSIONER WASSON FELT AS THOUGH THE PRESENT SUBDIVISION REQUIREMENTS SHOULD SUPERSEDE ANY CYrHER AGREEMENTS AND SHE WAS OPPOSED TO MORE DRIVES ON SUNSET. CCMMISSIONER FINGER MADE A MOI'ION THAT THE FINAL PLAT BE APPROVED CONTINGENT UPON THE CHANGE OF PLAT NOTE #6 TO RF.AD THAT NO MORE THAN ONE DRIVl!."WAY WOULD BE PERMITTED ON SUNSET. SECOND: RODGERS VOTE FOR: KONCJI..BA, FINGER, RODGERS OPPOSED: WASSON MOTION CARRIED 4.A ZONE CLASSIFICATION CHANGE REQUEST FRCM CSC (CCMMUNITY SHOPPING CENTER DISTRIC'l' TO MFR-H (MULTIPLE FAMILY RESIDENTIAL OOELLING DISTRICT -HIGHEST) -8.1064 ACRES ON FM 518 -HAUSMAN. THE PLANNING AND ZONING CCM,1ISSION CALLED A PUBLIC HEARING FOR DECEMBER 2, 1991. 5.A ZONE CLASSIFICATION CHANGE REQUEST FRCM CSC (CCMMUNITY SHOPPING CENTER DISTRICT TO MFR-H (MULTIPLE FAMILY RESIDENTIAL DWELLING DISTRICT -HIGHEST) -FM 518 BY THE LUTHERAN CHURCH -CAMPBEIL / v.UJI'ERS. THE PLANNING AND ZONING CCMMISSION CALLED A PUBLIC HEARING FOR DECEMBER 2, 1991. 6.PRE-APP -WINDSONG -BILL GROTE. THE TRACT IS A FOUR ACRE TRACT OF LAND CMNED BY DR. BOONE, WHICH IS TO BE SUBDIVIDED INTO '1WO TRACTS OF '!WO ACRES EACH. WINDSONG IS AN UNRECORDED PLAT. CCM-1ISSIONER FINGER ASKED WHAT WOULD BE REQUIRED FOR THE PEOPLE 'ro SUBDIVIDE AND BUILD ON THE PROPERI'Y. ENGINEER THCMPSON SAID THAT A BUILDING PERMIT WOUID BE ISSUED SHOULD THEY WISH 'l'O BUILD ON THE 4 ACRE TRACT BUT IN SUBDIVIDING, THE DEVELOPER WOULD HAVE TO CCMPLY WITH CURRENT SUBDIVISION ORDINANCE. THAT REGULATION REQUIRES A PUBLIC STREET OR AN APPROVED PRIVATE STREET IN ORDER TO BUIID A STRUCTURE. QUESTION AROSE AS TO RATHER OR NCYr THE ROAD WOULD HAVE TO BE IMPROVED TO CITY STANDARDS ACCORDING TO THE CITY'S SUBDIVISION ORDINANCE. THE GENERAL CONSENSUS WAS THAT THE ROAD WOULD HAVE TO BE IMPROVED TO 'rHE CITY STANDARDS BUT THAT THE CITY A'ITORNEY COUID BE CONSULTED. f I j P&Z November 7, 1991 Page 3 ENGINEER THOMPSON SAID THAT THERE WERE SEVERAL Ol'HER PROPERI'IES IN THE SAME SITUATION 7.PRE-APP -R.W. BUSH - 7 .4 ACRES (3 LOTS). THE CCM-llSSION REVIEWED THE PLAT OF THE PROPERI'Y WHICH IS LOCATED BY LUNDY LANE. Sa-1E CHANGES WERE RECCT-1MENDED REGARDING THE REMOVAL OF ONE LOT LINE. THE CCM-1ISSION APPROVED THE CONCEPT WITH THE AFOREMENTIONED CHANGE. 8.PRE-APP -G.W. BLAIR -1. 7 ACRES (2 LOTS). THIS PROPER'.rY IS :u::x:ATED ON MILIS ROAD.THE CCM-llSSION REVIEWED THE PLA'l' AND AGREED WITH THE CONCEPT. 9.CONSIDERATION AND POSSIBLE ACTION REGARDING THE PROPOSED AMENDMEm' TO ORDINANCE 84-15 REGARDING TEMPORARY BATCHING FACILITIES. DISCUSSION FOLl..CWED REGARDING BATCHING FACILITIES AND SPECIFIC USE PERMITS. THE CCM-1ISSION CALLED A PUBLIC HEARING FOR DECEMBER 2,1991. 10.COMPREHENSIVE PLAN (M.W.) CCM-1ISSIONER KONCABA SAID THAT THE ECONOOIC DEVELOPMENT COMMITI'EE SAID THAT LIKED WHAT HAD BEEN PRESENTED TO THFM.
