AGENDA A REGULAR MEEI'ING OF THE FRIENDSYrnD PLANNING AND ZONING ro1MISSION 'IO WAS HEID ON THURSDAY, DOCEMBER 5, 1991, AT 7:00 P.M. IN THE CITY I-W.J., COUNCIL CHAMBERS. THE FOLLCWING MEMBERS WERE PRESENT: BAKER -CHAIRMAN FINGER FRANKOVICH THClv1PSON -CITY ENGINEER JORDAN KONCABA RODGERS VAN DYKE HENRY -DEVELOPMENT COORDINA'IOR BRINKMAN -SECRETARY WITH A QUORUM PRESENT, COLBURN ABSENT, CHAIRMAN BAKER OPENED THE MEErING OF THE PLANNING AND ZONING Ca1MISSION. CHAIRMAN BAKER STATED THAT P&Z COUID NaI' RECEIVE FURTHER COOMUNICATIONS REGARDING THE ITEMS FOR CONSIDERATION AS A RESULT OF THE PUBLIC HF.ARING ON DOCEMBER 2, 1991. HE ASKED FOR CCMMUNICATIONS FRCM THE PUBLIC REGARDING ANY ITEM WHICH DID NO'l.1 APPEAR ON THE AGENDA. A FEW QUESTIONS WERE ASKED REFERENCING PROCEDURES WHICH WERE ANSWERED BY CHAIRMAN BAKER. THE �-ULLCWING ITEMS WERE THEN CONSIDERED. A.A ZONE CLASSIFICATION CHANGE REQUEST OF CSC (CCMMUNITYSHOPPING CENTER DISTRICT) TO MFR-H (MULTIPLE FAMILYRESIDENTIAL DWELLING DISTRICT -HIGHEST) FOR 8 .1064 ACRESM)RE OR LESS OUT OF THE EMILY M. AUSTIN AND JAMES E. PERRYLEAGUE, ABSTRACT 20 AND A PORI'ION OF RESERVE B, ANNALFAWHITEHALL SUBDIVISION. CHAIRMAN BAKER INFORMED THE C<:)M,USSION OF A CONVERSATION HE HAD WITH CHIEF S'IOUT REGARDING CRIME IN APAR'IMENT PROJECI'S IN THE CITY OF FRIENDSYrnD. CHIEF STOUT HAD ADVISED BAKER THAT CRIME IN FRIENDSWOOD APAR'lMEm'S WAS LESS THAN THE SAME NUMBER OF HOUSES IN ANOI'HER PAR!' OF THE CITY. THE REASON BEING THAT MANY OF THE APARIMENT DWELLERS WERE OLDER OR RRI'IRED PERSONS, WHO CHOSE TO LIVE IN FRIENDSYrnD BUT WITHOUT THE MAINTENANCE INVOLVED IN avNING A Ha.1E. BAKER ALSO STATED THAT THE AVERAGE Hc»IB DID NaI' PAY FOR THE EDUCATION OF ONE CHIID, IF THE FIGURES PRESENTED IN THE PUBLIC HF.ARING WERE CORROC"I'i THEREFORE, AN APARIMENT DWELLER SHOUID NOT BE EXP:ocTED TO DO SO. IT WAS ALSO STATED THAT A Ha.1E IS ELIGIBLE FOR Ha.1ESTEAD EXEMPTION WHERE AN APARIMENT IS NOT. BAKER WENT ON TO SAY THAT A H�R CCMMENTED THAT THE DEVELOPER TOOK CHANCES WHEN PURCHASING A PROPERI'Y WITH A CERI'AIN ZONE CLASSIFICATION AND THAT THE PROPERI'Y MIGHT NOT SERVE THE USE OF THE DEVELOPER. THE CITIZEN STATED THAT THE PROPERTY WAS PURCHASED AS CSC (CCMMUNITY SHOPPING CENTER DISTRICT) AND SHOULD REMAIN SO. BAKER SAID THAT THE PROPERI'Y IN QUESTION WAS NOT EVEN IN THE CITY WHEN IT WAS PURCHASED l P&Z 12/5/91 Page 2 B. MUCH LESS ZONED. a.rHER ca.1MENTS FOLLCMED REGARDING DRAINAGE, PROPERI'Y MANAGEMENT, TRAFFIC AND THE ATI'ORNEY'S CONSIDERATIONS REGARDING ZONE CLASSIFICATION CHANGES. CCMMISSIONER FINGER CCM-1ENTED THAT THE ATI'ORNEY'S OPINION WAS NOi' LAW. HE ALSO STATED THAT THE APARIMENT PROJEcr WILL BE REQUIRED TO MEET THE SAME 100 YEAR FLOOD GUIDELINES AS WOULD A Ha.1E. FINGER SAID THAT GRADUAL DECLINE IN PROPERTY MANAGEMENT DOES OCCUR, THAT APARIMENTS GENERAIJ.,Y BROUGHT IN YOUNG FAMILIES, AND THAT TRAFFIC WOULD BE GREATER IN AN APARIMENT PROJEcr THAN IN A CCMMERCIAL PROJECT BECAUSE THE TRAFFIC WOUID BE CONCENTRATED IN PF.AK HOURS. CCMMISSIONER KONCABA STATED THAT THE DEVELOPER AND MANAGEMENT FIRM HAD A PROVEN TRACK RECORD IN THE CITY WHICH SPANNED AT LEAST 20 YEARS. HE ADDED THAT APAR'IMENTS DO OFFER A BUFFER BfilWEEN RESIDENTIAL AND CCM-1ERCIAL PROPERI'IES. CCMMISSIONER VAN DYKE SAID THAT HE DID NOi' SEE A NEED FOR APARTMENTS WITHIN THE CITY NOR DID APAR'IMENTS APPEAR CCMPATIBLE WITH THE AESTHETICS OF THE CITY. CCMMISSIONER JORDAN STATED THAT SHE APPROACHED ZONING FRCM THE HIGHEST AND BEST USE OF THE PROPERTY WHICH, IN HER OPINION, WAS THAT B01'H PROPERI'IES BEING CONSIDERED SHOULD R™AIN ZONED FOR Ca.1MUNITY SHOPPING CENTER DISTRicr. CCMMISSIONER RODGERS STATED THAT HE DID NOi' UNDERSTAND WHY THE CCM1ISSION WOUID REZONE A CSC ZONE TO MFR WHEN THERE WAS SEVERAL MULTIPLE FAMILY DWELLING DISTRicr SH<MN ON THE ZONING MAP. CCMMISSIONER FINGER ADDED THAT WITH REGARD TO CRIME, AN APARIMENT PROJFX:T WOULD NOi' BE UNGUARDED AT NIGHT AS WOULD A CCM1ERCIAL ZONE. CCMMISSIONER JORDAN MADE A MOl'ION THAT THE ZONE CLASSIFICATION CHANGE REQUEST FRCM CSC TO MFR-H BE DENIED. SOCOND: VAN DYKE FOR THE MOl'ION: JORDAN, VAN DYKE AND RODGERS OPPOSED THE MOl'ION: FINGER, KONCABA, BAKER MCYI'ION FAILED. A ZONE CLASSIFICATION CHANGE REQUEST OF MFR-L (MULTIPLE FAMILY RESIDENTIAL DWELLING DISTRicr - I.av) TO SFR (SINGLE FAMILY RESIDENTIAL DWELLING DISTRicr) FOR A 5. 0 ACRE TRAcr OF LAND OUT wr 25 OF VOSS SUBDIVISION, SARAH McKISSICK LEAGUE. CCMMISSIONER JORDAN EXPRESSED HER OPINION THAT THE BEST USE FOR PROPERTY IN THIS LOCATION WAS FOR SINGLE FAMILY RESIDENTIAL. CHAIRMAN BAKER ca-1MENTED THAT I.av DENSITY APARIMENTS WOUID BE A BUFFER BfilWEEN THE CSC AND SFR ZONE CLASSIFICATIONS AND SUGGESTED THAT A IOiJ DENSITY PROJEcr f 1 l ! j P&Z 12/5/91 Page 3 1. c. MIGHT BE ADVISABLE IN WHICH CASE, THE PUBLIC MIGHT BE BEST SERVED SHOULD THE ZONE CHANGE BE DENIED. DISCUSSION FOLI..CWED AND CCM-ITSSIONER FINGER MADE A MCYI'ION THAT THE ZONE CLASSIFICATION BE APPROVED. SOCOND: VAN DYKE VOTE FOR: UNANIMOUS OPPOSED: NONE MCII'ION CARRIED A ZONE CLASSIFICATION CHANGE REQUEST OF CSC (Ca-1MUNITY SHOPPING CENTER DISTRICT) TO MFR-H (MULTIPLE FAMILY RESIDENTIAL DWELLING DISTRICT -HIGHEST) FOR 5. 987 ACRES OF LAND BEING PAR!' OF LOI' 38 OF ANTOINE'rrE VOSS SUBDIVISION, SARAH McKISSICK LEAGUE. THERE WAS DISCUSSION REGARDING THE DEVELOPMENT OF CSC IN THIS PORI'ION OF TCWN AND THE CCM-ITSSION AGREED THAT THE BEST USE OF THE PROPERI'Y WAS FOR IT TO REMAIN CSC. <Xr-1MISSIONER JORDAN MADE A MCII'ION 'l'HAT ZONE CLASSIFICATION CHANGE REQUEST FRCM CSC TO MFR-H BE DENIED. SECOND: KONCABA VOTE FOR: UNANIMOUS OPPOSED: NONE MCII'ION CARRIED D.AMENDING ZONE ORDINANCE NO. 84-15, OF PARAGRAPH 7, OF SUBSECTION J OF SECTION 8, DEIEI'ING REQUIREMENTS RELATING TO IOCATION AND DURATION OF TEMPORARY BATCHING FACILITIES AS CONDITIONS OF SPECIFIC USE PERMITS, AND PROVIDING OTHER MA'ITERS RELATING TO THE SUBJECT. CITY ATI'ORNEY OLSON EXPLAINED THE NEED TO AMEND THE ZONING ORDINANCE. THERE WERE SEVERAL QUESTIONS FRCM THE AUDIENCE REGARDING BATCHING FACILITIES AND THEIR FUTURE NEED AND/OR USE. CCM-ITSSIONER FINGER MADE A MCII'ION THAT THE AMENDMENT TO THE ZONING ORDINANCE BE APPROVED. SOCOND: KONCABA VOTE FOR: UNANIMOUS OPPOSED: NONE MCYrION CARRIED. CONSIDERATION AND POSSIBLE ACTION REGARDING THE PRELIMINARY PLAT OF LEISURE ESTATES (LEISURE LANE AND WINDING WAY). <Xr-1MISSIONER FINGER INQUIRED ABOUT THE BUILDING LINE ON LOI' 4 OF THE PRELIMINARY PLAT STATING THAT IF THE BUILDING LINE WERE TO BE DRAWN STRAIGHT, THE LOI' SIZE WOULD BE UNDER THE 120' FRONI'AGE REQUIREMENT AS SET FORI'H IN THE SUBDIVISION ORDINANCE. ENGINEER THCMPSON STATED THAT THE BUILDING LINE PARALLELED THE STREET AND FELT AS THOUGH IT WERE ACCEPTABLE. BCYrH Ca-1MISSIONERS FINGER AND JORDAN AGREED THAT THE LOI' LINE SHOULD BE DRAWN STRAIGHT WHICH WOULD RENDER A SLIGHTLY SMALLER FRONTAGE THAN THAT REQUIRED. MR. GARrRELL STATED THAT HE FELT THE LINE WAS ACCEPI'ABLE BECAUSE IT PARALLELED I u P&Z 12/5/91 Page 4 2. THE STREB!'; HCWEVER, WOUID CHANGE THE EASEMENT WHICH \A.UJLD BE DEDICATED TO THE CITY IN ORDER TO OBTAIN A FULL 120 FOO!' FRONI'AGE. CCMMISSIONER JORDAN MADE A .MOTION THAT THE PLA'r BE APPROVED CONTINGENT UPON THE CHANGE IN EASEMENT SO THAT THE IJ:Jr SIZE WOUID BE 120' • SECOND: FINGER VOTE FOR: UNANIMOUS OPPOSED: NONE .MOTION CARRIED CONSIDERATION AND POSSIBLE ACTION REGARDING THE PRELIMINARY PLAT OF KEYSTONE ME'.AIJOOS II (F.M. 528@ BRIARCREEK). THIS ITEM WAS NCfI' RF.ADY AND WAS PASSED OVER. 3.PRE-APP OF 86.04 ACRES INTO 191 IJ:JrS -LAWRENCE PLACE - MUNICIPAL ENGINEERING. 4. JANIS I.CME PRESENTED THE PLAT OF LAWRENCE PLACE ADVISING THE CCMMISSION THAT THE PROPERI'Y WAS LOCATED IN '.&10 WATERSHEDS AND WOUID REQUIRE 'lWO DETENTION PONDS. SHE REVIEWED HER PLANS FOR THE SUBDIVISION AND TOLD THE CCM-1ISSION THAT SCME CHANGES WERE TO BE MADE TO THE DRAWINGS BUT ASKED IF THE CCMMISSION APPROVED OF THE OVERALL CONCEPT. THE CCMMISSION DID AGREE AND INFORMED HER THAT ANCfI'HER PRE-APP WOUID BE REQUIRED WHEN THE NEW PLANS WERE DRAWN. CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF EAGLE LAKES, SEX:'1.'ION II -WALTER P. MCX)RE.
