A SPECIAL MEETING OF THE FRIENDffi'XX>D PLANNING AND ZONING C'OMMISSION WAS HELD ON THURSDAY, JANUARY 10, AT 7:00 P.M. IN THE CITY HALL COUNCIL CHAMBERS. THE FOLLCMING MEMBERS WERE PRESENT: BAKER -CHAIRMAN COLBURN FI NGER KONCABA McHUGH RODGERS WASSON FRANKOVICH -LIAISON THCOO'SON -CITY ENGINEERHENRY -DEVELOPMEN'.I' COORDINA'IDRBRINKMAN -SECRETARY WITH A QUORUM PRESENT AND NONE ABSENT, THE FOLU:WING ITEMS WERE CONSIDERED: CHAI�.N BAKER CALIBD THE MEETING OF THE PLANNING AND ZONING COMMISSION 'IO ORDER AND ASKED FOR PUBLIC CCM1Em' REGARDING ITEMS NCYI' ON THE AGENDA. WITH NO PUBLIC C'OM'1EN'J' BARER OPENED THE PUBLIC HEARING. 1.A PUBLIC HEARING FOR THE PLANNING AND ZONING CCM-1ISSION 'ID ROCEIVEPUBLIC INPUT, BOI'H ORAL AND WRI'ITEN, REGARDING THE PROPOSED REPLATOF SECTIONS III AND IV OF WIIDERNESS TRAILS SUBDIVISION. MR. RAMSEY ADDRESSED THE ca-1MISSION ON BEHALF OF THE DEVELOPER. HE STATED THAT THE REP.LAT OF WIIDERNESS TRAIIS CONSISTED OF 205 rars COOPARED 'ID THE 211 ORIGINALLY PLANNED. RAMSEY EXPLAINED 'I'HEDRAINAGE PLAN AND MALCOIM COILINS WITH COENCO EXPLAINED PROCEDURE INVOLVED IN ARRIVING AT DRAINAGE FIGURES. THERE WERE APPROXIMATELY 30 CITIZENS IN THE AUDIENCE. A QUESTION WAS RAISED REGARDING THE VALUE OF THE HOOES PROPOSED IN THE NEW SUBDIVISION. MR. RAMSEY ANSWERED TR.AT THE HOOES WOUID SEIL FOR AN AVERAGE OF $120,000. ADDITIONAL QUESTIONS WERE RAISED REC'-.ARDING THE DEI'ENI'ION POND MAINTENANCE, RECRF.ATION PROPOSALS FOR THE DRI'ENTION POND, PARKING, ACCESS ROADS, THE PROBABILITY OF A SIGNAL LIGHT ON CASTLEWCOD, AND DRAINAGE ALONG SCHOOL PROPERTY. CHAIRMAN BAKER ASKED FOR ANY PUBLIC OPPOSITION 'ID THE PROPOSED REPLAT, EXPLAINING THAT ONCE THE HEARING WAS CLOSED THE PLANNING AND ZCNING COMMISSION COUID NO LONGER ACCEPT PUBLIC INPUT, EITHER FOR OR AGAINST THE MATTER. 'fl!EHE WAS NO PUBLIC OPPO...SITION AND CHAIRMAN BAKER CLOSED THE PUBLIC HF.ARING FOR THE PROPOSED REP.LAT OF SECTIONS III AND IV OF WIIDEHNESS TRAILS SUBDIVISION. 2.CONSIDERATION AND POSSIBLE RECOMENDATION REGARDING THE PROPOSEDREP.LAT OF SECTIONS III AND IV OF WILDERNESS T.RAILS SUBDIVISION -PUBLIC HEARING COMMISSIONER FINGER MADE A MCYI'ION THAT THE PROPOSED REP.LAT OF SECTIONS III AND IV OF WIIDERNESS TRAII.S SUBDIVISION BE ACCEPTED CONTINGENT UPON THE THE RESOLUTION OF THE SCHOOL DRAINAGE ISSUE [ 1 j l AND THE :F'INALIZATION OF THE MAINTENANCE OF THE DETENTION POND WHICH WAS BEFORE CITY COUNCIL. SECOND: KONCABA MR. RAMSEY EXPRESSED HIS CONCERN WITH THE PROPOSED RECG1MENDATION, STATING THAT THE DEVELOPER DID Na!' HAVE CONTROL OVER THE TIME FRAME REQUIRED FOR BOTH THE CITY COUNCIL AND THE SCHOOL BOARD. HE STATED THAT THE PROPOSAL FOR THE SCHOOL BOARD 'TO GIVE A DRAINAGE EASEMENT IN EXCHANGE FOR THE DEVELOPER PAYING FOR THE PROJ'ECl.1 HAD BEEN VERBALLY AGREED UPON; HCME.'VER, HE ADDED THAT SHOULD THE SCHOOL BOARD RF.JEx::'I' THE PROPOSAL, THE DEVELOPER WOULD TAKE THE EASEMENT ENTIRELY FRCM HIS PORI'ION OF THE PROPERTY. CITY ENGINEER THa.1PSON PRESENTED AN ALTERNATIVE WHICH MIGHT BE ACCEPTABLE 'TO ALL PARI'IES INVOLVED. HE STATED THAT AJ.L THE STREETS, DRAINAGE, WATER, SEWER, EI'C. IDULD HAVE 'TO BE ACCEP"l'ED BY THE CITY PRIOR 'IO ANY ACI'UAL BUIIDING OF STRUCTURES. THC1-1PSON SAID THAT THE CC1'1r-USSION COUID GIVE APPROVAL 'TO THE DEVELOPER SO THAT HE COULD BEGIN CONSTRUCTION OF STREETS BY AMENDING THE MO'l'ION 'IO READ THAT THE STREm'S, EI'C. "UULD NOT BE ACCEPTED BY THE CITY UNLESS THE MATTER OF SCHOOL DRAINAGE AND THE MATI'ER OF DETENTION POND MAINTENANCE IS RESOLVED. THE C()M,fISSION COULD AU.J:Jil THE DEVELOPER 'TO BEGIN AND STILL MAINTAIN CONTROL, AS THE TIME FRAME WAS INDEED OUT OF THE DEVELOPER'S CON.l'ROL. THE CCM-1ISSION AGREED WITH THIS PROPOSAL AND CCM-1ISSION FINGER AMENDED HIS MYI'ION 'IO SO READ. TED BOGREN EXPLAINED 'IO THE ca-1MISSION THAT THE FIVE FOCfI' RESERVE HAD BEEN WIDENED TO SIX FEET. CCM1ISSIONER McH UGH MADE A MO'l'ION THAT THE AMENDED PLAT OF SUNSET MEADCMS II BE APPROVFD. SECOND: RODGERS VOTE FOR: UNANIMOUS OPPOSED: NONE MaI'ION CARRIED. 5.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL REPLAT OFPOLLY RANCH ADDITION II -GARTRELL. MR. GARTRELL EXPLAINED THE REASON FOR THE FINAL REPLAT OF POLLY RANCH ADDITION II WAS 'IO GIVE ONE OF THE rms MORE ROAD FRONTAGE. AFTER SIGNING THE MYIARS, CHAIRMAN BAKER ISSUED 'l'HE CERTIFICATION OF APPOINIMENT 'ID COMMISSIONER FINGER AND 'ID ca.1MISSIONER KONCABA. HE STATED THAT TYPICALLY JANUARY WAS THE M<)NTH IN WHICH A NEW CHAIRMAN AND VICE CHAIRMAN WAS ELECI'ED. BAKF..R EXPLAINED BCYl'H POSITIONS AND ASKED THE CG1MISSION 'ID BE THINKING ABOUI' THOSE POSITIONS. BAKF.R STATED THAT HE HAD GONE OUT 'ID THE PROPOSED SITE FOR POLLY OAKS SUBDIVISION. HE HAD COUNTED AT LF.AST 15 TREES THAT WERE AT 15" OR MORE IN DIAMm'ER AND SOOE arHERS THAT WERE LARGE ENOUGH HE COUID NOT REACH AROUND. IN CONFERRING WITH CITY AT'IDRNEY JOHN OLSON, IT WAS POINTED our THA'J..1 THE ZONING ORDINANCE MADE REFERENCE 'ID PRESF.RVING TREES AS HIS'IDRICAL SIGNIFICANCE.
