AGENDA A SPOCIAL MEETING OF THE FRIENDSVO)D PLANNING AND·ZONING CCMMISSION WAS HELD ON MONDAY, DECEMBER 2, 1991, AT 7:00 P.M. IN THE CITY HALL COUNCIL CHAMBERS. THE FOLLCmING ME1-IBERS WERE PRESENT: BAKER -CHAIRMAN COLBURN THa-1PSON -CITY ENGINEER HENRY -DEVELOPMENT COORDINATOR BRINKMAN -SOCRETARY FINGER RODGERS VAN DYKE JORDAN WITH A QUORUM PRESENT AND CCMMISSIONER KONCABA ABSENT, CHAIRMAN BAKER CALLED THE SPOCIAL MEETING OF THE PLANNING AND ZONING C(M.USSION TO ORDER. HAVING DONE SO, CHAIRMAN BAKER OPENED THE PUBLIC HEARING WITH Ca.1MENTS REGARDING PERMITTED USES WITHIN A ca.1MUNITY SHOPPING CENTER ZONE CLASSIFICATION. BAKER EXPLAINED THAT ALL PARI'IES WOULD HAVE AN OPPORTUNITY TO VOICE THEIR OPINION AND WOULD GIVE THOSE PERSONS WHO ARE IN FAVOR OF THE ZONE CLASSIFICATION CHANGE AN OPPORTUNITY TO FIRST VOICE THEIR POSITION. THE FOLLavING ITEMS WERE CONSIDERED: A. B. A ZONE CLASSIFICATION CHANGE REQUEST OF CSC (CCM-1UNITY SHOPPING CENTER DISTRICT) TO MFR-H (MULTIPLE FAMILY RESIDENTIAL DWELLING DISTRICT -HIGHEST) FOR 8 .1064 ACRES MORE OR LESS OUT OF THE EMILY M. AUSTIN AND JAMES E. PERRY LEAGUE, ABSTRACT 20 AND A PORI'ION OF RESERVE B, ANNALEA WHITEHALL SUBDIVISION. BUCK HAUSMAN MADE A PRESENTATION REGARDING THE PROPOSED APARIMENT CCMPLEX WHICH IS TO BE NAMED "OAKS OF FRIENDSW(X)I)" AND WOUID BE MANAGED BY BANFIELD PROPERTIES. HAUSMAN INI'RODUCED HIS ARCHITECT, MR. STEINBERG, WHO PRESENTED AN ARI'IST' S RENDITION OF THE PROIOCT. MR. SCHUSKE, REPRESENTING THE FIRM MR. HAUSMAN HAD EMPLOYED TO PERFORM A TRAFFIC SURVEY, PRESENTED HIS FIGURES STATING THAT THE IMPACT ON TRAFFIC WOULD BE N<MrnAL. WITH NO CJl'HER CCMMENT IN FAVOR OF THE ZONE CLASSIFICA'l'ION CHANGE REQUEST, CHAIRMAN BAKER RECOGNIZED MR. GIDRGE VALE'ITA WHO REPRESENTED THE ANNALEA -WHITEHAIL HCMECMNER' S ASSOCIATION. MR. VALETI'A READ THE C(M,1EN'l'S REGARDING THE ZONE CLASSIFICATION CHANGE !IDJUEST AND PRESENTED A PE'I'ITION WITH 155 NAMES IN OPPOSITION. THERE WERE APPROXIMATELY 45 PERSONS IN THE AUDIENCE WHO EXPRESSED THEIR OPPOSITION BY A sm:m OF HANDS. APPROXIMATELY 15 SPOKE THEIR OPPOSITION CITING NUMEROUS REASONS; TRAFFIC, SAFE'l'Y, PROPERI'Y VALUES, THE ESTHE'I'ICS OF FRIENDSVO)D AND THE QUALITY OF LIFE. WITH NO CJl'HER Ca.1MENT, CHAIRMAN BAKER CLOSED THAT PORI'ION OF THE PUBLIC HEARING. A ZONE CLASSIFICATION CHANGE }®JUEST OF MFR-L (MULTIPLE FAMILY RESIDENTIAL DWELLING DISTRICT -La'l) TO SFR (SINGLE 1 l_j P&Z DECEMBER 2, 1991 Page 2 c. D. FAMILY RESIDENTIAL DWELLING DISTRICT) FOR A 5.0 ACRE TRACI' OF LAND OlYI' 10T 25 OF VOSS SUBDIVISION, SARAH McKISSICK LEAGUE. CHAIRMAN BAKER ASKED FOR ANYONE WHO MIGHT BE IN FAVOR OF THE ZONE CLASSIFICATION CHANGE R0;;1UEST. ONE GENI'LEMAN SPOKE IN FAVOR AND THERE WAS NO OPPOSITION TO THE CHANGE RmUEST. CHAIRMAN BAKER CLOSED THAT PORI'ION OF THE PUBLIC HEARING AND MOVED TO THE NEXT ITEM. A ZONE CLASSIFICATION CHANGE REQUEST OF CSC (ca-M.JNITY SHOPPING CENTER DISTRICT) TO MFR-H (MULTIPLE FAMILY RESIDENTIAL DWELLING DISTRICT -HIGHEST) FOR 5. 987 ACRES OF LAND BEING PAR!' OF 10T 38 OF ANTOINETI'E VOSS SUBDIVISION, SARAH McKISSICK LEAGUE. CHAIRMAN BAKER ASKED IF THE CMNER OF THE PROPERI'Y HAD REPRESENTATION TO OFFER THEIR ARGUMENT FOR THE ZONE CLASSIFICATION CHANGE. THERE WAS NO REPRESENTATIVE PRESENT, NOR WAS THERE ANYONE PRESENI' WHO WISHED TO SPF.AK IN FAVOR OF THE ZONE CHANGE. BAKER ASKED FOR PUBLIC CCM>IDNICATIONS IN OPPOSITION TO THE ZONE CLASSIFICATION CHANGE RmUEST. JEFF BRANSON SPOKE TO THE CCMMISSION REGARDING THEIR OBLIGATION TO THE CCMMUNITY AND THE MAINTENANCE THEREOF, AND REMINDED THAT BCYl'H THE PLANNING AND ZONING CCMMISSION AND THE CITY COUNCIL REPRESENTED THE CCM-ruNITY AT LARGE. BRANSON Ca.1MENTED THAT HE WAS MOVING FRCT,1 HERITAGE PARK BECAUSE OF THE CLOSE PROXIMITY OF APAR'IMENTS TO HIM AND ASKED THE C(M.11SSION TO DENY THE RmUEST BEFORE THEM. RALPH HOBRATSCHK PRESENTED A PETITION OF 93 NAMES IN OPPOSITION AND '!WO OR THREE OTHER CITIZENS SPOKE IN OPPOSITION. THERE WERE APPROXIMATELY 35 PERSONS WHO EXPRESSED OPPOSITION BY SHCM OF HANDS. WITH NO FURl'HER Ca.1MENT, CHAIRMAN BAKER CLOSED THAT PORI'ION OF THE PUBLIC HEARING. AMENDING ZONE ORDINANCE NO. 84-15, OF PARAGRAPH 7, OF SUBSECTION J OF SECTION 8 , DELETING R0;;1UIREMENI'S RELATING TO r..a:ATION AND DURATION OF TEMPORARY BATCHING FACILITIES AS CONDITIONS OF SP�IFIC USE PERMITS, AND PROVIDING OTHER MATI'ERS RELATING TO THE SUBJECT. CITY A'ITORNEY JOHN OLSON EXPLAINED THE CHANGE IN THE ORDINANCE TO THE CITIZENS IN THE AUDIENCE. SEVERAL QUESTIONS WERE DIRECTED TO OLSON AND TO THE CCMUSSION AS A WHOLE. WITH NO FURTHER CCMMENI', BAKER CLOSED THE PUBLIC HEARING.
