A REGULAR MEETING OF THE FRIENDSWCX)D PLANNING AND ZONING C<Mv1ISSION WAS HELD ON THURSDAY, FEBRUARY 6, 1992, AT 7:00 P.M. IN THE CITY HAIJ., COUNCIL CHAMBERS. THE FOLI..avING MEMBERS WERE PRESENT: BAKER -CHAIRMAN JORDAN VAN DYKE COLBURN RODGERS KONCABA THCMPSON -CITY ENGINEER HENRY -DEVELOPMENT COORDINATOR BRINKMAN -SOCRE'l'ARY WITH A QUORUM PRESENT AND FINGER ABSENT, CHAIRMAN BAKER CALLED THE .MEEI'ING TO ORDER AND ASKED FOR CCM,1UNICATIONS FRa.1 THE PUBLIC. MR. AIMONE'ITI ADDRESSED THE CCMv1ISSION REGARDING A PROPOSED SUBDIVISION THAT WAS INTRODUCED TO THE CCMv1ISSION IN NOVEMBER, 1991 BY MR. GEORGE 1-IAIJ.,. MR. AIMONE'ITI CITED SEVERAL REASONS FOR THE CCM-1ISSION TO DENY THE REQUEST FOR SUBDIVISION SUCH AS RUINING THE INI'EGRITY OF THE NEIGHBORHOOD, SAFE'rY DUE TO THE FACT THAT THREE NEW DRIVES IDULD ENTER ON WEST SPREADING OAKS, FLCX>DING, AND DEED RESTRICTIONS WHICH HE SAID PROHIBITED BUiillING IN FRONT OF THE TREE LINES. MR. AIMONE'ITI S'l'ATED 'l'HAT THE Ha-1EavNER' S �UULD LIKE TO PROTEST BY PE'l'ITION AND ASKED WHAT ROCOURSE THEY MIGHr HAVE. CHAIRMAN BAKER ADVISED MR. AIMONE'ITI THAT THE STAFF WOUID CHOCK INl'O THE DEED RESTRICTION ISSUE AND THAT THE ITEM WOULD BE POSTED ON THE AGENDA WHEN THE FINAL PLAT OOULD APPEAR BEFORE THE CCMv1ISSION. BAKER SAID THAT THE APPROPRIATE TIME FOR A PETITION TO BE FILED IDULD BE AT THAT .MEEI'ING. 1.Im""ORMAL DISCUSSION RF.,GARDING THE RELOCATION AND ZONE CLASSIFICATION OF 'IDP PRINl'ING -0' FARRELL. DAVID O'FARRELL ADDRESSED THE CCMv1ISSION RF..GARDING THE RELOCATION AND ZONE CLASSH'ICATION OF TOP PRINTING. 0 1 FARREIJJ STATED THAT 'IHE ZONING ORDINANCE REQUIRED TOP PRINTING TO BE PLACED IN AN INDUSTRIAL OR LIGHT INDUSTRIAL CLASSIFICATION BUT ARGUED THAT MR. SALLEE'S BUSINESS IDULD BE BETI'ER CLASSIFIED BY 733 UNDER BUSINESS SERVICES OF THE PERMITTED USE TABLE -FRIENDSWOJD ZONING ORDINANCE. THAT CLASSIFICATION IS MAILING, REPRODUCTION, CCMMERCIAL ART, PHOTOGRAPHY AND STENOGRAPHIC SERVICES. 0 1 FARRELL SAID THAT MOST OF THE EQUIPMENT IS CLASSIFIED AS DUPLICA'l'ORS AND ARE Nar PRINTING PRESSES. HE F'URI'HER EXPLAINED THA'I' THE FACSIMILES FOR BUSINESS CARDS, ETC. ARE CONSIDERED CCMMERCIAL ART IDRK. THE CCMvlISSION AGREED THAT BY THE DEFINITIONS PRESENTED BY DAVID O'FARRELL, THE BUSINESS SHOULD INDEED FALL UNDER THE PROPOSED CATEGORY WHICH OOULD BE PERMI'l""TED IN VARIOUS ZONES. CCM-1ISSIONER VAN DYKE MADE A Mal'ION THAT THE ACCEPTANCE OF THE DEFINITION BE RECORDED IN THE MINUTES FOR FUTURE REFERENCE. SECOND: JORDAN VOTE FOR: UNANIMOUS [ 1 11 u P&Z February 6, 1992 Page 2 OPPOSED: NONE MCYI'ION CARRIED. 2.CONSIDERATION AND POSSIBLE ACTION REGARDING THE PRELIMINARY PLAT OF THE ORCHARD LOCATED ON MELODY LANE -4 .69 ACRES INTO 12 Im'S - MUNICIPAL ENGINEERING. JOHN GARDNER PRESENTED THE PRELIMl"NARY PLAT TO THE COMMISSION STATING THAT ONE ROW OF TREES WILL BE CUT DCWN FOR DRAINAGE AND FOR RONJ.i/AY, BUT THAT ALL OTHER TREES ¾QUID BE SAVED. ENGINEER THOMPSON CCMMENTED THAT THE PRELIMINARY SHCWS WATER AND SEWER LOCATIONS, MANHOLES, DRAINAGE DETAIIS, EI'C. HE SAID THAT THE FINAL ¾QUID ADDRESS MOST OF THE DETAIL ON THE CONSTRUCTION PLANS. TIIOOPSON SAID THAT THE ONLY ISSUE UNADDRESSED WAS THAT MELODY LANE APPEARED ON THE MAJOR THOROUGHFARE PLAN AND THEREFORE THE CITY IID;JUIRED AN ADDITIONAL 10 FEET, WHICH JOHN GARDNER SAID HE ¾DULD BE ABLE TO GIVE. THE CLEAR CREEK DRAINAGE DISTRICT HAS ALREADY GIVEN THEIR FINAL APPROVAL AND CCDD WILL TAKE CWNERSHIP OF THE DETENTION POND. CCM-1ISSIONER RODGERS MADE A MCYI'ION THAT THE PRELIMINARY PLAT OF' THE ORCHARD BE APPROVED CONTINGENT UPON THE ADDITIONAL 10 FEET BffiIN DEDICATED TO THE CITY. SOCOND: JORDAN VOI'E FOR: UNANIMOUS OPPOSED: NONE .tl.!OTION CARRIED 3.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF SOUTHERN BREEZE SUBDIVISION LOCATED AT FM 518 AND E. CASTLEWCOD - 1.9661 ACRES INTO 5 Im'S -C.L. DAVIS. CHUCK DAVIS PRESENTED THE FINAL PLAT OF SOUTHERN BREEZE AND ADVISED THE COMMISSION 'l'HAT THERE WAS A 35 1 ACCESS EASEMENT ACROSS THE FRONT OF THE PROPER'l'Y. HE HAD MADE A PLAT NOl'E TO RESTRICT THE NUMBER OF DRIVES ON FM 518 AS PER THE C<M-1ISSION'S REQUIREMENT. THERE WILL BE ONLY 'IWO DRIVES ALI.DNED. ENGINEER THOOPSON SAID THAT STAFF HAD EVERYTHING !ID;JUIRED. CCMMISSIONER KONCABA MADE A MCYI'ION THAT THE FINAL PLAT OF SOUTHERN BREEZE BE APPROVED. SOCOND: VAN DYKE VOTE FOR: UNANIMOUS OPPOSED: NONE MOI'ION CARRIED 4.RATIFY AND CONFIRM THE PROPOSED ZONING MAP FOR RECCM-1ENDATION TO CITY COUNCIL. TIIE COMMISSION REVIEWED THE ZONING MAP AND ENGINEER THOMPSON CCMMEN""'l'ED ON THE CHANGES. HE SAID THAT ONCE THE MAP WAS APPROVED AND ADOPTED BY CITY COUNCIL THAT ALL COMMISSIONERS WOULD BE SUPPLIED WITH A MAP OF THEIR Oii1N. HE ALSO ADVISED THE COMMISSION THAT IT TOOK THE PI.al'TER 4 HOURS TO PI.al' A MAP. THERE WAS SCME DISCUSSION REGARDING CHURCHES. I [ l J P&Z February 6, 1992 Page 3 CQ\1MISSIONER KONCABA MADE A MOTION THAT THE ZONING MAP BE RECCMMENDED TO CITY COUNCIL FOR AOOPTION. SOCOND: VAN DYKE VOTE FOR: UNANIMOUS OPPOSED: NONE MCYI'ION CARRIED. 5.CONSIDERATION AND POSSIBLE RECQ\1MENDATION REGARDING SUBDIVISION ORDINANCE F[J'Arf.flAY STANDARDS. THERE WAS A GREAT DE.AL OF DISCUSSION REGARDING "RED FLAG" SUBDIVISIONS AND THE REQUIREMENI' FOR ROAD ACCESS AO:::ORDING TO THE SUBDIVISION ORDINANCE. DISCUSSION FOI...I..avED REGARDING ACCEPTED CITY STREETS VERSUS UNIMPROVED ROADWAY. ROGER BAKER SUGGESTED THE CQ\1MISSION CONSIDER AN AMENDMENT TO THE ORDINANCE WHEREBY A DEVELOPER COULD BUILD A SUBDIVISION WITHOUT PROVIDING CONCRETE STREEI'S, STATING THAT THE COST COULD BE PROHIBITIVE FOR DEVELOPMENT IN CERTAIN AREAS. CCMJJISSIONER VAN DYKE AGREED THAT A THIRD CLASSI FICATION MIGHT NOT BE A BAD THING FOR THE CITY AND '!'HAT A LITTLE IDRE FLEXIBILITY IN THE ORDINANCE MIGHT BE ADVANTAGEOUS TO DEVELOPMENT. CHAIRMAN BAKER SAID THAT HE WOUID NOT BE AGREEABLE TO A THIRD CATEGORY AND FELT THAT DEVELOPMENT SHOUID BE RESTRICTED TO THOSE PROPERTIES ON CITY APPROVED/AO:::EPTED STREEI'S OR THAT ARE ON CITY RIGHT-OF-WAY. HE ASKED FOR A POLL OF THE COMMISSION REGARDING THEIR DECISION TO PRESENT AN AMENDMENT TO CITY COUNCIL FOR THE PURPOSE OF PROVIDING A THIRD CATEGORY FOR SUBDIVISION. VOTE FOR THE AMENDMENT: VAN DYKE OPPOSED: BAKER, RODGERS, JORDAN, KONCABA, AND COLBURN 6.MINUTES FOR APPROVAL:OCTOBER 3, 1991; JANUARY 14, 1992; JANUARY 16, 1992. ALL MINUTES APPROVED AS READ. ���
