A REX:;ULAR MEETING OF THE FRIENDSWOOD PLANNING AND ZONING CCM-1ISSION WAS HELD ON THURSDAY, APRIL 2, 1992, AT 7: 00 P .M. IN THE CITY HAU, COUNCIL CHAMBERS • THE FOLLCWrNG MEMBERS WERE PRESENT:

WITH A QUORUM PRESENT AND WITH COLBURN AND RODGERS ABSENT, CHAIRMAN BAKER CALLED THE MEEI'ING OF THE PLANNING AND ZONING CCM,1ISSION TO ORDER TO CONSIDER THE FOLLCWrNG ITEMS:
1.PUBLIC HEARING:
A PUBLIC HEARING FOR THE PLANNING AND ZONING CCM,1ISSION TORECEIVE PUBLIC INPUT, BCfI'H ORAL AND WRI'ITEN, REGARDING THEPROPOSED REPLAT OF wr 34 OF POIJ..Y RANCH SUBDIVISION.
PAIGE HEBERI' ADVISED THE CCM-1ISSION OF HER INTENT TO SUBDIVIDE THEPROPERl'Y. BARBARA GERLACH ADDRESSED THE CCM,1ISSION ON BEHALF OFTHE POIJ..Y RANCH Hc:MEX:mNERS ASSOCIATION EXPRESSING THEIR OPPOSITIONTO THE SUBDIVISION ON THE BASIS THAT IT VIOLATED THEIR DEEDRESTRICTIONS. THERE WERE APPROXIMATELY 30 H�RS PRESENT ATTHE HEARING AND THE MAJORITY SPOKE IN OPPOSITION TO THE PROPOSEDSUBDIVISION. CHAIRMAN BAKER CLOSED THE PUBLIC HEARING.
CHAIRMAN BAKER ASKED FOR C(M,1(JNICATIONS FRCM THE PUBLIC REGARDING ITEMS WHICH DID NOT APPEAR ON THE AGENDA. BUD GOZA ADDRESSED THE CCM,1ISSION ABOUT 9. 5 ACRES OF LAND OFF OF FM 528 WHICH HE WOUID LIKE TO SUBDIVIDE. THERE IS AN EXISTING HCME WITH 3. 5 ACRES OF LAND WHICH HE IDUI.D REI'AIN. SHOUID THE CCMMISSION AU.J:JiJ SUBDIVISION OF THE PROPERl'Y, THE STREET TO THE SUBDIVISION WOULD BE OFF OF GREENBRIAR. THE CCM,1ISSION HAD NO OBJECI'ION TO THE PROPOSAL.

CCM-1ISSIONER FINGER MADE A MCfl'ION THAT HIS ITEM BE TABLED IN ORDERTHAT ENGINEER '.rHCMPSON COULD GEI' A LEGAL OPINION FRCM JOHN OLSONREGARDING THE SUBDIVISION.SECOND: KONCABAVOTE FOR: UNANIMOUSOPPOSED: NONE Mal'ION CARRIED

MR. RUCKER PRESENTED THE PLAT, INDICATING THAT A VERY SMALL
PORI'ION WOULD BE IN THE FRIENDSWOOD CITY LIMIT S. ENGINEER
THC11PSON SAID THAT THE PLAT OOES MEET ALL OF STAFF'S REQUIREMENTS.
CCM-1ISSION FINGER MADE A MOTION THAT THE PRELIMINARY PLAT OF
BRIARWCX)D ESTATES BE APPROVED.

4.PRE APP -SITE PLAN -FOOD LION 'IO BE LOCATED AT FM 2351 ANDBLACKHAWK.
SCCII'I' McCREARY, REPRESENTATIVE FOR FOOD LION AND MIKE CLARK, CIVIL
ENGINEER PRESENTED THE PROPOSED PLAN FOR FOOD LION GROCERY STORE.
MR. McCREARY EXPLAINED THAT THE STORE WAS ORIGINALLY CALLED WINN
DIXIE. FOOD LION REPRESENTATIVES WERE GOING TO CONI'ACT THE STATE
HIGHWAY DEPARIMENT TO SEE IF THE STATE IDULD AI..J.J:JiJ A MEDIAN cur ON
FM 2351. DRAINAGE 'WOULD BE TO A LARGE INLET AND BOX CULVER!' ON FM
2351 AND A SMALL PORI'ION OOUlD BE RETAINED ON THE SITE. THIS
PROJECT WILL GO BEFORE THE HARRIS COUNI'RY DRAINAGE CONTROL
DISTRICT FOR THEIR APPROVAL AS WELL AS THROUGH CITY STAFF.
McCREARY SAID THAT FOOD LION IDULD LIKE TO PRESENT THEIR
PRELIMINARY PLAT ON APRIL 16, 1992. THE CCM-1ISSION AGREED WITH
THE CONCEPT.
5.CONSIDERATION OF THE PROPOSED TUI'ORING SERVICE TO BE LOCATED
WITHIN AN OBD (ORIGINAL BUSINESS DISTRICT) AT 412 S. FRIENDSWOOD
DRIVE -ESTLINBAUM.
MR. FOO ADVISED THE CCM-1ISSION THAT HIS WIFE IDULD LIKE TO OPEN A
BUSINESS ON THE SITE. THE PURPOSE WOUID BE TO TRAIN CHILDREN ON
THE CC11PITTER EMPLOYING DIFFERENT SOFIWARES THAT ARE USED IN THE
MARKET PLACE. THIS 'WOULD BE A SUM-1:ER PROGRAM OR FOR AFTER SCHOOL
EDUCATION. THE PROPERI'Y IS ZONED OBD (ORIGINAL BUSINESS DISTRICT)
AND MR. FOO ASKED FOR A RULING ON IF THE BUSINESS 'WOULD BE
PERMITTED IN THAT ZONE CLASSIFICATION.
CCM-1ISSIONER FINGER MADE A MOTION THAT THE BUSINESS BE ACCEPTED
UNDER ITEM 729 -MISCELLANEOUS PERSONAL SERVICES.

OPPOSED: NONE MOI'ION CARRIED
6.DISCUSSION REGARDING SIDEWALKS IN THE PARK PLACE SUBDIVISION
LOCATED ON CEDARWCX)D -BURKE.
TCM BURKE APPROACHED THE CCMMISSION REGARDING A SIDEWALK WHICH THE
CITY REX)UIRED ON HIS PROPERI'Y IN THE PARK PLACE SUBDIVISION. THE
LOI' IS AT THE CORNER OF CEDARWCX)D AND WEST CASTLEWCOD BY THE CITY
POOL. HE ASKED THAT HE NOI' BE REQUIRED TO PUT A SIDEWALK ON HIS
SIDE YARD DUE TO THE EXPENSE INVOLVED. BURKE SAID THAT THE ONLY
TIME A SIDEWALK WOULD BE NECESSARY ON CEDARWCX)D IS WHEN THERE WAS
A SWIM MEET, IN WHICH CASE, PIDPLE 'WOULD PROBABLY WALK IN THE
STREEI' ANYWAY. HE STATED THAT A SIDEWALK WAS CONSTRUCTED ALONG
WEST CASTLEWCOD IN THE FRONT YARD.

CCMMISSIONER VAN DYKE MADE A MOTION THAT THE PROPERI'Y BE ACCEPTED
WITHOUT A SIDEWALK ON THE SIDE PROPERI'Y LINE. STATING THAT THE
SIDEWALK IN THE FRONT Mm' THE INTENT OF THE PLAT NOI'E.

7.CONSIDERATION AND POSSIBLE REXXM-1ENDATION REGARDING A PROPOSED
.AMENDMENT TO THE SUBDIVISION ORDINANCE TO INCLUDE THE FOI.J...CMING:
a.Maintenance of Mediansb.Street Lights
Carmissioner Koncaba agreed to prepare guidelines for the Carmission to consider regarding street lights. The City has developed a policy regarding the maintenance of medians which will be presented to City Council on April 6, 1,.9;92 for adoption •
