A REGULAR MEE:l'ING OF THE FRIENDSv.UOD PLANNING AND ZONING CCMMISSION WAS HELD ON THURSDAY, MAY 21, 1992, AT 7: 00 P .M. IN THE CITY HAU., COUNCIL CHAMBERS. THE FOLLCWING MEMBERS WERE PRESENT: BAKER -CHAIRMAN COLBURN FINGER JORDAN HARRIS VAN DYKE THCW'SON -CITY ENGINEER HENRY -DEVELOPMENT COORDINATOR BRINKMAN -S:OCREl'ARY WITH A QUORUM PRESENT, KONCABA ABSENT, CHAIRMAN BAKER CALLED THE MEETING OF THE PLANNING AND ZONING CCM1ISSION TO ORDER AND OPENED THE PUBLIC HEARING. A PUBLIC HEARING FOR THE PLANNING AND ZONING CCM1ISSION TO RECEIVE PUBLIC INPUT, BCfI'H ORAL AND WRITTEN, REGARDING THE PROPOSED REPIAT OF wr 1 OF POLLY RANCH SUBDIVISION. MS. DUNN ADDRESSED THE CCM1ISSION REGARDING THE SUBDIVISION OF HER PROPERTY. THERE WERE APPROXIMATELY 30 PERSONS IN THE AUDIENCE WHO WERE IN OPPOSITION TO THE PROPOSED SUBDIVISION. BARBARA GERLACH PRESENTED THE CCMMISSION WITH SEVERAL PETITIONS AGAINST THE PROPOSED SUBDIVISION, SIGNED BY H(1,1E(MNERS IN THE POLLY RANCH SUBDIVISION. THEY STATED THAT IT WAS AGAINST THEIR DEED RESTRICTIONS AND THE INTENT OF THE DEVELOPER OF POLLY RANCH, TO ALl.J:JiJ REPIA'ITING OF AN EXISTING wr. MS. DUNN STATED THAT WHEN HER wr WAS SUBDIVIDED, IT WOULD STILL BE LARGER THAN 75 OF THE wrs IN THE SUBDIVISION AND THA'r IT WOULD BE A FINANCIAL BURDEN 'ID HER 'ID ALl.f:JiJ IT TO REMAIN AS ONE LARGE wr. CHAIRMAN BAKER ADVISED THE AUDIENCE THAT THE CITY COULD Nar ENFORCE DEED RESTRICTIONS AND THAT THEY WOULD CONFER WITH THE CITY AT'IDRNEY REGARDING THIS MATTER. WITH NO FURI'HER CQ\1MENT, HE CLOSED THE PUBLIC HEARING. CHAIRMAN BAKER ASKED FOR CCMMUNICATIONS FRCM THE PUBLIC FOR ITEMS WHICH DID Nar APPEAR ON THE AGENDA. WITH NO PUBLIC CCM,1EN'I' THE CCM1ISSION CONSIDERED THE FOLLCWING: 1.CONSIDERATION AND POSSIBLE REC0.'1MENDATION REGARDING THE PROPOSED REPIAT OF IJJr 1 OF POLLY RANCH SUBDIVISION. THE C(M,tISSION DISCUSSED THE PUBLIC HEARING AND THE MATTER OF DEED RESTRICTIONS AND THEIR ENFORCEMENT. CCM-1ISSIONER HARRIS EXPRESSED HER CONCERNS REGARDING DEED RESTRICTIONS STATING THAT WHILE SHE UNDERSTOOD THE CITY COULD Nar ENFORCE THEM, SHE FELT THE ca-1MISSION SHOULD Nor BE A PARI'Y TO BREAKING THEM EITHER. ca-1MISSIONER VAN DYKE SAID THAT SHOULD THE C(M,tISSION AGREE 'ID ALl.iliJ THE SUBDIVISION, THE H�R' S ASSOCIATION WOULD STILL I l P&Z May 21 1992 Page 2 HAVE TO GIVE APPROVAL OF THE SUBDIVISION. CHAIRMAN BAKER RExn.1MENDED THAT THE CCM1ISSION CONSIDER CONSULTING THE A'I'IDRNEY. CCMMISSIONER FINGER AGREED AND MADE A MOI'ION THAT THE MATTER BE REFERRED TO THE CITY A'I'.IDRNEY. S:OCOND: COLBURN VOl'E FOR: BAKER, COLBURN, FINGER, HARRIS, VAN DYKE OPPOSED: JORDAN MOI'ION CARRIED 2.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF WINDSOR ESTA'IES. THIS ITEM WAS NOI' READY AND WAS PASSED OVER BY THE CCMMISSION. 3.CONSIDERATION AND POSSIBLE ACTION REGARDING THE PRELIMINARY PLAT POIJ,Y OAKS SUBDIVISION. 4.CONSIDERATION AND POSSIBLE ACTION REGARDING THE PRELIMINARY PLAT OF POIJ,Y OAKS ADDITION #1. THE TI\U SUBDIVISIONS WERE CCMBINED DUE TO THE REQUEST OF THE CITY ENGINEER IN ORDER TO SIMPLIFY THE MATI'ER. GARI'RELL STATED THAT THE PROPERl'Y HAD RECEIVED APPROVAL PREVIOUSLY, BUI' DUE TO THE TIME THAT IT TOOK TO ARRANGE FINANCING, PRELIMINARY APPROVAL TIME HAD RUN OUT. ACCORDING TO THE ORDINANCE OF THE CITY OF FRIENDSYKX>D, THEY HAD SIX MONTHS IN WHICH TO PROCEED. THAT TIME NOW GONE, AND WITH NO CHANGES SINCE THE LAST PRELIMINARY APPROVAL, GARI'REIJ, ASKED THAT THE CCMMISSION AGAIN GRAN!' APPROVAL TO THE PLAT. THE CCMMISSION REVIEWED THE PLAT AND CCMMISSIONER FINGER MADE A MOI'ION THAT THE PRELIMINARY PLAT OF POIJ,Y OAKS SUBDIVISION BE APPROVED. SECOND: VAN DYKE VOl'E FOR: UNANIMOUS OPPOSED: NONE MOI'ION CARRIED 5.CONSIDERATION AND POSSIBLE ACTION REGARDING THE FINAL PLAT OF RA-MAR R& -RESUBDIVISION OF 4. 489 ACRES -A PAR!'
