WITH A QUORUM PRESENT, KONCABA ABSENT, CHAIRMAN BAKER OPENED THE IX)CKEl'E[) JOINT PUBLIC HEARING TO ROCEIVE INPur, BC/I'H ORAL AND WRITI'EN, REG ARDING A ZONE CLASSIFICATION CHANGE REQUEST OF MULTI-FAMILY RESIDENTIAL MEDIUM DENSITY (MFR-M) TO SINGLE FAMILY RESIDENTIAL (SFR) FOR 10.35 ACRES OF LAND, MORE OR LESS, BEING RESERVE E, POIJ,Y RANCH ESTATES, GALVESTON COUNTY, TEXAS, MORE PARI'ICULARLY DESCRIBED AS BEING 10CATED AT THE WEST END OF OAK DRIVE.
MR. GARl'RELL EXPLAINED THE PURPOSE OF THE ZONE CLASSIFICATION CHANGE REQUEST. MAYOR NE.W-1AN ASKED WHERE THE PROPERTY WAS 10CATED IN RELATION 'IO THE FLOODWAY. GARTRELL EXPLAINED THAT THERE WOULD BE THREE HOUSES, NONE OF WHICH OOULD BE 10CATED IN THE FLOODWAY; Ha-IBVER, HE SAID THAT THEY OOULD BE LOCATED IN THE 100 YF.AR FLCX)I) PLANE.
THERE WAS NO OPPOSITION TO THE ZONE CLASSIFICATION CHANGE REQUEST AND CHAIRMAN BAKER CLOSED THE PUBLIC HEARING, CAIJ,ING FOR COOMUNICATIONS FRQ\1 THE PUBLIC. MRS. BRENNAN FRQ\1 PILGRIM'S POINT SUBDIVISION ADVISED THE CCMMISSION OF THEIR RESPONSIBILITIES REGARDING PRa.I'ECTION OF THE PUBLIC FRCM UNDESIRABLE BUSINESSES. WITH NO FUR1'HER CCM1ENT, THE FOLLCM:NG ITEMS WERE CONSIDERED:

2.CONSIDERATION AND POSSIBLE ACTION REGARDING THE PRELIMINARY PLATOF THE OAKS OF BRIARCREEK - 8 LOrS.
THIS ITEM WAS NOT READY AND WAS PASSED OVER BY THE CCM-1ISSION.

CCMMISSIONER JORDAN QUESTIONED THE SHEET FIJ:Jil RATIO, SHOULD THERE

THCMPSON SAID THE DIFFERENCE w:xJLD BE NEGLIGIBLE.
CCM-1ISSIONER VAN DYKE MADE A IDI'ION THAT THE FINAL PLAT OF
WINOCREEK ADDITION BE APPROVED.

THE CCM-1ISSION REVIEWED THE PLAT AND CCM-1ISSIONER FINGER MADE A
MCYI'ION THAT THE FINAL PLAT OF EAGLE LAKES III BE APPROVED.
SECOND: HARRIS

OPPOSED: NONE MOTION CARRIED
5.ZONE CLASSIFICATION CHANGE RmUEST OF OBD (ORIGINAL BUSINESS
DISTRICT) TO SP -B&B (SPECIFIC USE -BED AND BREAKFAST).
THE CCM-1ISSION CALLED A PUBLIC HF.ARING FOR NOVEMBER 2, 1992.
6.CONSIDERATION AND POSSIBLE RECCMMENDATION REGARDING THE ZONE
CLASSIFICATION CHANGE REQUEST OF CSC (CCMMUNITY SHOPPING CENTER
DISTRICT) TO SPECIFIC USE-MINI GOLF FOR 1. 040 ACRES OUT OF THE
J.R. WILLIAMS LEAGUE I.0'2ATED AT 1410 E. WINDING WAY.
ENGINEER THCMPSON ADVISED THE ca-1MISSION THAT THE STANDARD
INDUSTRIAL CLASSIFICATION MANUAL WAS THE DOCUMENT FRa-1 WHICH
THE PERMITTED USE TABLE OF THE CITY'S ZONING ORDINANCE, WAS
DERIVED. ACCORDING TO THIS DOCUMENT, MINI GOLF CAME UNDER A
CLASSIFICATION OF 7999 -AMUSEMENTS AND SERVICES NOT ELSEWHERE
CLASSIFIED. UNDER THIS CLASSIFICATION, A SPECIFIC USE PERMIT
v.DULD BE REQUIRED. HE STATED THAT THERE WAS Sa.1E CONCERN AS TO
WHEl'HER OR NOT THE PROPERI'Y 1®;2UIRED A SPECIFIC USE PERMIT AND
THIS REITERATED THAT PLANNING AND ZONING' S INTERPRETATION WAS
CORRECT. THCMPSON FURl'HER , EXPLAINED THAT THIS DOCUMENT WAS
DEVELOPED BY THE FEDERAL GOVERNMENI' FOR USE AS A GUIDELINE BY
MUNICIPAL GOVERNMENT.
CCMMISSIONER JORDAN EXPRESSED HER CONCERN ABOUT THE CMNER' S LACK
OF I<NCMLEDGE REGARDING THE RmUIRED PATRONAGE FOR A PROFITABLE
BUSINESS AND ALSO IN THE NUMBER OF PARKING SPACES SHCWN ON THE
SITE PLAN. CCM>ITSSIONER DICKSON SAID THAT HE FELT IT IDULD BE
DIFFICULT FOR THE OWNER TO MEET ALL OF THE REQUIREMENTS OF
SPECIFIC USE. Ca.1MISSIONER HARRIS STATED THAT NARROW WIDTH OF
WINDING WAY WAS OF CONCERN TO HER. CHAIRMAN BAKER REMINDED THE
ca-1MISSION THAT THE PROPERI'Y WAS ZONED CSC PRIOR TO THE
CONSTRUCTION OF ANY RESIDENTIAL PROPERI'IES AND ASKED THE CWNER' S

REPRESENTATIVE IF THEY HAD RESEARCHED OBTAINING ACCESS TO FM 518. THE ONNER STATED THAT IT WOULD BE COST PROHIBITIVE TO OBTAIN ACCESS FRCM FM 518.
CCM,1ISSIONER FINGER STATED THAT HE REALIZED THAT THE PROPERTY WAS ZONED FOR CCNMERCIAL USE PRIOR TO THE PURCHASING OF Ha.1ES IN PILGRIM'S POINT SUBDIVISION AND WOULD GIVE CONSIDERATION IF THE PROPOSED USE FIT INl'O THE GUIDELINES OF THE ZONE CLASSIFICATION; HCMEVER, MINI GOLF WAS NCYr A PERMITTED USE WITHIN A CSC ZONE CLASSIFICATION.
CCM,1ISSIONER JORDAN MADE A MOTION THAT THE PLANNING AND ZONING ca1MISSION ROCCNMEND TO CITY COUNCIL THAT THE ZONE CLASSIFICATION CHANGE REQUEST BE DENIED. SOCOND: HARRIS VCYrE FOR: JORDAN, HARRIS, DICKSON, FINGER OPPOSED: VAN DYKE, BAKER MarION CARRIED.
7.ZONE CLASSIFICATION CHANGE REQUEST OF SFR (SINGLE FAMILYRESIDENTIAL) TO CSC (Ca-1MUNITY SHOPPING CENTER DISTRICT) FOR2.6045 ACRES OF LAND AND FOR 0.3857 ACRES OF LAND (TOTAL OF 2.9902ACRES OF LAND) LOCATED ON FM 2351.
