IN THE CITY HALL COUNCIL CHAMBERS LOCATED AT 910 S. FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS. THE FOLLOWING MEMBERS WERE PRESENT: BAKER -CHAIRMAN WHITTENBURG GRACE HENRY -DEVELOPMENT COORDINATOR HOOVER -CITY PLANNER BRINKMAN -SECRETARY CLARK STEWART-CITY ATTORNEY BURKE OLSON -CITY ATTORNEY CRESS DICKEY -COUNCI L LIAISON (arrived at 8:50 pm) WITH A QUORUM PRESENT, FINGER ABSENT, CHAIRMAN BAKER OPENED THE MEETING TO CONSIDER THE FOLLOWING ITEMS: 1.ZONE CLASSIFICATION CHANGE REQUEST OF NEIGHBORHOODCOMMERCIAL (NC) TO COMMUNITY SHOPPING CENTER (CSC) FOR6.75 ACRES OF LAND LOCATED ON THE NE CORNER OF FM 528 ANDSUNSET.COMMISSIONER WHITTENBURG MADE A MOTION TO RECOMMENDTO CITY COUNCIL THAT THE ZONE CLASSIFICATION CHANGE REQUESTBE APPROVED.SECOND: CRESSVOTEFOR: UNANIMOUSOPPOSED: NONE MOTION CARRIED2.ZONE CLASSIFICATION CHANGE REQUEST OF SINGLE FAMILYRESIDENTIAL (SFR) TO NEIGHBORHOOD COMMERCIAL (NC) FOR 3.86ACRES OF LAND LOCATED AT 2001 FM 518, EAST OF INTERSECTIONOF EAGLE LAKES BOULEY ARD AND FM 528.3. COMMISSIONER CRESS MADE A MOTION TO RECOMMEND TO CITYCOUNCIL THAT THE ZONE CLASSIFICATION CHANGE REQUEST BE DENIED.SECOND: WHITTENBURGVOTEFOR: UNANIMOUSOPPOSED: NONE MOTION CARRIEDORIENTATION OF THE PLANNING & ZONING COMMISSIONTODD STEWART, ATTORNEY FOR THE CITY OF FRIENDSWOOD, GAVE THE

COMMISSION TWO HANDOUTS WHICH HE SAID WOULD GIVE THEM A
"THUMBNAIL" SKETCH OF PLATS, REPLAT, AND LIMITATIONS OF WHAT A CITY
CAN REQUIRE ON PLATS. HE STATED THAT A MEETING NOTICE MUST BE POSTED
72 HOURS IN ADVANCE OF THE MEETING.
STEWART FURTHER EXPLAINED THE DUTIES OF THE COMMISSION STATING
THAT THEY ARE REALLY TWO BODIES, THE PLANNING BODY AND A ZONING
BODY. HE FURTHER ADVISED THAT THE BOA IS YET ANOTHER BODY WHICH IS
INVOLVED IN THE PROCESS OF PLANNING AND ZONING.
THE ZONING BODY HAS NO AUTHORITY IN THE ULTIMATE DECISION OF A
ZONING ISSUE. THE ZONING BODY ONLY MAKES RECOMMENDATIONS TO THOSE
WHO ARE THE ULTIMATE DECISION MAKERS, THE CITY COUNCIL.
AS A PLANNING BODY, HOWEVER, THE ULTIMATE AUTHORITY IS THE PLANNING
COMMISSION. PLATS ARE REVIEWED BY THE PLANNING COMMISSION IN
ACCORDANCE TO THE SUBDIVISION ORDINANCE OF THE CITY.
A PLAT MUST BE APPROVED WHEN THE MINIMUM REQUIREMENTS OF THE
ORDINANCE ARE MET. A PLAT CANNOT BE DELAYED BECAUSE "YOU DO NOT
LIKE IT". IF WITHIN 30 DAYS AFTER THE MINIMUM REQUIREMENTS HA VE BEEN
MET AND NO DECISION HAS BEEN MADE, A PLAT WILL BE DEEMED AS HA YING
BEEN APPROVED. A RIGHT OF REFUSAL CAN ONLY BE MADE IF THE PLAT
CONFLICTS WITH AN ADOPTED MASTER PLAN, SUCH AS MAJOR THOROUGHFARE
PLAN, A COMPREHENSIVE PLAN, AN ENTRYWAY/OVERLAY PLAN, ETC. THE
STANDARDS, AS SET FORTH IN THESE PLANS, WERE ADDRESSED BY CITY
COUNCIL WHEN THEY WERE ADOPTED.
COMMERCIAL SITE PLAN ARE A ZONING ISSUE AND REQUIRE APPROVAL OF THE
CITY COUNCIL.
STEWART REVIEWED THE RULES OF PROCEDURE WHICH INVOLVED SUSPENSION
OF RULES, VOTING, CALLING A QUESTION, AND MISCELLANEOUS OTHERS. THE
RULES OF ETHICS WERE REVIEWED AS WAS THE PROCEDURE FOR ABSTENTIONS
DUE TO CONFLICTS OF INTEREST.
CITY ATTORNEY OLSON REVIEWED THE PLANNED UNIT DEVELOPMENT
DISTRICT (PUD) EXPLAINING TO THE COMMISSION THAT STRINGENT
REQUIREMENTS COULD BE MADE IN THIS ZONE CLASSIFICATION DUE TO THE
FACT THAT ALL USES REQUIRE A SPECIFIC USE PERMIT. HE STATED THAT
LANDSCAPING, SCREENING, PARKING, AND ADDITIONAL REQUIREMENTS BY
THE COMMISSION, COULD BE ENFORCED. IT WAS FURTHER EXPLAINED THAT
ONCE A USE CEASED TO EXIST WITHIN A SPECIFIC USE PERMITTED AREA, THE
NEW USE WOULD REQUIRE A SPECIFIC USE PERMIT. THIS PROCESS REQUIRES A
PUBLIC HEARING AND SITE PLAN APPROVAL.

STEW ART STATED THAT THE URBAN PLANNING GUIDE (LARGE BLUE BOOK) WAS
AN EXCELLENT TOOL FOR THE COMMISSION. CITY PLANNER HOOVER GA VE THE
THREE NEW COMMISSIONER'S THEIR BOOKS.
CITY PLANNER HOOVER REVIEWED THE STAFF PROCEDURES FOR PRE-APPS,
PRELIMINARY PLATS, FINAL PLATS, AND SITE PLANS. CHAIRMAN CRESS STATED
THAT CONTINGENCIES CAN BE MADE BY THE COMMISSION ONLY ON THE
PRELIMINARY ST AGE OF DEVELOPMENT. AT FINAL, REQUIREMENTS MUST BE
MET, THERE CAN BE NO CONTINGENCIES.
BEFORE THE COMMISSION RECEIVES THE FINAL PLAT, IT HAS BEEN REVIEWED
AND APPROVED BY THE FIRE MARSHAL, POLICE DEPARTMENT, DRAINAGE
DISTRICT, PUBLIC WORKS FOR WATER & SEWER, THE CITY ENGINEER, CITY
PLANNER, AND DEVELOPMENT COORDINATOR. IN ADDITION, THE STAFF HAS
ACQUIRED COPIES OF TXDOT PERMITS, TITLE REPORTS, OIL COMP ANY LETTERS,
PLAT SIGNATURES, ETC.
THE STATUS OF THE COMPREHENSIVE PLAN WAS DISCUSSED AS WELL AS
LIABILITIES INCURRED BY THE COMMISSION.
