OF THE
FRIENDSWOOD PLANNING & ZONING COMMISSION
February 1, 1996
A Regular meeting of the Friendswood Planning and Zoning Commission was held on February 1,
1996 at 7:00 p.m. in the City Hall Council Chambers located at 910 S. Friendswood Drive,
Friendswood, Texas with the following members in attendance:

With a quorum present, and with Finger and Grace absent, Chairman Baker the following business
was transacted:
DOCKETED JOINT PUBLIC HEARING:
1.A zone classification change request from Original Business District (OBD) to Single
Family Residential (SFR) for 1.0537 acre tract out of Lot 12, Block 3 Friendswood
Addition, Galveston County, Texas.
This property is located at Castlewood and Cedarwood, behind the green office building
belonging to Dr. Groba. Two people spoke in favor of the zone change request; none spoke in
opposition.
2.Request for a Specific Use Permit for property located at Melody and FM 2351, Lots
2 (0.4345 acres) and 3 (0.4360 acres), Block 1, Melody Plaza Subdivision, Galveston,
County, Texas.
David O'Farrell presented the proposed elevation of the building, the landscaping plan, and a
list of proposed uses which will become a part of the specific use permit. The building will be
red brick and have a residential styled composition shingle roof. O'Farrell stated that the
signage will be 30% less than that allowed by the Sign Ordinance and that the proposed
landscaping exceeds the requirements of the Zoning Ordinance by 15%. He commented that
there will be 1 O' of landscaping to comply with the Entryway/Overlay Ordinance and a sidewalk
in the right of way, both on FM 2351 and on Melodywood.
Bill Lango, president of the Imperial Estates Homeowners Association, stated that the local
residents were pleased with the elevation of the building, but expressed concern with some of
the proposed uses, (ie) restaurant, drug store, and computer electronics. Two citizens spoke
in agreement with Mr. Lange's statement regarding the uses. Mayor Newman read a letter
into the minutes from an adjacent landowner who also concurred with Mr. Lange's comments.
Questions arose regarding the use of a list for the Specific Use Permit and several Council
Members and Commissioners expressed concern for the permitted uses, including
restaurants, day cares and kindergartens, and veterinary services.

Recommendation -080 To SFR 1.0537 acres out of Lot 12, Block 3, Friendswood Subdivision
The arrangement of lots has changed since the pre-app. All three lots will front Cedarwood,
making the lots approximately 153' in depth. This will not create a non-conforming lot.
MOTION: Whittenburg to recommend to City Council that the zone classification change
request be approved.
Second: Clark
Vote: Unanimous FOR MOTION CARRIED
Recommendation -Request of a Specific Use Permit for Lots 2 & 3 , Block 1, Melody Plaza
Subdivision.
MOTION: Whittenburg made a motion, for purpose of discussion, to recommend the
specific use permit be granted.
Second: Burke
After much discussion regarding the permitted use list , the list was trimmed to 18 uses
with a note that retail space cannot exceed more than 30% of the gross square footage
of the building. Sidewalks and the dumpster were located on the site plan. The
commission deliberated on tabling this item for further discussion; however, Mr. Lango
stated the citizens were anxious to have a conclusion. Lango stated he would circulate
a list of agreed permitted uses, but would be very surprised if there were any objections.
Whittenburg withdrew his original motion; Burke his second.
MOTION: Whittenburg made a motion to recommend the specific use permit be granted
based upon the amended document of proposed uses and changes to the site
plan regarding the dumpster site.
Second: Clark
Vote: Unanimous FOR MOTION CARRIED

COMMUNICATIONS
1.Staff
City Engineer Kneupper advised the commission that Friendswood Texaco, recently
approved by the commission and which is under construction, desired to build 100' of
roadway in the 40' of dedicated right-of-way. This would be an extension of Hope Village

Road. Their desire is to build only 1/2 of the boulevard or 24', and stripe it into 2 lanes.
According to Subdivision Ordinance, P&Z would have to grant approval for the
construction of a partial road. TxDot will have to do some modification regarding the traffic
signal at that intersection. The Commission agreed to the roadway provided it was built
to City Specification and approved by the City Engineer.
Commissioners
Commissioner Cress stated that the policy of the commIssIon had been that
recommendation would not be made on the same night as the Public Hearing. City
Planner Hoover advised the commission that the zoning process was taking approximately
12 weeks due to meeting deadlines, and the developer would not be complete until late
March. He stated that he had placed the items on the agenda to expedite the process for
the developer. Due to Council deadlines, this item could not be considered by Council until
February 19, 1996. The deadline for the February 5th Council meeting was January 30th.
This item will be placed on the next agenda for business.

Dear. Ms. McKenzie:
I received the notice from the City a Friendswood regarding a public hearing on February I, 1996 for a
Specific Use Perm.it at Lot 2 and Lot 3 Block 1 Melody Plaza Subdivision, owned by O'Farrell Anderson
Interest, Inc.
Unfortunately, we will be out of town on this day and will not be able to attend the hearing. Howc\'er. as
the owner of the adjacent property (Lot 1) for which a combined interior design studio/residence has
already been approved by City Council, I would like to voice my comments in writing to be presented at
the hearing.
David O'Farrell has provided me wiUt the proposed elevation (attached) and with regard to the structure,
assuming adequate landscaping and parking is provided, we feel comfort�ble with the proposal. If the
proposed parking layout, however, directs traffic to the rear, we feel a fence should be constrncted along
the northern property line since commercial traffic will be directed toward our property.
·With regard to the proposed specific use permit, we are comfortable with the space being used for light
retail/office/professional (e.g. jewelry, quilt store, dentist, etc.) but are opposed to the addition of a food
service business (e.g. restaurant). This is because we feel that the product and refuse generated by this
type of business will result in increased incidence of odors and rodents as well as increased risk of fire.
