HomeMy WebLinkAboutP&Z Minutes 2005-09-12 Special[ Minutes of a Special Meeting of the Friendswood Planning and Zoning Commission September 12, 2005 A special meeting of the Friendswood Planning and Zoning Conunission was held Monday, September 12, 2005, at 7:00 p.m. in the city hall located at 910 S. Friendswood Drive, Friendswood, Texas. The following members were present: David Brakebill-?: 10 p.m. Jim Gibson Kevin Holland Roy Klusendorf Mark Van Riper Sherry Weesner Diana Steelquist-Staff Planner Cheri Skelton-Development Coordinator With a quorum present, Commissioner Bertrand absent, Chairman Holland called the Joint Public Hearing to order to discuss the following: 7:00 P.M.-DOCKETED JOINT PUBLIC HEARING 1.To receive public input, either oral or written regarding the following: A.Zone Classification change for a tract of land containing 137.307 acres of land, Clear Creek Farms, located in the Sarah McKissick Survey, property located at 3801 FM 528, Harris County, Texas, from Single-Family Residential (SFR) and amending Planned Unit Development (PUD) -Mixed Use/amending Ma ster Land Use Plan to Planned Unit Development (PUD) -Mixed Use. Staff gave a brief history overview of the zone change request. Staff explained that since approved in 2004, the FEMA map has changed which placed portions of the property in the Floodway. The reasons for the Public Hearing are due to the land swap with Clear Creek Independent School District (CCISD) and the percentage of changes to the master land use plan of the Planned Unit Development (PUD). Mr. Browne, developer of the property, addressed City Council and the Conunission. Mr. Browne explained FEMA changed the floodplain map after the re-zoning was approved. Mr. Browne stated since FEMA changed the floodway this forced the project to change and allow for additional water. Mr. Browne continued by explaining the biggest change to the project is the parkland, which was previously 27 acres and now is 41 acres. The other changes to the project included the increase in office space, retail decreased, the amphitheater, hotel, and the restaurant moved to the retail commercial area. Councilmember Ewing asked how much green space is lost to detention ponds. Mr. Browne stated the wet ponds would be part of the aesthetics and the all trees will try to be saved but the trees in the wet ponds may not be. The following is a synopsis of the discussions in opposition of the zone change request: Page 1 of 3 9/12/05 P & Z Cindy Bohmmon, 2102 McKissick stated she opposed the zone change for the following reasons: 1.Flooding is a concern because erosion is increased. 2.Loss of the green belt (trees). 3.Cuts down on screening and aesthetics of the neighborhood. 4.Concerned about marina, and wildlife will be displaced. 5.Loss of large growth trees and habitat for woodpeckers. After giving the issues of concern, she then gave possible changes to consider for the development to help homeowners, wildlife and the overall development. Ted Leach, stated he was concerned with the creek itself. He likes the natural beauty of it. Polluted runoff from parking lots and the marina is an issue. He feels this development could be a negative impact to the creek. Jolm Johnson, 703 Oak, stated he is all for the development and property rights; however, he is concerned with the amphitheater. He feels there will be issues with noise pollution because he likes the quietness of his property. He also feels a 100 boat marina will be a problem because the creek turns are going to cause an accident if more boats are on it. He asked if the marina would be public or private. He stated in addition he is concerned with the greenbelt being destroyed. Kathy Rodgers, 207 Charleston stated she is concerned with the amphitheatre because of noise pollution. No one spoke in favor of the zone change. Mr. Browne then addressed the concerns of the citizens opposed of the zone change. He stated that FEMA requires that no changes to the hydraulics of the creek can be made. FEMA enforces those requirements. He also stated that no changes would be made to the parkland but he thought that Friendswood wanted the amphitheater for community based events. In addition, regarding the concern about noise pollution, Mr. Browne stated the amphitheater would be positioned where noise would go toward the development. B.Amending the Zoning Ordinance of the City of Friendswood, amending height restrictions in Community Shopping Center (CSC), Original Business District (OBD) and Neighborhood Commercial (NC). Staff reviewed with the City Council and Planning and Zoning Commission the current and proposed zoning ordinance regarding height restrictions. The following is a synopsis of people who spoke in favor: Bill Finger, 2805 Burr Oak stated by allowing these zones to have a greater height will encourage commercial development, which in turn will increase tax revenue. He also stated that the city has in place protection for homeowners for this modification. The following is a synopsis s of people who spoke against: Page 2 of 3 9/12/05 P & Z [ I I Penelope Burke, 613 Penny Lane stated she is opposed of changing the look of Friendswood and that Friendswood has a fundamental look that other city's do not. C.Amending the Zoning Ordinance of the City of Friendswood, adding definitions of Open Space and Green Space. Staff gave a brief history regarding this item. Staff stated that the current Cluster Home ordinance does not have a clear definition of open space/green space within the ordinance. Staff then reviewed with City Council and Planning and Zoning the proposed definitions. No one spoke in favor or against. D.Amending the Zoning Ordinance of the City of Friendswood, revisions to the Entryway Overlay District to include additional roadways. Staff explained the Entryway Overlay District is merely an overlay on top of the current zoning and the proposed revisions would also provide relief to intersecting zones of corner lots. No one spoke in favor or against. E.Amending the Zoning Ordinance of the City of Friendswood, eliminating office space limitations in Community Shopping Center (CSC) and Neighborhood Commercial (NC). Staff reviewed with City Council and Planning and Zoning the current zoning requirements for this item. The following is a synopsis of people who spoke against the item. Bill Finger, 2805 Burr Oak stated by allowing the office limitations to be removed it will eliminate sales tax revenue for the city. He also stated that allowing this proposal eliminates the need. for Office Park District (OPD), and it negatively impacts residential values. 2.Adjournment With no further comments the Joint Public Hearing was adjourned at 8: 12 p.m. Development Coordinator Page 3 of 3 9/12/05 P & Z Minutes of a Special Meeting of the Friendswood Planning and Zoning Commission September 13, 2005 A special meeting of the Friendswood Planning and Zoning Commission was scheduled for Tuesday, September 13, 2005, at 6:30 p.m. in the city hall located at 910 S. Friendswood Drive, Friendswood, Texas. The meeting regarding a discussion with members of the Main Street Committee regarding Zoning Measures for the Main Street Area was cancelled due to a lack of quorum available.
