Mike Dominguez -City Planner Diana Steelquist -Development Coordinator With a quornm present, Clark and Bertrand absent, the meeting was called to order at 7:08 p.m. by Chai1man Burke to consider the following: Call to Order: Docketed joint public hearing: 1.To receive public input, either oral or written, regarding the following: A.A request for a zone classification change for property located at 101 Live Oak, located on the comer of West Edgewood (FM 2351) and Live Oak, 0.4591 acres in the Perry and Austin League, Abstract No. 20, Galveston County, Texas,· from: Community Shopping Center (CSC) to: Multi­ Family Residential --High (MFR-H) The applicant, Mr. Carl Horecky of 415 Live Oak, addressed the Commission and Council. He proposes to develop 5 townhomes on tlie .4591 acre lot. The townhomes will be sim ilar in style as the homes in the adjoining garden homes subdivision. Councilman Erikson wanted know if a townhome development would be better served if it was zoned medium density. Chairman Burke explained that a medium density zone would only allow for the development of 3 units, where as the high density zone allowed for 5 units. Bill Ruble, 410 Live Oak, addressed the Commission and Council as the spokesperson for about l O of his neighbors on Live Oak. They are not in favor of the zone change for the following reasons: 1) 5 additional driveways on Live Oak would create traffic problems as there is no traffic light and the street is narrow; 2)the townhomes would not have any area for children to play; 3) the neighbors -1 - 04/02/0 l P &Z ,.-c-• .r 1,.-,;:_• ,1.�• •.ii :t •., .._., are concerned that the townhomes will not have the same style as the garden homes; 4) two sto1y townhomes will detract from the current street appeal resulting in a decrease in property values; 5) the townhomes would become rental properties; 6) would the townhome residents have to pay maintenance fees like the garden home residents currently do; 7) concerned about increased drainage and detention problems; 8) will the garden home residents' be liable if the townhome residents use the walking trail. Marcus Rives, 1106 W. Edgewood, spoke in favor of the zone change. Mr. Rives is the designer for the proposed townhomes. He rebutted several of Mr. Ruben's comments. He stated that a commercial development would have more traffic than the additional 5 drive ways proposed. Property values should increase because the townhomes will be high end in nature with fa9ade materials to match area garden homes. There are also already some 2-stoty homes on Live Oak. Detention and runoff were calculated for this tract when the garden home subdivision was developed. Donna Stephenson, 414 Live Oak, wanted to know if the decks on the proposed townhomes would be visible from Live Oak. Mr. Rives responded the decks would have decorative railing and be poured concrete. Chai1man Burke advised Ms. Stevenson that the issue under discussion was the re-zoning. Site plan issues would be discussed when the site plan was submitted to Planning & Zoning. Comments on site plan issues would be discussed at that time. Councilwoman Brizendine wanted to know what the value of the proposed townhomes would be. Mr. Rives estimated that constmction costs would be about $80/sq. ft. and most would average about 1,500 sq. ft. in size. Chairman Burke confomed that this item would be on the April 5 th Planning & Zoning agenda.
