HomeMy WebLinkAboutP&Z Minutes 2001-03-15 Regularr Minutes of a Regular Meeting ofthe Friendswo od Planning and Zoning Commission lVIarch 15, 2001 A regular meeting of the Friendswood Planning and Zoning Com mission was held Thursday March 15, 2001 at 7:00 p.m. in the City Hall Council Chambers located at 910 S. Friendswood Drive, Friendswood, Texas. The following members were present: Tom Burke Mike Dominguez -City Planner Mark Clark Frank Frankovich Zekie McVeigh Niels Aalund Bob Bertrand Tom Samson Linda Collins -Senior Administrative Assistant With a quorum present, Chair Burke called the meeting to order to consider the following: 1.Communications from the public. There were no communications from the public. 2.Consideration and possible action regarding a zone classification change for an 11.16 Acre tract out of George W. Patterson Survey, Abstract 645, property located in front of the proposed Friendswood Lakes Subdivision (FM 528-W. Parkwood), Galveston County, Texas from: Single Family Residential (SFR) to: Multifamily Residential -Garden Home District (MFR-GHD) . Motion: Neils Aalund -to recommend approval Second: Mark Clark Vote for: Six Vote against: One, Zekie Mc Veigh Motion Carried Mitch Mitchell addressed the Commissioners comments and answered questions. Zekie Mc Veigh was concerned of houses backing up to the back door of business. It was explained the lots were 11 0' in depth with a 1 0' natural buffer and fencing. 3.Consideration and possible action regarding the following: Consent Agenda: Motion: Second: Vote for: Amended Mark Clark -to approve Zekie McVeigh Unanimous -1 - 03/15/01 P&Z Motion Carried Motion: Second: Vote for: Clark -Make correction to 3-1-01 minutes page 3, item 5 -the staff rep01t item 2.) B.approval 3-05-01 special meeting minutes. 4.Discussion regarding Appendix C -Zoning Ordinance Section 8, I., 2. f., (1. thrn 3.) Preserving trees -Historical Significance. After much discussion among the Commissioners, including items like the number of exceptions granted, amount of surveying to be done, increased tree survey size, site management, cost impact of doing any or all of these items, the dept. or personnel that would be enforcing the changes and the debit and credit system of tree removal and replacement. Tom Burke stated it might be necessary to set up a workshop session with Council. Commissioners were interested in reading what other Cities or areas have in place. Commissioners suggested ways of preserving current trees and adding more, through Texas A&M volunteer, 61Tants or other means that would not cost the City any funds. Mike Dominguez said he would provide the Commissioners copies of tree ordinances and other data from surrounding areas for examination in time for the April 5, 2001, meeting. 5.Staff Repo1·t Mike Dominguez reported on each as indicated below: A.City Planner's report clarifying the Park Dedication Ordinance. B.City Planner's repo1t regarding the use of Recreation/Detention easements pertaining to plats and the Park Dedication Ordin ance. Mike Dominguez indicated it would be difficult to ask for specific uses to be placed on the plat. With much opposition the Commissioners sited many areas in and around Friendswood where these very easements have become areas of concern. Many are grown up in weeds, stickers and etc., making them havens for snakes, varmints and the like. The asked that Mike look further into what can be done to give a better definition of this easement. C.Status of Robin 's Nest site plan and building permits Mike briefed the Commissioners on the set back requirements that were not met; stating this as the reason the building pe1mit was pulled. Commissioners asked questions concerning pro cedure of the permitting and inspection processes for ensuring a slab is placed within allotted setbacks. Commission Bertrand commended that a list of comments were provided and the setbacks were mentioned in the first go around and in the second go 'round for final approval the comments were not incorporated, and it was -2 - 03/15/01 P&Z I missed by staff, it was also this group and of course the City Council approved it and it wasn't caught there. The issue goes back to when you have conflicts between Ordinances and plans, the Ordinances mle with regards to setback and that is why we are here where we are. This has been a difficult process, and the City should be commended for the step we are taking. This is the right approach due to concerns that if a mistake is made and allowed to continue, then next person coming in, if they have a mistake, you have the issue all over again. Commissioner Mc Veigh asked for clarification of slab insp ection procedure. Commissioners clarified that a slab inspection is not done until a form survey is provided by the surv eyor before it is poured and inspected. Commissioner Burke stated it was the homeowners association brought to the attention of the City the setback problem. Mike Dominguez stated that he would have a more detailed repo1t for the Commission at the next meeti ng. D.Status of Chevron Handi-plus land use change request Mike Dominguez indicated there will be another public hearing on April 16, 200 l, due to the metes and bounds changing.
