HomeMy WebLinkAboutP&Z Minutes 2001-02-05 Regularl Minutes of the Friendswood Planning and Zoning Commission February S, 2001 A special meeting of the Friendswood Planning and Zoning Commission was held Monday February 5, 2001 at 7:00 p.m. in the City Hall Council Chambers located at 910 S.Friendswood Drive, Friendswood, Texas. Diana Steelquist -CDD Coordinator Mike Hodge -CDD Director With a quorum present, Frankovich and Clark absent, the meeting was called to order at 7: 10 p.m. by Chairman Burke to consider the following: Call to Order: I I Docketed joint public hearing: 1.To receive public input, either oral or written, regarding the following: A.Requesting zone classification change for a total of 0.9634 acre tract out of an 11.62 acre tract, in the Mary Sloan Survey, Abstract 184, Chevron Handi-plus ( comer of FM 528 and Country Club Drive) Galveston County, Texas, from: Multi-family Residential Dwelling District - Medium (MFR-M), to: Neighborhood Commercial (NC). Mr. David Lucyk, representing the applicants, Millennium Development, addressed the council and commission. The request is to rezone a portion of a MFR-M tract to NC in order to build a Chevron Handi-plus gas station/ convenience store. The rezoning is necessary due to an error on the City Zoning map which indicated the area was zoned CSC, however, when the conceptual plan was presented to Planning & Zoning, it was discovered that the area was not properly zoned. No one spoke in favor of the project. Dr. Larry Smith, 8207 Mason Road, Manvel, Texas, addressed the Council and Commission to express his opposition to the re-zoning and development of a gas station at this location. He also believed Chairman Burke had a conflict of interest because of the Lowe Family Trust's former ownership of the tract. He is - 1 - 02/05/01 P&Z concerned about the cunent private road that provides access to the golf course. He also felt it was not fair to residents who had purchased lots near the MFR-M tract with the expectation of being next to only a residential development, now being placed near a commercial development. He stated there were enough service stations in the area. He questioned how thls re-zoning would fit in with the master plan of community. He stated that the Millennium Group had threatened him with a lawsuit if he appeared at the public hearing. He believes that the station would create a traffic hazard on FM 528, as there is not a traffic signal at the Country Club Drive intersection. He also pointed out that a commercial development could take place in the proper zone 60 feet across Country Club Drive on property which he owns. Mrs. Vicki Schultz, 2204 Tampa, spoke in opposition. She felt the gas station would be a traffic safety hazard and would also lower the property value of her home in Boca Raton. She did not think another service station was needed in Friendswood. Mr. Robel1 Costa, 2706 T8µipa Street, spoke in opposition. He seconded Mrs. Schultz's statements. Richard Jackson, 1453 Castle Harbor Drive, noted that two gas stations already exist within 1 000 feet of proposed Chevron. He believes if the Chevron opened, the additional competition would force one of the other stations to close and be abandoned. An abandoned service station would be a blight to the area. There are already some in the area. Nel Smith, a Sun Meadow resident on East Castle Harbor, spoke in opposition. A new gas station would be a visual blight viewed from her home. Joe Cannon, 420 E. Castle Harbor, spoke in opposition. There are already failing businesses in the area. Councilman Measeles wanted to know why the zoning map had been in enor. Mr. Lucyk responded that when he attended the DRC, he was told the area was zoned CSC. When he presented his conceptual plan to P&Z, it was determined to be MFR-M. Chairman Burke confomed that the property was zoned MFR-M but could not give details. The Community Development director noted that the map had been updated and an error had been made on the updated map. Ms. Faye Roberson addressed the commission in opposition to the gas station. She is concerned about drainage. B.Requesting a Specific Use Permit-Family Life Center (Site Plan change only) for propelty located at 202 E. Heritage, a tract of land out of Lot 1, Block 2, First Baptist Church of Friendswood Addition, Friendswood, Galveston County, Texas -2 - 02/05/01 P&Z \ Mr. Bob Mase and Ms. Kathy Denton, represented the applicant and addressed the Commission and Council. They plan on adding 95 parking spaces and a detention pond. Chairman Burke wanted to know where the outfall was for the pond. Councilwoman Kitten Brizedine was concerned about the screening of the detention pond. Ms. Denton responded that the_p.ond area was wooded with a 3 ½ foot deep detention pond. Outfall will be to the creek at the rear of the property.
