of the
Friendswood Planning and Zoning Commission
January 17, 2002
A regular meeting of the Friendswood Planning and Zoning Commission was held
Thursday, January 17, 2002 at 7:00 p.m. in the city hall council chambers located at 910
S.Friendswood Drive, Friendswood, Texas. The following members were present:

With a quorum present, Chair Burke called the meeting to order to consider the following:

Discussion and possible action regarding a request for Specific Use Permit (SUP)
-Church Facilities located in Berean Baptist Subdivision and Burgess
Subdivision, 9.267 acres tract of land, zoned Single Family Residential (SFR),
(FM 528 at Desota Drive), Galveston County, Texas.

Mr. Mark Shatz of Tackett-Ludholz Architects, represented the Church.
Mr. Shatz recapped the Church's request which is for a master planned
development with Phase One to include a new sanctuary that will seat 500
congregants and administrative facilities. Phase One will have approximately
134 parking space with some additional parking possible if funding permits. The
current Zoning Ordinance requirements for parking are met with the 134 spaces.

The access to the church facilities for Phase One wi11 be off of FM 528. Later
phases of the master plan will make the church facilities accessible from Desota
Dtive, thus providing access from two different points. Future phases call for
another sanctua1y that will seat about 1,000 people and additional administrative
and education space as the congregation grows. The church is under negotiations
with Alliance Construction for completion of Phase One by late October of this
year. A site development permit has been issued to do some dirt work.
Chairman Burke asked the Commission if they had any questions
regarding the site plan as it is the nature of a Specific Use Permit that the site plan
become part of the permit.
In response to a question from Commissioner Frankovich, Mr. Shotz
explained that the driveway off FM 528 was not ali gned with Windsong Lane as
had been requested by staff because of possible traffic flow problems and the fact
that a traffic light already exists at Desota. The pipelines on the property
necessitated the placement of the parking along FM 528. The church has obt ained
letters from each pipeline owner allowing them to cons.truct a parking lot over the
pipelines. '
Commissioner Bertrand asked about the placement of sidewalks on the
site. Mr. Shotz stated that the sidewalk shown along Desota would be constructed
during one of the next phases. The Church is requesting that the requirement for
sidewalks along FM 528 be deferred to a time in the future when the church will
be in a better financial position for such an undertaking. A discussion took place
regarding the necessity fo! sidewalks.
3.Discussion regarding the Conceptual Plan of the amended plat of Boca Raton,
Section Four, Lots 7, 8, 9 & 10, Block 5.
Ms. Janice Lowe, agent for the applicant, addressed the Commission. The
amended plat is being requested to correct a nine inch error in the placement of
the lot lines. These are currently un-improved lots.
4.Discussion regarding the Conceptual Plan of Sunset' Car Wash located 304 E.
Edgewood.
Mike Riggle, of 3300 Pebble Brook and co-owner, addressed the Commission.
The tract is located next to the closed oil change shop off FM 2351. They will not
be combining operations with the oil change business.
Commissioner Frankovich asked about the possibility of placing a driveway to
adjoin the two commercial tracts; however, Mr. Riggle was concerned that their
detention plan may not allow then:i: to have an adjacent driveway.

Chairman Burke ·also noted the need for-common access with the oil change lot:
He observed the plan indicated a larger landscaped area which could be used for a
detention pond on the opposite side of the tract. He also noted that the tract has 36
large oak trees and requested a tree survey of the first twenty feet of frontage. He
would like to see as many trees as possible saved throughout the h·act.
Commissioner Frankovich suggested a series of culverts be used for detention to
facilitate the joint access.
Commissioner Be1irand expressed concern regarding noise and light next to the
Mobile Home District in the rear of the tract. . The applicants will rebuild the eight
foot fence and have a twenty foot buffer of green space in the rear. Pole lights will
be used in the vacuum area and lights will be in the canopy of the car wash. The
car wash will be open twenty-four hours a day as an un-manned facility.
Chairman Burke encouraged the applicants to review the noise ordinance with
regards to the vacuum motors. Commissioner Bertrand noted that any dumpster
located on the site would need to be screened per E.O.D. requirements The
applicants stated that the construction would be a metal bu\lding with a masonry
fa9ade. Although' there are no sidewalks in the area, they will be required. The
applicants stated that the three landscape areas shown on the plan were designed
to save h·ees on the lot. The applicants were discouraged from obtaining a
development permit until a site plan could be reviewed by staff and P&Z.
Discussion regarding the Conceptual Plan of L. Christoph Subdivision located off
FM 528.
Mr. Chuck Davis addressed the Commis.sion for the applicant. He stated the plat
is for a one-acre home site. The area being platted is located across from the
CCDD's office on FM 528. Commissioner Be1trand complimented the plan for
its information on the location of trees.
6.Discussion and possible action regarding city requirements and enforcement for
fire lanes and private streets.
Chairman Burke stated that the request for this item originated from
Commissioner Clark. Clark noted that this issue had been touched on during
previous P &Z meetings and appeared to be an ongoing discussion between
different city departments. He believes there is an enforcement problem with
parking in fire lanes and emergency access as it relates to the increasing number
of apmiments and gated communities. As an example, he stated the Autumn
Creek multi-family complex had city patrol cars which entered the complex but
would not issue citations because it was private property.

,Chairman Burke tried to define the issue by asking where the creation of fire lanes
originates from the City Code and how enforcement of them pertains to the
Planning & Zoning Commission.
The Fire Marshall responded that fire lanes are requirements of the City Code of
Ordinances. The Deputy Director of Community Development noted to the
Commission that fire lane requisites are reviewed by staff but did not believe
enforcement was a P &Z issue. Captain Luke Loesser of the PD stated that fire
lane enforcement was done by the PD and FMO with the cooperation of the
property owner. Enforcement was generally complaint driven. Also the property
owner has the authority to have vehicles towed from fire lanes. Captain Loesser
also asked that if there were specific concerns, that the individual Commissioner
address the issue with city staff in a different fon.im.
On private streets, the City can only issue a citation for D.W.I. or reckless
driving. A big issue in en forcement of fires lanes is the proper letteri ng of the
lane. Citations can only be issued for lanes that are properly marked with yellow
letters on a red background. Often when maintenance is performed on the
markings, white letters are used. The Commission questioned whether a proper
maintenance requirement for fire lanes should be a part of a site plan approval.
The FMO stated a review of the fire codes is currently being done in conjunction
with the review of the building codes. The FMO would prefer fire lanes be
marked with signage.
7.Discussion and possible action regarding landscaping in drainage easements and
ponds.
Chairman Burke has noted the inclusion of a CCDD note on plats which does not
allow planting/landscaping in drainage easements and reserves. He spoke to Carl
Horecky, who stated the concern that in the past, side swales had been filled in
causing drainage problems. Al Lentz, representing the Drainage District, added
that planting in drainage easements takes away from detention, blocks flow and
can prevent access to ponds or creeks. These types of problems are evident in
older subdivisions in the District. The requirement of no planting/landscaping in
easements has been added to plats to prevent these problems.'
Mr. Lentz did state that some regional drainage facilities, such as one in the Forest
of F1iendswood, were going to be used for soccer practice fields. The issue of
maintenance had to be worked out before the recreational use could be allowed.
Without room for maint enance, the District cannot allow landscaping in it's
reserves. Some exceptions have been made and the Distiict's plan is to provide
two regional detention facilities in the Friendswood area which can serve dual
purposes of recreation and detention. Such as a fishing pond, jogging trails or
practice fields. The District is also trying to leave as many trees in these regional
facilities as possible to promote them as park areas.

Trees can be placed in larger detention facilities so iong as there is adequate area
to move maintenance equipment in and around them. No developer has actually
approached the District about planting trees in detention facilities.
The Commission wanted to know if detention/recreational easements were
actually usable for recreational purposes when their main function was for
drainage and was concerned that some developments were receiving park credits
for these areas. A request was made for the Parks Director to address these issues
with the Commission.
Mr. Lentz stated that the District was mainly concerned with developments where
the detention maintenance is the District's responsibility.
