I Minutes of a Special Meeting/Joint Workshop Session of the Friendswood Planning and Zoning Commission June 7, 2004 A special meeting of the Friendswood Planning and Zoning Commission was held Monday,· June 7, 2004 at 4:30 p.m. in the city hall council chambers located at 910 S. Fr iendswood Drive, Friendswood, Texas. The following members were present: Tom Burke-5:20 pm Jim Gibson Kevin Holland Sheny Weesner John Olson-City Attorney Ron Cox-City Manager Dan Johnson-Deputy Director of Community Development Diana Steelquist-Planner Cheri Skelton-Development Coordinator With a quorum present, Mayor Brizendine called the meeting to order to consider the following. Joint Workshop Session Call to order: 1.Discussion with City Council regarding: A.Mixed Use as a Planned Unit Development zone classification (30 min.) Discussion was held regarding Mixed Use as a Planned Unit Development zone classification. Staff Planner, Diana Steelquist, gave a presentation outlining the proposed amendments to the Zoning Ordinance Planned Unit Development (PUD) regulations, which are being amended to allow Mixed Use Developments within the City. A question and answer session took place betvveen Council, Staff Planner, and the Planning and Zoning Commission members. Proposed residential limitations of 35% coverage and the purpose to promote commercial development were discussed. It was stated that Staff has put a lot of time into this process, meeting weekly and they felt good about the proposed ordinance. The Planning and Zoning Commission stated they are trying hard to work with the developments proposed, but ag reed the process for a standard PUD should still exist. Friendswood Drive, Friendswood, Texas. Call to order: Docketed Joint Public Hearing: 1.To receive public input, either oral or written regarding the following: Commissioner Burke, because of a business relationship recused himself from item "A" portion of the joint public hearing A.Request for a Zone Classification change for 6.5401 acres, located at Woodland Trails and FM 2351,Galveston County, Texas, from Single Family Residential (SFR) to Office Park District (OPD) .. Dan Rucker, with Coastal Bend Prope1ties, addressed the Commission and City Council regarding his request for a zone classification change. Mr. Rucker presep.ted several demonstrations, which indicated the intent of the pi'operty dating back to 1999. He explained that it was always his intent to re-zone this prope1ty to a Planned Unit Development (PUD) or some other commercial zone. He also stated that he understood a map that was inconect was distributed at some point in time indicating the property he wants to re-zone was to remain open space. It was unfmtunate that the prope1ty owners ofthe Forest of Friendswood felt they were mislead; however, the intent for that property was always for commercial use. Several people spoke for the re-zoning classification change. Wayne Robbins, 305 Timber Creek, stated he was under the impression when he bought in the Forest of Friendswood that the property at the front of the subdivision would be commercial. In addition it would also increase the tax base. Leland Harris, 1109 Oakland, stated he never heard any discussion of ,the front of the Page 1 of 4 6/7/04 P & Z Forest of Friendswood being open space. He agreed with Mr. Robbins about the increase of the tax base. David Dorsett, 1105 Oakland, agreed with the previous reason listed above. Bud Goza, 1104 Oak Park Lane, suggested and encouraged everyone to work together for a better upper class Office Park District (OPD). He was in favor of the re-zoning. Several people spoke against the re-zoning classification change. Charles Kelly, 603 Tall Timbers, stated cha nging the open space to commercial would create spot zoning. He is against commercial development on the property. Chris Sellers, Home Owners Association President (HOA) of the Forest of Friendswood, 311 Scenic View, stated that the appraisal repo1t the HOA obtained from a private source indicated that allowing this prope1ty to be rezoned to commercial would cause a negative prope1ty value for the people of the Forest of Friendswood and surrounding prope1ties. He also stated that some items of concern were drainage, increased crime, increased traffic flow, traffic congestion, and property value loss. Not knowing what size, shape, setbacks or landscaping that will be allowed is also a concern. Mr. Sellers is against the re-zorung. Steve Waldner, 147 Chen-y Tree Lane, Mr. Fulghum, lives in Enchanted Woods subdivision and is concerned about the open space becoming commercial. He stated that the whole reason he moved to Friendswood was because it was considered a residential community. He also expressed concerns' that the detention pond does not hold enough for more development, the increase in traffic will cause more wrecks and the prope1ty value will decrease. Tom Debello, 403 Timbergrove, stated he would like to see the prope1ty stay open space. He agrees with the previous speakers. Kirk Stephens, 308 Trail Bend stated he agreed with what the other speakers were concerned about, but also is concerned about keeping the natural beauty of the Forest of Friendswood. Justin Tiemann, 608 Royal Oaks, he likes the natural beauty of the Forest and is concerned about the traffic issue that_ a commercial development would create. He also stated that he was mislead in believing that the open space would always be there. Henry Flinn, 700 Timber Creek Lane, agrees with the previous speakers with regards to the tax base and traffic issues. Tim Demarko, 609 Tall Timbers, He stated that he did not want to see or s_mell the garbage or trash bins that a commercial development would have. Mr. Demarko also asked if Commissioner Holland needed to recuse himself since Cervelle homes built in the Forest of Friendswood. Paul Campise, 601 Tall Timbers, Mr. Campise is concerned about the flooding that might Page 2 of 4 6/7/04 P & Z [ I l l l occur if development occurs on the property. Paul Afonso, 805 Pineywoods Dr., He does not believe commercial prope1ty should be allowed and the odor and site trash is also what he is concerned about. In addition, if the commercial prope1ty was ever bought out and a new developer wanted to change the look to be something that is unappealing, then the value of the homes would go down and who is going to require the new developer to make the property presentable. Eva Lord, 406 Trailhead Dr., is concerned about crime rate going up and traffic increasing. Nancy Dauer, 206 Trail Bend Lane, is concerned about the traffic increase, safety, and stated the current vacant commercial prope1ty in Friendswood should be beautified instead of creating more commercial properties, so they could later go empty. Rick James, 1004 Acorn Ct., agreed with all the comments stated previously and objected to the re-zoning. Kenneth Cruise, 710 Pine Oak Dr., is concerned about the quality of the neighborhood, traffic, vacant commercial prope1ties not being used and drainage. Doug Buster, 906 Pine Breeze, agreed with eve1ything previously stated and objected to the re-zoning. Melissa Rickard, 707 Hidden Creek, does not want run down commercial. Vince Colangelo, 201 Trail Bend Lane, agreed with everything said previously and stated that Mr. Rucker should develop more homes and not commercial. Cabella Taddei, 712 Post Oak, he likes the look of the Forest of Friendswood and does not want it to be changed. Mike Stanley, 200 Trail Bend Lane, he does not want to see garbage, air conditioning units and hear the noise of a commercial establishment. Arthur Hue, 709 Pin Oak, he would like to keep the natural look of the Forest of Friendswood. The main· areas of concern seemed to be traffic increase, crime increase, drain age issues, flooding, garbage and odors from a commercial business as well as the possibilities of the commercial establishment being vacant. The residents also wanted to keep the natural look of the Forest of Friendswood. B.Amendment to the Zoning Ordinance and Building Code-Industrialized Housing and Buildings. Staff gave a presentation indicating how the proposed ordinance change would regulate Industrialized Homes in Friendswood and the requirements for Industrialized Homes. Industrialized Homes can also be regulated through the Home Owners Association . Page 3 of 4 6/7/04 P & Z (HOA) seperate from the City. No one spoke either for or against the proposed amendment. C.Amending Zoning Ordinance for revisions to the Permitted Use Table for Used Car Sales, Amusement/Recreation Industries, and Parking requirements. Staff's presentation outlined the proposed revisions to the Permitted Use Table (PUT). Used car sales would be allowed with a Specific Use Permit (SUP) within the same zoning district as New Car Sales. Amusement/Recreational Industries will be allowed in Industrial and Light Industrial zones with an SUP. The Parking requirements within the PUT for use #531 was proposed to be changed to TBD (to be determined). No one spoke either for or against the proposed amendment. D.Amending Zoning Ordinance-Cluster Homes Staff presented the proposal for revising Cluster Homes. One of the changes involves increasing the amount of required open space from 15 to 40 percent to 20 to 40 percent. The proposed changes also modify the density requirements so that they are addressed through a step process. In addition, the proposed ordinance changes will simplify the language and create a more clear unders tanding of what a Cluster Home development requires. Councilman Goza stated that he would like a definition of the proposed verbiage "reasonably adjust" with regards to the different levels of density requirements. John Hammond, with Friendswood Development, addressed the Commission and City Council. Mr. Hammond stated he was in favor of the changes; however, he would like the lot coverage adjusted as well as the setback requirements. No one spoke against the propos ed amendment. E.Amending Zoning Ordinance for Planned Unit Development-Mixed Use. Staff presented a proposed ordinance change to create enabling legislation for mixed-use development with a Master Plan approval process requiring detailed development standards.
