Chairman Hughes called the hearing to order to receive public input regarding a variance for property located at 3437 Queensburg_Lane, situated in Lot 4, Block 1, Section 2 in Harris County, Texas, from the requirements of Appendix C-Zoning, Regulation Matrix Residential District 7.Q.3 of the Friendswood City Code to allow construction of a patio cover into the 25 foot rear set back. Chairman Hughes asked if anyone from the public would like to speak in favor of this request, other than the applicants. The applicant was not present to speak regarding the request. Deputy Director/Planning and Building Regulations Frank Manigold stated that the owner called and stated he could not be present because he was going out of town. Chairman Hughes asked Mr.Manigold if the applicant had requested the Board to hold off on a decision,table the motion,or proceed with a decision. Mr.Manigold stated the applicant requested that he call him tomorrow with the decision. Chairman Hughes asked if anyone from the public who would like to speak for or against the request. No one spoke for or against the request. Hearing no further input the Public Hearing was closed. Chairman Hughes asked for any comments from the Board. Boardmember O'Brien asked about a specific amount on the variance. Mr. Manigold stated the applicant was going to bring additional information to the meeting. Boardmember Knis inquired about rear elevation. Mr. Manigold stated the home was a Perry home and is one of the largest built in the subdivision. Boardmember Dyer asked if the current concrete slab is representative of the foot print of the addition that the applicant wants to make. Mr. Manigold stated he did not know if it was representative of the foot print of the addition the applicant wants to make. Chairman Hughes asked if the plans were to scale. Mr. Manigold stated he did not know if they were to scale. It is a site plan which is close to scale. Chairman Hughes stated that it looks like a 14 foot deep patio that is into the setback line probably 10 feet. He asked if the additional structure that the applicant is going to build could be more than 10 feet into the setback. Mr. Manigold stated that to his understanding, it was going to be the same as the foot print. Chairman Hughes asked if any plans have been permitted or were there any plans that show an exact dimension. Mr. Manigold stated there is a small patio but not that size. Chairman Hughes stated he was reluctant to proceed when the Board does not know for sure exactly what it is the applicant wants or how big he wants the patio cover to be. Mr. Hughes asked for any comments from the Board. After additional discussion regarding the variance and the size of the lot, Chairman Hughes stated that there was not enough information to grant a variance so he asked for a motion on the proposal. **Boardmember Dyer made a motion to cease discussion and called for a vote on the proposal. Seconded by Boardmember O'Brien. The motion was denied unanimously. 1 **Boardmember Kendrick moved to approve the minutes for the March 25, May 27, and July 1, 2008 meetings with an amendment to the July 1, 2008 minutes. Seconded by Boardmember Dyer. The motion was approved unanimously. A motion was made and approved to adjourn at 7:16 PM. Vice Chairman Steve Knis called the meeting to order at 7:00 PM. 7:00 PM—REGULAR SESSION Vice Chairman Knis appointed alternate member Mike Czarowitz as a regular voting member for tonight's meeting due to Chairman Hughes absence. Vice Chairman Knis explained the process for holding the public hearing. Vice Chairman Knis called the hearing to order to receive public input regarding a variance for property located at 600 Northfield Dr. Lot 13, Block 2 Northfield Estates, a subdivision in Galveston County, Texas of required twenty-five (25) foot rear yard setback of Appendix C — Zoning, Section 7.Q.3., Regulations Matrix Residential Districts of the Friendswood City Code to allow a newly constructed home already constructed beyond the rear yard and setback line. No one spoke for or against the proposed request. Hearing no further input the Public Hearing was closed. Deputy Director of Community Development Frank Manigold stated that no applicant was in attendance. Vice Chairman Knis stated maps and drawings are not available from the applicant since he was not in attendance. Mr. Manigold stated the builder submitted a site plan which is given to Community Development to see if a house will fit on the lot, the inspector that was looking at this was looking at pipeline setback, was concerned that structure was 50 ft. awam pipeline, inspector did not want to sign the site plan because he was concerned. Mr. Manigold sMt' e assured him it was okay and said he stamped it approved and went on with the permit, survey was stamped June 10, engineer looks at the foundation, should have form survey before they pour, Boardmember O'Brien stated there is supposed to be 25 ft. setback. Mr. Manigold stated it was missed because they were worrying about the pipeline instead of the fact that they only had 13-15 ft. setback. Vice Chairman Knis asked if builders usually know setback rules and Mr. Manigold answered yes. Boardmember Czarowitz asked about plumbing inspection before and Mr. Manigold stated yes. Boardmember Dyer asked if other Brentwood homes were built there and are they 25 ft. setback and Mr. Manigold said yes and further stated he does not have the addition of the garage on the side and does not have the correction on the engineer letter saying he saw the extension of the garage. Boardmember O'Brien asked if rear setback is the only issue and Mr. Manigold answered yes. Boardmember Dyer asked if it is supposed to be 25 ft. what is it now and Mr. Manigold stated 15.82 feet. Vice Chairman Knis asked about nearest home to property, pipeline easement is there so area around will not be constructed. Vice Chairman Knis asked Mr. Manigold if he had any more comments, Mr. Manigold said no, mistake was made on site plan, usually caught on form survey. Boardmember O'Brien asked when the City mistakenly approved it, it was only 13 ft. but Brentwood Homes changed to 15 ft. Vice Chairman Knis asked whose responsibility is it to make sure it is done correctly, Brentwood Homes obviously knew it was 25 ft., it is their ultimate responsibility to submit plans to meet zoning, even if it is approved it does not change the zoning requirements. Mr. Manigold said he takes responsibility for missing this at the first go-round. Vice Chairman Knis asked if Brentwood Homes brought this to Community Development Department's attention and Mr. Manigold stated when they brought in the survey was when the Community Development Department noticed it. Brentwood Homes stated at that time it was ready for a cover inspection. Boardmember Kendrick asked how common is it for builders usually to wait to ask for a cover inspection. Mr. Manigold stated it is not that common and further stated a survey is required before they pour the slab for this reason as a second look before pouring concrete. Boardmember Dyer confirmed that the Community Development Department did not receive the survey until after the slab was poured and Mr. Manigold stated that is true. Vice Chairman Knis asked if this builder had done business with the City before and Mr. Manigold answered in the affirmative. Vice Chairman Knis asked clarification from the City Attorney about options. City Attorney Bobby Gervais stated the Board can grant a variance with conditions. Vice Chairman Knis asked if since the applicant is not at the meeting can the Board table the variance until the next scheduled meeting and the City Attorney said yes. Mr. Manigold stated no work is going on. Boardmember Czarowitz said yes the builder was working on it. Boardmember Kendrick stated he is concerned that someone who seemingly knows the rules would miss something like this. **Boardmember Kendrick made a motion to approve the variance as requested for property located at 600 Northfield Drive. Seconded by Boardmember Czarowitz. The motion failed 1-4 with Boardmembers Dyer,Knis,Czarowitz and Kendrick opposed. A motion was made and approved to adjourn at 7:38 PM. Chairman Hughes called the hearing to order to receive public input regarding a variance for property located at 1805 Coronado(Tract C),Tract 10, in block 7,of Mission Estates Subdivision,a subdivision in Galveston County, Texas of required twenty-five(25)foot rear yard setback, and the 10 foot side setback of Appendix C—Zoning, Section 7.Q.3,Regulations Matrix Residential Districts of the Friendswood City Code to allow a wooden deck patio with cover already constructed beyond the rear yard setback line. David Vlasek stated that he is the applicant and is asking for a variance for the rear and side setbacks on a back patio cover and a deck on the side of his house which was built to allow wheelchair access because of his wife's disability. He stated that he did not obtain a permit from the City. Chairman Hughes asked if anyone would like to speak in favor of this request. Chairman Hughes asked if anyone wanted to speak against the proposed request. Mark Parmenter, Friendswood resident, stated he is a neighbor who lives behind Mr. Vlasek and further stated he would like to know how the deck would look when it is finished and stated he also wanted to know if a fence could be constructed because the deck is not an attractive structure, is concerned about maintaining his property's value. Hearing no further input the Public Hearing was closed. Discussion was held among the Zoning Board members and the applicant regarding the construction of the deck and screened porch and that no permit was obtained from the City. **Boardmember Knis moved to approve the variance as requested for property located at 1805 Coronado. Seconded by Boardmember Thelen. The motion failed 2-3 with Boardmembers Hughes, Knis and Kendrick opposed. Discussion was held regarding amending the language on the standard agenda so an appeal or variance can be acted on either way. The language is as follows: The Zoning Board of Adjustments has the authority to hear and decide appeals of decisions of an administrative official and to grant variances and the Board may choose to grant relief to an applicant on a posted item in the form of either an appeal or variance,regardless of how the item is posted. Chairman Hughes stated that future notices of meetings will allow the Board to consider the language on applications any way the Board is legally allowed to do so,either through a variance or through an appeal. He further stated some language was sent out via email that the City Attorney had written to see if everyone was satisfied with the wording and that he was personally satisfied with the language. Additionally, he stated that this language does not increase or decrease the Board's authority to act under the law and the Board has the same law and latitude from City Council. This wording covers the notice to the public, so no one can have a complaint that the Board made a decision the wrong way without the public knowing the Board might have done that. Boardmember O'Brien asked if there was a legal problem if someone filed a variance and the Board decided that it is an appeal. City Attorney Bobby Gervais stated not for open meeting purposes because this statement would put everyone on notice. He further commented that the City does not try to steer the applicant into one way or the other; it allows them to choose whether to file for an appeal or a variance. Chairman Hughes asked for a motion to approve this language to be added to future notices. **Boardmember Knis moved to approve that language be added to future notices. Seconded by Boardmember O'Brien. The motion was approved unanimously. Frank Manigold, Deputy Director/Planning and Building Regulations, stated he will send the applicant options for an appeal. **Chairman Hughes moved to table the minutes for March 25,2008,until next meeting. Seconded by Boardmember Czarowitz. The motion was approved unanimously. Chairman Hughes asked if the message could be relayed to City Council regarding the issue of a wooden deck flat on the ground is intended to be a structure. This is not the first time this has come up and stated he knows that some of the Board members disagree. He asked the City Attorney for the best way to let City Council know that the Board would like for them to look at this issue and possibly give some direction on how they want this handled. City Attorney Gervais stated that local amendments can be adopted to the Building Code or an amendment to one of the regular codes that the City adopts and that would probably be raised through Staff and let them propose a change to the ordinance of the City Code. He further stated that he would check with Deputy Director/Planning and Building Regulations Frank Manigold to see if this is a Building Code interpretation or a Zoning Code interpretation. Mr. Miller stated that changing the building line would effectively reduce the usable size of the lot, anything less than 78 feet would change the price of the house and would make it like a small starter home which the land price would not support,and further stated that a lot of money had been put into the floodplain and other improvements so they would like to salvage the project. Chairman Hughes asked if anyone would like to speak for the proposed request. Lloyd Trevino from Patriot Bank stated he would like to speak in favor of the project and that his bank loaned money for the project relying on the documentation which was provided as true and correct. Kevin Holland, Friendswood resident, stated he was Chairman of the Planning and Zoning Commission at the time the project was started, spoke in favor of the project and stated that he signed off on the plat.
