AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS, PROVIDING FOR THE STREET NAME CHANGE OF HATCHER LANE TO
PARKSIDE DRIVE ALONG THE ENTIRE LENGTH OF THE EXISTING RIGHT-OF-
WAY, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
INCONSISTENT OR IN CONFLICT HEREWITH; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, it is the intent of City Council to protect the public health, safety, and welfare of the
citizens of Friendswood; and
WHEREAS, municipalities may, under their police powers, enact reasonable regulations to
promote the health, safety, and welfare of citizens; and
WHEREAS, the City of Friendswood is a home -rule municipality acting under its Charter adopted
by the electorate pursuant to Article 11, Section 5 of the Texas Constitution and Chapter 9 of the Texas
Local Government Code; and
WHEREAS, Section 51.001(1) of the Texas Local Government Code provides that the City
Council "may adopt, publish, amend, or repeal an ordinance, rule or police regulation that is for the good
government, peace, or order" of the City; and
WHEREAS, Section 51.001(2) of the Texas Local Government Code provides that the City
Council "may adopt, publish, amend, or repeal an ordinance, rule or police regulation that ... is necessary
or proper for the carrying out of a power granted by law" to the City or to an office or department thereof;
and
WHEREAS, Texas Transportation Code Section 311.001(a) states "[a] home -rule municipality has
exclusive control over and under the public highways, streets, and alleys of the municipality'; and
WHEREAS, the City Council finds and declares that it is in the public interest to change the name
of a public street as set forth herein; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE
OF TEXAS:
Section
1.
That the
facts and matters set forth in the recitals of this ordinance are hereby
found to be true
and
correct.
Section 2. That the name of Hatcher Lane is hereby changed to Par•kside Drive along the
entire length of the existing right -of --way, as shown in Exhibit "A," which is attached hereto and
incorporated herein for all intents and purposes.
Section 3. That the City Manager is hereby ordered and directed to cause the installation of
proper street signs and City of Friendswood maps to be amended to reflect the above -described street
name change.
Section 4. All ordinances or parts of ordinances inconsistent or in conflict herewith are,
to the extent of such inconsistency, hereby repealed.
Section 5. In the event any clause, phrase, provision, sentence, or pall of this Ordinance or
the application of the same to any person or circumstances shall for any reason be adjudged invalid
or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this
Ordinance as a whole or any part or provision hereof other than the pall declared to be invalid or
unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed
each and every part of the same notwithstanding the omission of any such part thus declared to be invalid
or unconstitutional, whether there be one or more parts.
Section 6. That this ordinance shall become effective fiom and after its date of passage and
iIs publication, as provided by law.
