White 1208 Timber Lane MEMBERS PRESENT: MEMBERS ABSENT: B. Foster Mrs. Bernice Box G. Rummel William Dykes Hal Taylor A. Knight H. Whitaker The meeting was called to order by Mr. Bruce Foster at 7:30 p.m. Mr. and Mrs . Kenneth White were present and Mr. Foster asked them to explain to the Board the nature of their problem. They reside at 1208 Timber Lane, Lot 14 of Clear Creek Woods , but own the empty lot in back of them Lot 7, which faces on Deepwood. They are requesting permission to put up a six foot (6' ) high cedar fence down both boundary sides of lot 7 and run this fence to the edge of their property and across the front on Deepwood. Their reason for wanting to do this is that they have neighbors with homes on both sides of lot 7 who use their lot for parking cars , etc. , and they want this stopped. Mrs. White said her plan is to have a garden and hot house on this empty lot. They both agreed that the adjoining neighbors would object to this fence, although these neighbors were not at the meeting to voice any objection. As shown by the attach- ed map submitted by Mr. White, there are three double lots at one end of the block each of which have a house facing Timber Lane, and fences extending to the property on Deepwood. It was Mr. White's opinion that these had been fenced before Friendswood had any ordinance on Zoning. The Board considered this at length. The lot depth is only 1001 , see survey or map attached. The Board came to the con- clusion that because lot 7 faces on Deepwood Street it must be considered a separate lot coming under all the zoning rules , despite the fact Mr. White claims it is his "back lot." A motion was made by William E. Dykes , seconded by George Rummel as follows: "That any fence erected by the Whites on lot 7 must stop twenty feet (20' ) from their property line facing on Deepwood Street, or not closer to Deepwood than the closest concrete slab of either house adjacent to lot 7." The motion carried unanimously by all members present. The reason a 20' set-back was allowed instead of 25' , is that their lot is only 100' long and according to out zoning ordinance, page 32, set-backs front, note a, the set-back may be 20' if the lot is less than 105' deep. The Board also advised the Whites that they could run a fence, not over 30 inches high, across the front property line of lot 7, if they so desired. This is covered in the ordinance on page 8, paragraph 35, yard front. Meeting was adjourned about 8:30 p.m. I
