HomeMy WebLinkAboutZBOA Minutes 1974-02-28 Regular MINUTES OF THE MEETING OF THE FRIENDSWOOD BOARD OF ADJUSTMENT February 28, 1974 The following Board members were present: Mrs. Ivy Fossler, Chairman Mr. Bruce Foster Mrs. Berneice Box Mr. William H. Taylor Mr. George Rummel Those absent were: Mr. William E. Dykes Mr. Ray Nelson The meeting was called to order by Mrs. Fossler. The first case presented was a variance on the farm of about 1100 acres along FM 528 owned by Mr. George Bofysil. Mr. Bofysil had a tenant house on this acreage that was occupied as a home by the Bookman family. The tenant house had deteriorated beyond repair and he moved a mobile home on to the property in January, 1974, that is now being occupied as a residence by the Bookmans. Mayor Ralph Lowe appeared at our meeting and made the recommendation that Mr. Bofysil be allowed to keep this mobile home on his property. His reasons were that Mr. Bofysil had cooperated with the City of Friendswood in some drainage problems and the Bookmans were old residents of Friendswood who had raised eight (8) children here. Mr. William P. Murphy and his wife testified that they were neighbors of the Bookmans and asked that the mobile home be left in place. Motion was made by Taylor and seconded that a variance be granted allowing this mobile home to remain on the Bofysil farm. Motion carried unanimously. The next case was presented by Mrs. Clayton R. Manchaca who lives at 208 East Heri- tage Drive with her husband. The Manchaca's purchased this property on which there was an old mobile home trailer. This old trailer finally deteriorated beyond repair so they purchased a new mobile home and placed it on the lot and are now living in same. Since this area is not zoned for mobile home use under the present zoning map, a new mobile home put on the lot to replace the old one is a non-conforming use per Ordinance #174, Section 6, Paragraph 4b, Page 15. It was brought out in the testimony that there are two other mobile homes occupied as residences on the adjoining lots. Also, these lots are too small to allow a perma- nent type house to be built on same and occupied as a residence. It was moved by Taylor that this new mobile home be allowed to remain on the property as a special exception because it was an improvement over the old one and therefore did not detract the neighborhood, and actually enhanced the use of this lot. Motion seconded by Fossler and passed unanimously. a BOARD OF ADJUSTMENT MINUTES February 28, 1974 Page 2 The third case was a variance of the building code on how far structures must be set back from the property line. This case was presented by Mr. Bernard Brooks, Attorney and Mr. Dave Wilson, Architect, representing National Investors in their shopping center at Captains Corner. National Investors was granted a building permit by the City of Friendswood some years ago and part of their complex of buildings bordering on Heritage Drive is only about 6-1/2 feet from their property line. They wish to put an addition of approxi- mately 3000 square feet on to one building that would also be only 6-1/2 feet from the property line to accomodate the needs of a new tenant, Weiners. Several hearings on this matter had taken place between National Investors people and the Friendswood Planning and Zoning Board. Mr. Ken Fossler of the Planning and Zoning Board was called into our meeting and testified that his Board recommended approval of this variance. The reasons were that National Investors had agreed to make major improvements to their buildings and property as recorded in the minutes of the Plan- ning and Zoning Board. Also, there would not be any hazards to people using Heritage Drive on the adjoining property by this addition. See the drawings attached as part of the presentation which show the nature of the addition. Motion made by Rummel, seconded by Mrs. Fossler that the variance be granted. Motion passed unanimously. Mrs. Fossler recommended, and the Board agreed, that the City Council and Planning and Zoning Board be asked to amend the zoning restrictions so that on large acreages (5 acres or more) the Board of Adjustment be allowed to grant variances. The reason- ing behind this is that the City of Friendswood has annexed areas that are farm land, but are classified as residential unless otherwise designated. As long as this farm land is used for agricultural purposes, the owners are going to want to occasionally do things that do not conform to the residential zoning restrictions. Mrs. Fossler is to present this to Council. Also, Mrs. Fossler agreed to contact the School Board and see what action is being taken to shut off the road adjoining the Junior High School, known as F.I.S.D. No. 1, to vehicle traffic.
