BOARD OF ADJUSTMENT
January 20, 1972
The Friendswood Zoning Board of Adjustment held a public hearing at the
City Hall in Friendswood on Thursday, January 20, 1972. The following
Board members were present:
Mrs. Ivy Fossler, Chairman
Mr. William E. Dykes
Mr. George Rummel , Secretary
Mr. Helmut Erwing, Attorney substituting for
Ody Jerden
Board Members Absent:
Mr. Truman Taylor
Mr. Ody K. Jerden, City Attorney
Also present to represent the defendents:
Mrs . Greg Hughes
Mr. Robert A. Harkowitz, Attorney
Mr. and Mrs . James Lowdermilk
Mrs. Fossler opened the meeting at 8:20 p.m. by asking Board Secretary to
read the minutes of the last meeting. Several corrections were made and noted
on file copy of minutes.
Mr. Harkowitz requested that the words "mobile home" be struck out of the
minutes of January 6 wherever any of his statements using this appeared, and
the word "building" be substituted.
Mr. Dykes suggested adjournment because we only had three (3) Board members
present and the Ordinance requires that four (4) members concur on any
decision that reverses a determination of the Administrative Official . How-
ever, the meeting continued despite the fact that no decision could be made
by the Board.
Mr. Erwing asked several questions about matters he said were not clear to
Mr. Jerden and was given copies of letters from the files to take to Mr. Jerden.
Mr. Harkowitz gave the opinion that the building in question should not be
called a "mobile home" in this case as it was being used as a place of business.
This was challenged by Mr. Rummel , who felt that no matter what the end use
of the building, it was still a mobile home as described in the Ordinance.
The meeting was finally adjourned with no definite date set for the next
meeting because the Board must have additional members appointed by the City
Council to insure sufficient people at a meeting to make decisions .
