MINUTES OF THE CHARTER REVIEW COMMISSION MEETING THAT WAS HELD ON THURSDAY,
JULY 18, 1996 AT 7:00 P.M. AT FRIENDSWOOD CITY HALL, SECOND FLOOR CONFERENCE
ROOM, 910 S. FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS WITH THE FOLLOWING
PRESENT CONSTITUTING A QUORUM:

CHAIRMAN HUFFMAN SUGGESTED THAT THE COMMISSION GO THROUGH THE REVISIONS THAT'
WERE SUBMITTED BY CITY ATTORNEY JOHN OLSON.
DISCUSSION WAS HELD REGARDING THESE REVISIONS RELATING TO SECTIONS 2.03, ,
2.05, 2.06, 3.01, 3.09, 3.12, 4.06, 5.04, 5.06, 6.02, 6.04, 7.02, 8.05, '
(CITY MANAGER COX ARRIVED AT THIS TIME), 8.07, 9.03, 9.07, 9.10, 10.01,
ARTICLE X, SEC. 11.01, 11.09, AND 11.10.
FOLLOWING THE DISCUSSION OF THESE SECTIONS, VOTING BY THE COMMISSION TOOK
PLACE REGARDING THE PROPOSED AMENDMENTS TO THE CHARTER OF THE •CITY OF
FRIENDSWOOD.
**BLAISE GUZZETTA MOVED TO APPROVE PROPOSED AMENDMENT NO. 1 REGARDING THE
SECOND SENTENCE OF SECTION 2.03 OF ARTICLE II OF THE CHARTER OF THE CITY OF
FRIENDSWOOD, TEXAS, WHICH PROVIDES THAT THE CITY EXERCISE THE POWER OF;
EMINENT DOMAIN BY THE LAWS GOVERNING THE CONDEMNATION OF PROPERTY BY'
RAILROAD CORPORATIONS, SHALL BE DELETED IN ITS ENTIRETY.
SECONDED BY ED DRISKILL. THE MOTION PASSED UNANIMOUSLY.
**ED DRISKILL MOVED TO APPROVE PROPOSED AMENDMENT NO. 2 REGARDING THE THIRD
PARAGRAPH OF SECTION 2.50 OF ARTICLE II OF THE CHARTER OF THE CITY OF
FRIENDSWOOD, TEXAS, WHICH PROVIDES PROCEDURES FOR THE ADOPTION OF STREET;

PARAGRAPH OF SECTION 3.09 OF ARTICLE III OF THE CHARTER OF THE- CITY OF;
FRIENDSWOOD, TEXAS, SHALL HEREAFTER PROVIDE AS FOLLOWS; "MEETINGS OF COUNCIL'
- ALL MEETINGS OF THE COUNCIL SHALL BE HELD IN ACCORDANCE WITH APPLICABLE
OPEN MEETINGS LAWS."

**ED DRISKILL MOVED TO APPROVE PROPOSED AMENDMENT NO. 6 REGARDING SECTION,
3.12 OF ARTICLE III OF THE CHARTER OF THE CITY OF FRIENDSWOOD, TEXAS, SHALLI
HEREAFTER PROVIDE AS FOLLOWS: "EMERGENCY ORDINANCES -- TO MEET EMERGENCIES;
THE COUNCIL MAY ADOPT EMERGENCY ORDINANCES. SUCH ORDINANCES SHALL NOT
GRANT, RENEW, OR EXTEND FRANCHISES, OR REGULATE RATES CHARGED BY A PUBLIC
UTILITY. EACH EMERGENCY ORDINANCE SHALL CONTAIN A PROVISION DESCRIBING THE
NATURE OF THE EMERGENCY. AN EMERGENCY ORDINANCE MAY NOT BE ADOPTED UNLESS
NECESSARY TO PREVENT OR MITIGATE AN IMMINENT THREAT TO PUBLIC HEALTH OR
SAFETY. THE AFFIRMATIVE VOTE OF FOUR (4) COUNCILMEMBERS SHALL BE REQUIRED

CHARTER OF THE CITY OF FRIENDSWOOD, TEXAS, SHALL HEREAFTER PROVIDE AS
FOLLOWS: "(c) PROHIBITED ACTS: NO PERSON EMPLOYED IN THE ADMINISTRATIVE
SERVICE OF THE CITY, OR WHO SEEKS APPOINTMENT THERETO, SHALL BE APPOINTED,
PROMOTED, REDUCED, REMOVED, OR IN ANY WAY FAVORED OR DISCRIMINATED AGAINST
BECAUSE OF HIS/HER RACE, COLOR, NATIONAL ORIGIN, AGE, DISABILITY, VETERAN

HEREAFTER PROVIDE AS FOLLOWS: "POWER TO TAX - THE COUNCIL OF THE CITY SHALL
HAVE THE POWER, AND IS HEREBY AUTHORIZED TO LEVY, ASSESS, AND COLLECT,
ANNUAL AD VALOREM TAXES AT RATES NOT EXCEEDING LIMITS ESTABLISHED BY THE
CONSTITUTION OR LAWS OF THE STATE OF TEXAS, AS THEY NOW EXIST OR AS THEY MAY

SERVICE CORPORATION, PARTNERSHIP, OR PROPRIETORSHIP WHO SHALL FOR A 30-DAY
PERIOD WILLFULLY REFUSE OR FAIL TO REPORT IN THE MANNER PROVIDED BY THIS
CHARTER SHALL FORFEIT AND PAY TO THE CITY THE SUM OF $1,000 PER DAY FOR EACH

CITY SHALL BE MAINTAINED AND AVAILABLE FOR PUBLIC INSPECTION AS PROVIDED BY

INTRODUCTORY PARAGRAPH OF SECTION 11.09 OF ARTICLE XI OF THE CHARTER OF THE
CITY OF FRIENDSWOOD, TEXAS, SHALL HEREAFTER PROVIDE AS FOLLOWS: "THEI
COUNCIL SHALL APPOINT AT ITS FIRST REGULAR MEETING IN JULY OF EVERY FIFTH
YEAR AFTER APPROVAL OF THIS CHARTER, A CHARTER REVIEW COMMISSION COMPOSED OF
SEVEN (7) CITIZENS OF THE CITY OF FRIENDSWOOD. THE CITY SECRETARY SHALL
CAUSE WRITTEN NOTICE OF APPOINTMENT TO BE DELIVERED TO EACH PERSON APPOINTED

DISCUSSION FOLLOWED AS TO THE -SCHEDULING OF THE NEXT MEETING TO BE HELD JULY

THE FINAL MEETING OF THE COMMISSION TO BE HELD ON AUGUST 15, 1996.
