HomeMy WebLinkAboutZBOA Minutes 1987-08-25 Regular ti REGULAR MEETING BOARD OF ADJUSTMENT AUGUST 25 , 1987 MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF FRIENDSWOOD WHICH WAS HELD AT CITY HALL ON AUGUST 25 , 1987 WITH THE FOLLOWING MEMBERS CONSTITUTING A QUORUM: CHAIRMAN HAL TAYLOR REGULAR MEMBER MAURICE ESTLINBAUM REGULAR MEMBER DR . TOM SULLIVAN REGULAR MEMBER STEVE JOHNSON ALTERNATE MEMBER MARY ELLEN BELLARD ALTERNATE MEMBER HOWARD YEAGER SIGN CODE ENFORCEMENT OFFICER CAROLYN MAUTNER SECRETARY JANE TOLLETT CHAIRMAN HAL TAYLOR CALLED THE MEETING TO ORDER . MARY ELLEN BELLARD WAS APPOINTED REGULAR MEMBER FOR THIS MEETING. CHAIRMAN TAYLOR CALLED FOR PUBLIC INPUT REGARDING REQUEST FROM DON BEETH, FRIENDLY COMPUTERS , INC . , 126A SOUTH FRIENDSWOOD DRIVE , TO REQUEST VARIANCE TO ALLOW CONSTRUCTION OF AN ADDITIONAL SHOPPING CENTER PYLON SIGN OR TO INSTALL A FREE STANDING SIGN. DON BEETH STATED HE IS TRYING TO GET THE VARIANCE ON THE 4X8 FOOT FREE STANDING SIGN WHICH IS ON FM518 AT CAPTAIN'S CORNER SHOPPING CENTER . HE FELT THAT HE WAS DENIED THE SIGN PERMIT UNDER IMPROPER GROUNDS WHICH IS SECTION 21 .D . 2 OF THE FRIENDSWOOD SIGN ORDINANCE AND HE IS APPEALING UNDER SECTION 21 .C . 2. JIM PENDLAND , DON BEETH 'S ATTORNEY, STATED THAT HIS SIGN REQUEST CLEARLY DOES NOT FALL UNDER SECTION 9 , WHICH IS PROHIBITED SIGNS , BUT FELT THAT THERE WAS IMPROPER GROUNDS TO DENY THE SIGN PERMIT AS STATED BY DON BEETH. MR . BEETH TOLD THE BOARD THAT HE HAS A TEMPORARY SIGN PERMIT FOR A PERMANENT SIGN AND WOULD LIKE FOR THE BOARD OF ADJUSTMENT TO MAKE IT A PERMANENT ONE . HE FELT THAT THE LOCATION OF HIS BUSINESS IN THE CENTER NEEDS A GOOD SIGN AND IF THE COMPANY NAME IS PUT ON THE PYLON SIGN IT WILL TOO SMALL FOR ANYONE TO SEE AND HE NEEDS THE 4X8 SIGN FOR ADVERTISEMENT . HE TOLD THE BOARD HIS BUSINESS IS DOING WELL NOW BECAUSE OF THE SIGN BUT THE WEEK IT WAS TAKEN DOWN THAT THE BUSINESS WENT DOWN WITH IT . THE LARGE SIGN, HE FEELS , IS AN INTEGRAL PART OF THE FRIENDLY COMPUTERS COMPANY STAYING OPEN FOR BUSINESS . DISCUSSION FOLLOWED AT LENGTH. CHAIRMAN TAYLOR CALLED FOR CONSIDERATION AND POSSIBLE ACTION REGARDING REQUEST FROM DON BEETH, FRIENDLY COMPUTERS , INC . , 126A SOUTH FRIENDSWOOD DRIVE , TO REQUEST VARIANCE TO ALLOW CONSTRUCTION OF AN ADDITIONAL SHOPPING CENTER PYLON SIGN OR TO INSTALL A FREE STANDING SIGN. 1 DON BEETH DISCUSSED WITH MEMBERS OF THE BOARD THE FACT THAT HE FELT THAT HE HAD BEEN IMPROPERLY DENIED A VARIANCE FROM THE CITY STAFF FOR HIS SIGN. HE STATED THAT IF THE BOARD WERE TO OVERTURN THE RULING OF THE CITY STAFF IN DENYING HIM THE SIGN AND IF THEY WILL NOT OVERTHROW IT, THEN WE WILL TALK ABOUT THE VARIANCES. **STEVE JOHNSON MADE THE MOTION THAT THAT WE DO NOT OVERTURN THE DENIAL. DR. TOM SULLIVAN SECONDED THE UNANIMOUSLY. THE STAFF RULED PROPERLY AND MOTION. MOTION APPROVED DON BEETH AGAIN STATED THAT THE NEED FOR THE 4X8 SIGN IS A VIABLE PART OF HIS BUSINESS AND IS THE ONLY WAY THAT THE PUBLIC WILL KNOW THAT HIS OFFICE IS IN THE CAPTAIN'S CORNER SHOPPIN G CENTER. **STEVE JOHNSON MADE THE MOTION TO GRANT THE VARIANCE TO ALLOW THE NEW BUSINESS A TEMPORARY SIGN FROM NOW UNTIL JANUARY 1, 1988. MAURICE ESTLINBAUM SECONDED THE MOTION. MOTION APPROVED UNANIMOUSLY. AT THIS TIME DON BEETH WITHDREW THE OTHER APPLICATION.
