BOARD OF ADJUSTMENT
! REGULAR MEETING
DECEMBER 16, 1986
' MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT
OF THE CITY OF FRIENDSWOOD WAS HELD ON DECEMBER 16, 1986 AT CITY
HALL AT 7:00 P.M. WITH THE FOLLOWING PRESENT:
CHAIRMAN ED DYKES
REGULAR MEMBER DR. TOM SULLIVAN
REGULAR MEMBER ELVIA SALYER
ALTERNATE MEMBER STEVE JOHNSON
ALTERNATE MEMBER KENNETH KONCABA
ALTERNATE MEMBER HOWARD YEAGER

CHAIRMAN DYKES CALLED THE MEETING TO ORDER. STEVE JOHNSON JOHNSON
AND KENNETH KONCABA WERE APPOINTED REGULAR MEMBERS FOR THIS
MEETING.
CHAIRMAN DYKES CALLED TO ORDER A PUBLIC HEARING FOR THE PURPOSE
OF RECEIVING TESTIMONY FROM INTERESTED PERSONS REGARDING THE
REQUEST FROM JEAN PHARR OF ANTHONY POOLS, REPRESENTING EFRAIN
ZUNIGA, OF 1801 PALO DURO, CARMEL VILLAGE SUBDIVISION, TO REQUEST
A VARIANCE OF 15 FEET FROM REQUIRED SIDE BUILDING LINE OF 20 FEET
TO BUILD A POOL.
MRS. PHARR STATED PRESENTED PICTURES OF THE POOL AT ALL ANGLES
WHICH SHOWED HOW CLOSE THE POOL HAS BEEN DUG TO THE BUILDING
LINE. SHE STATED SHE MADE THE ERROR IN THE DRAWING OF THE POOL ON
THE PLOT FOR THE BUILDING DEPARTMENT. WHEN NICK CAPUANO, BUILDING
INSPECTOR, WENT TO INSPECT THE POOL IT WAS INSIDE THE BUILDING
LINE BY FIVE FEET. SHE WAS TOLD SHE WOULD HAVE TO APPLY TO THE
BOARD OF ADJUSTMENT FOR A VARIANCE BECAUSE IT WAS IN LINE WITH
THE RESTRICTIONS OF THE ORDINANCE.
NICK CAPUANO STATED THAT THE HOME WAS ON A CORNER LOT AND TOTALLY
ENCASED BY A WOODEN FENCE. FROM THE PICTURES ONE COULD SEE THAT
THE POOL WAS RIGHT UP TO THE FENCE. DR. TOM SULLIVAN STATED THAT
BECAUSE THE POOL IS ENCLOSED BY A FENCE SO IT SHOULD BE NO
PROBLEM TO THE NEIGHBORS. DISCUSSION FOLLOWED AT LENGTH.
CHAIRMAN DYKES REQUESTED PUBLIC INPUT FROM INTERESTED PERSONS
REGARDING THE REQUEST FROM JACK CORNETT OF EDCO, INC. ,
REPRESENTING MR. TRI TAN NGUYEN OF 7-CROWN GROCERY STORE, 3698
FM528, TO REQUEST A VARIANCE TO INSTALL A NEW 6X7 FOOT TEXAS
TRADEMARK SIGN AND 2 SETS OF 30 INCH LETTERS AT THE GAS PUMPS.
MR. CORNETT TOLD THE BOARD MEMBERS THAT ONE OF THE

PREREQUISITES TEXACO REQUIRES IS REQUESTING TO HAVE THEIR LOGO
AND LETTERS ON A. 24X24 INCH CANOPY THAT WOULD BE OVER THE PUMPS.
• THE BOARD MEMBERS ASKED MR. CORNETT MANY QUESTIONS AND DISCUSSION
FOLLOWED AT LENGTH.'
THE BOARD MEMBERS DISCUSSED BETWEEN THEMSELVES THE TOTAL AMOUNT
OF SIGNAGE OF 100 SQUARE' FEET THAT MR. CORNETT IS ENTITLED TO AT
THE STORE. THE DECISION' MADE BY THE MEMBERS IS AS FOLLOWS: ALL
OF THE NEW ITEMS HE HAD . REQUESTED PLUS 7-CROWN IS A' TOTAL OF - 86
SQUARE FEET. ,THAT HE WILL ELIMINATE THE BEER, FOOD, ETC. SIGN ON
THE BUILDING. , „ THAT HE WILL ELIMINATE .THE FREE STANDING 7-CROWN
SIGN. , 'THAT HE WILL ELIMINATE THE FOOD AND GAS SIGN BECAUSE IT IS
IN -THE BACK OF A RESIDENTIAL AREA.' ALL OF THE ABOVE WILL BE LESS
SQUARE FOOTAGE BUT MUCH MORE ATTRACTIVE. - MR. CORNETT SAW NO
PROBLEM' WITH THIS DECISION.
CHAIRMAN DYKES CALLED FOR CONSIDERATION AND POSSIBLE ACTION
REGARDING ' THE REQUEST FROM ' JEAN PHARR OF ANTHONY POOLS,
REPRESENTING' EFRAIN • ZUNIGA, 2802 PALO DUR, • CARMEL VILLAGE
SUBDIVISION • TO' REQUEST 'A VARIANCE OF 15 FEET FROM THE REQUIRED
SIDE BUILDING LINE OF 20 FEET TO BUILD A POOL.-
**ELVIA SALYER 'MADE THE MOTION TO GRANT JEAN PHARR OF ANTHONY
POOLS, REPRESENTING EFRAIN ZUNIGA; A VARIANCE OF 15 FEET FROM THE
REQUIRED BUILDING ' LINE TO BUILD A POOL WITH THE UNDERSTANDING
THAT MR. ZUNIGA. UNDERSTAND THE CURVE BALL THROWN BECAUSE OF THE
PROPERTY LINE AND THAT NICK CAPUANO INFERRED THAT MR. ZUNIGA
COULD HAVE TROUBLE SELLING THE PROPERTY BECAUSE THE POOL IS ON
THE BUILDING LINE. • ' ' •
DR. TOM SULLIVAN SECONDED THE MOTION.
THE MOTION FAILED. ' STEVE JOHNSON AND KENNETH KONCABA VOTED

WILLIAMS PAINT 'COMPANY TO INQUIRE IF HE WOULD LIKE TO COME BEFORE
BOARD OF ADJUSTMENT IN JANUARY 1987'.
STEVE JOHNSON SECONDED THE MOTION. MOTION CARRIED.

**STEVE JOHNSON MADE THE MOTION TO' GRANT THE ABOVE VARIANCE BASED
ON THE FOLLOWING: .
1. THE HEIGHT OF THE TEXACO SIGN IS TO BE 15 FEET.
2. THE EXISTING' PAINTED SIGNS ON THE FRONT AND BACK OF THE
BUILDING BE PAINTED: .
3. 7-CROWN SIGN BE THE ONLY SIGN EXISTING ON THE FRONT OF
THE BUILDING.
4. THE CANOPY BE ALLOWED TO BE BUILT AND 2 TEXACO LOGOS BE
ON ITS TWO SIDES.

KENNETH KONCABA SECONDED STEVE JOHNSON'S MOTION.
DR. TOM SULLIVAN STATED THAT THE PAINTED SIGNS SHOULD BE PAINTED
OVER BEFORE THE NEW SIGNS ARE PUT UP.
**STEVE JOHNSON MADE THE MOTION TO AMEND THE MAIN MOTION THAT THE
PAINTED SIGNS SHOULD BE PAINTED OVER BEFORE THE NEW SIGNS ARE PUT
UP.
KENNETH KONCABA SECONDED THE MOTION. MOTION CARRIED UNANIMOUSLY.
THE MINUTES FROM THE REGULAR MEETING OF NOVEMBER 25, 1986 WERE
APPROVED AS PRESENTED.
CHAIRMAN DYKES PASSED TO ALL OF THE MEMBERS IN ATTENDANCE A LIST
OF EACH MEMBERS ATTENDANCE IN THE LAST 1 1/2 YEARS AND REMINDED
THEM THAT IT IS IMPORTANT THAT THEY SHOW UP TO AS MANY MEETINGS
AS POSSIBLE. HE STATED THAT IN RECENT MONTHS THE ATTENDANCE HAS
NOT BEEN VERY GOOD AND THE BOARD HAS COME CLOSE TO NOT BEING ABLE
TO HAVE A QUORUM.
THE MEETING ADJOURNED AT 8:30 P.M.
